The subject site, specifically identified as Tax Lot 1000 of Tax Map 2S1 10BC,is approximately 2.80 acres in area and is currently zoned R-7 (Residential, 5,000 square foot minimum lot size)by the City of Tigard. The site contains a few trees and terrain with slopes ranging from 2%to 18%. VICINITY INFORMATION The immediate area is currently undergoing a tremendous transition from a rural community to an upscale residential area. Nearly all of the development within the vicinity of the subject site has occurred within the past five years. Recent development projects within the immediate area include the Woodford Estates,Arlington Heights,Aspen Woods and Turnagain Heights. These developments feature single-family detached homes on 5,000 to 7,000+square foot lots. SITE INFORMATION Site Location The site is located on the south side of SW Bull Mountain Road, east of SW 126th Avenue and SW Winterview Drive. The site is bordered by vacant or underdeveloped property to the east and south, and by the Arlington Heights development to the west. Existing Uses The subject property currently contains a single-family residence. Topography In general,the site slopes to the south and west. Bull Mountain is located to the north and west of the site. Slopes on the property range from 2%to 18%(see Onsite Analysis). Vegetation There are a few large trees located throughout the subject site. Trees with a caliper of 12 inches or greater are identified by species and location on the attached Tree Preservation Plan(See Tree Preservation Plan). Surrounding Land Uses The subject site is located in an area of single-family residential development. Densities vary, ranging from 5,000 square foot lots to parcels containing areas as large as 7.55 acres. East and south of the site are undeveloped parcels containing areas from 1.16 acres to 7.44 acres. Land west of the site is mostly comprised of 7,000 square foot lots in the Arlington Heights development. (See Offsite Analysis Plan). Transportation There is no transit service located within one-half mile of the subject site. Tri-Met Line 12 stops approximately one-half mile west of the subject site at the intersection SW Bull Mountain Road and Highway 99W. Line 12,running every 30 minutes,provides service to downtown Portland or Sherwood. Twelve of the newly created lots will be developed with single-family attached homes. The 2 other new lots will contain single-family detached homes. The remaining lot contains a single-family home at this time. The proposed lots range in size from 5,000 square feet to 19,000 square feet,with an average lot size of just over 5,000 square feet.The resulting gross density is approximately 5.4 units per acre. An existing public street will be extended as part of the proposed development plan(See attached site plans). SW Winterview Drive will be extended approximately 350 feet east from its current alignment at the west side of the site.The applicant will construct full-street improvements as a part of the street extension. A sidewalk at ultimate grade and location will be constructed on SW Bull Mountain Road. • SW Winterview Drive will provide street access to all of the proposed lots and will accommodate the future development of the property to the east. Sanitary sewer and water service will be provided to all proposed lots through the extension of existing lines in adjacent development to the west. There is existing sanitary sewer in SW Winterview Drive just west of the project boundary in Arlington Heights. This line would be extended eastward into the project to serve the lots. Extending the existing line in the SW Winterview Drive right-of-way into the development site will provide water service. Storm water would be handled through a series of pipes,catch basins,and a storm water quality facility. A storm drain line and catch basins would be installed in the proposed section of SW Winterview Drive. A water quality facility will be located in the southwest corner of the project site, (see Storm Drainage&Grading Plan). 18.164.120 This section requires overhead utility lines adjacent to a development to be placed underground or at the election of the developer; a fee in-lieu of undergrounding can be paid. The overhead utility lines that exist along the frontage of SW Bull Mountain Road will be placed underground during the construction of this project. 18390: QUASI-JUDICIAL DECISION MAKING The applicant is submitting a proposal in complete compliance with all relevant code and Comprehensive Plan requirements. Included in the application is all the information requested on the application form, along with this narrative addressing the appropriate criteria in sufficient detail for review and action; the required fees; a list of all surrounding property owners, as well as other potentially affected parties. The Subdivision is consistent with the underlying zoning requirements and all relevant City ordinances and standards. The Washington County Survey Department has approved the proposed plat name. The street in the subdivision is laid out to conform to the adjacent subdivision. This document serves as the narrative for the project and contains an explanation for all of the common improvements proposed. 18.510: R-7 SINGLE FAMILY RESIDENTIAL The property is currently zoned R-7 by the City of Tigard. The City of Tigard will be reviewing the application using the R-7 Single Family Residential Zone standards as established by the City of Tigard. The purpose of the R-7 Land Use designation is to establish sites for single family detached and attached units for medium density residential developments. The proposed use is permitted outright under section 18.52.030. 