HOP1993-00052 7) There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgement of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. The nature of the business is wholesale automobiles. Quite frankly, I was totally taken by surprise that the City of Tigard planning department has total disregard for its residents. Specifically, the permit has been issued before notice was given to neighbors affected by the decision, which would give them a chance to voice their opinions or concerns about the situation. Please believe me this is not due to any conflict with Mr. Wu as a neighbor. (Quite honestly, I hardly know the gentleman. ) I also have the deepest respect for a person wanting to start or maintain their own business. I am however very concerned that due to the nature of the business, it will bring additional traffic to the neighborhood. There are a lot of children playing in the street constantly. one of the advantages of this street is the fact there isn' t an outlet, which reduces traffic flow. Along with more traffic you are allowing more strangers to be in the neighborhood which will almost certainly raise the incidence for crime. We have enjoyed a relatively crime free neighborhood, at least up until now. PAGE (2) : MR. RON POMEROY Mr. Pomeroy, I understand that since the permit has been approved, the burden of proof to appeal the situation rests on the adjacent homeowners, and unless Mr. Wu is in violation of conditions outlined, it will be nearly impossible to cancel the permit. Of the neighbors I have talked to, there hasn' t been one who has favored your decision. Who is responsible for excessive noise and traffic? who is responsible for injuries, especially to children, as a result of extra vehicular traffic? Who is responsible for increased crime in the neighborhood as a result of the decision? I 'd be willing to bet money the city of Tigard won' t accept any of the responsibility. For the record, I want to state I am in total disagreement of this decision. Any violations of the conditions for the permit will be noted and reported to the proper authorities. It would be appreciated if the City of Tigard would let its established residents know what they are planning for them ahead of time, rather than spring it on them by surprise, when it' s too late to do anything about it! The City of Tigard Planning Division does not have "total disregard" for the residents of this city, as stated in your letter. The review of a Home Occupation Permit application by the Planning Division, as well as any other land use application, is entirely nondiscretionary. If an applicant meets the applicable requirements for approval, the legal obligation of the Planning Division is to approve that application. To do otherwise would be to deny the applicant their legal right to the opportunities provided by City Council through the Community Development Code and the Comprehensive Plan.. This permit (HOP 93-0052) has been issued in accordance with the code standards which were approved by the City Council. The City Council approved the existing Home Occupation Permit process through a series of evening meetings with all Neighborhood Planning Organizations as well as public hearings held before the City Council. The Planning Division now administers this process. The City of Tigard does not require a public hearing for nondiscretionary land use decisions. Due to the sensitive nature of Home Occupation Permits and the information which was presented through the public hearing process, the standard 10 day "request for comment" period and the 10 day public appeal period required by the ORS was lengthened by the City Council to 20 days. " You are correct in stating that, unless Mr. Wu is in violation of the conditions outlined in the approval, the Planning Division will not revoke his permit. The burden of proof is always on the one who is making the accusation of illegal behavior, whether it be a neighbor, the City, another business owner, or someone else.