18.510.2: DEVELOPMENT STANDARDS IN RESIDENTIAL ZONES The proposed development site will comply with the dimensional requirements as laid out in Table 18.510.2, specifically: Setbacks Other Requirements Front Yard 20 feet Min. The net area is derived by subtracting existing home areas at least the size required by the zoning district, public right-of-ways, and private streets from the gross acreage. The density computations for Flower Gardens are as follows: Net Area Calculation Gross Square feet 121,409 (2.80-acres) Minus Public Right-of-ways 22,682 Minus existing lot 6,900(minimum necessary to contain existing home with setbacks) Equals Net Area subtotal 90,227 square feet/5,000 square feet= 18.04 dwellings allowed Minimum Dwelling Units Required: 18.04 X .80= 14.44 units Total Units Proposed 15.00 units 18.720.DESIGN COMPATIBILITY STANDARD In accordance with 18.720.030, the attached units proposed must meet design standards to ensure compatibility with surrounding existing and future development. This attached single-family development abuts property that is zoned for detached single-family development. For Density Transition requirements, building heights within 30 feet of the property line will not exceed 25 feet in height. It should be noted that the units are designed as attached and there is no true density transition occurring on the project site. The site is being developed within the density requirements of the underlying zone,which is the same zone as all abutting properties. All of the units have frontage on a street and entrances are all oriented to the street. The front elevations of the attached units have incorporated design features as shown on the architectural elevations that divide the building facades into planes of less than 500 feet. Individual dwelling units have been emphasized by the use of appropriate design features in accordance with this section. All of the attached units are ground level units and porches have been designed that exceed 48 square feet in area with no dimension less than 6 feet. The rooflines for the attached units incorporate offsets in accordance with this section. The exterior on each of the attached units includes trim to mark all building rooflines, porches, windows and doors that are on a primary structure's street-facing elevations. Items A.2, and G-H do not apply to this project because it is not multi-family development, there is no rooftop equipment,parking or pedestrian circulation associated with multi-family development. I:\532-001\W O RD\SUBNAR53200I.MS.doe 18.725: ENVIRONMENTAL PERFORMANCE STANDARDS The applicant understands that compliance with state, federal,and local environmental regulations are the continuing obligation of the property owner, and will abide by the applicable standards. 18.730.040: ADDITIONAL SETBACK REQUIREMENTS SW Bull Mountain Road contains an additional centerline setback requirement of 30 feet. This project is dedicating right-of-way to SW Bull Mountain Road to include 33 feet from the site to the centerline. This project already exceeds the centerline setback requirement of 30 feet through this dedication. 18.745.040: STREET TREES Street trees will be provided in accordance with this section on the public street and private driveway on the flag lot that exceeds 100 feet in length. The specific standards listed in Section 18.745.045C shall dictate the spacing, size, as well as other specifications inherent to planting of street trees (see Street Tree/Tree Removal/Tree Mitigation Plan). 18.765: OFF-STREET PARKING Under Section 18.765.030 Al, the applicant will provide at least 2 off-street parking spaces for each dwelling unit on the unit's designated lot. 18.780: SIGNS The applicant shall ensure that any signs related to the name of the proposed development shall comply with the relevant standards of this chapter,as they are applicable. 18.790: TREE REMOVAL While the design of this development strives to retain as many of the existing trees as possible, it will be necessary to remove several trees to accommodate grading for streets, utilities and building pads. In accordance with the provisions of this code section a permit will be applied for the removal of any trees having a trunk over six inches or more in diameter, four feet above the ground. This application shall be considered the permit for tree removal. As required by Section 18.790.030, 50 percent of the trees removed from the site will be mitigated (refer to—Tree Removal/Preservation Plan). The plan requires that 82 total caliper inches be mitigated. 18.795: VISUAL CLEARANCE AREAS Any future landscaping will be consistent with this section. There are no intersections proposed that will require the preservation of vision clearance triangles. This item does not apply to this project. I:\532-001\W O RD\S UBNAR532001.MS.doc 18.800: STREET&UTILITY IMPROVEMENT STANDARDS Streets: The public street will be dedicated and constructed to City standards as shown on the plans. SW Winterview Drive will be constructed to a 32-foot width with sidewalks on both sides within a 46-foot right-of-way. The proposed layout will provide access to homes on the site and allow for future extensions to neighboring properties. Sanitary Sewer: Sanitary sewer service is currently available from an existing line in SW Winterview Drive west of the site in the Arlington Heights development. This line would be extended into the site to serve all lots. Surface Water Run-off: Storm water runoff will be collected via a system of pipes and catch basins within the newly constructed portion of SW Winterview Drive. The water will then be conveyed to a stormwater quality swale before being discharged into an existing drainage near the southwest corner of the site. The proposed storm facilities will be constructed in compliance with Resolution 91-47 whereby, the Unified Sewerage Agency and the City of Tigard have agreed to enforce Surface Water Management regulations requiring the construction of said facilities. Domestic Water: Adequate domestic water will be provided to the site by extending the existing line in SW Winterview Drive at the west boundary of the site. Hydrants will be placed to provide adequate fire suppression to all lots within the development. 18.810.030: FUTURE STREET PLAN AND EXTENSION OF STREETS The plans illustrate an offsite analysis plan with future street extensions and connections with neighboring development. There are no bus routes within 500 feet of the site. The nearest bus route and Park and Ride are at the intersection of SW Bull Mountain Road and Highway 99W one-half mile east of the site. The bus line serving this route is Line 12 between Portland and Sherwood. Sidewalks will be provided as a part of street construction for pedestrian circulation through the development. 18.810.040: BLOCKS This project due to its small size is not creating a block that needs to be reviewed per the block standards. However, with future development of adjacent properties and potential alternate access locations to SW Bull Mountain Road are demonstrated on the Future Street Plan. IMPACT STATEMENT IMPACT STATEMENT For Flower Gardens Subdivision Purpose The purpose of the Impact Study is to review existing public facilities and address any proposed modifications to these that will help mitigate the proportionate project impacts that will likely occur as a result of development. All necessary facilities for serving this site are currently in place due to the previous Arlington Heights Development. The transportation system, storm water, sanitary,water and other private utilities are all available and adequate in the immediate vicinity of the subject property. Transportation System SW Bull Mt. Road is classified as a major collector in the Bull Mountain Community Plan. This project will construct a five-foot sidewalk at ultimate design and location to facilitate pedestrian movement. Adequate paving exists to serve traffic from this proposed development and the paving is in excellent condition as well. There are currently no Tri-Met bus routes along SW Bull Mt. Road,however the closest line is Bus 12 at the Hwy 99 and SW Bull Mt. Road intersection. There is a park and ride facility at this intersection which is only 0.6 miles from the proposed development. We expect no adverse impacts to the current capacity of SW Bull Mt. Road as this street was originally established to accommodate traffic generated by the development of the Bull Mt. Area. The city has not requested any additional improvements beyond the sidewalk construction and continuation of wall at Arlington Heights Frontage. SW Winterview Drive provides adequate access to the site via a stub on the western boundary. The street section consists of a 46-foot right-of-way containing 32 feet of paving with curbs and sidewalks. SW Winterview will be stubbed to the east to facilitate future development of adjacent property. Drainage Systems The proposed storm drainage system will be collected via a public piped system and be treated by an water quality swale designed in accordance with the standards set up by the Unified Sewerage Agency. The treated water will then outfall from the swale into an existing drainage on the south side of the site. No detention has been proposed for this project. Conversations with the Unified Sewerage Agency concluded that they would not require detention. The future street connection across the ravine at phase two of Arlington Heights has been partially constructed and contains a 24" culvert. This culvert is of adequate size for the runoff generated from this development. This culvert is located about 760 feet south of the projects southerly boundary and discharge point of the storm drainage system. Parks System No parks exist within the immediate vicinity of the project site. The nearest park is Jack Park, which is 2 miles north of the subject site off of Walnut Street and 124th. Park facilities have not been developed on Bull Mountain as historically the area was of rural character. Water Systems There is currently an 8-inch waterline in SW Winterview that will supply more than adequate flow and pressure for the proposed domestic and fire flows to the housing units. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The TIF shall be calculated at the time of building permit issuance. In limited circumstances, payment of the TIF may be allowed to be deferred until the issuance of an occupancy permit. The purpose of the meeting is to allow the prospective developer to share with you what they are planning to do. This is your opportunity to become informed of their proposed development and to let them know what issues or concerns you have in regard to their proposal. What Happens After The Neighborhood Meeting? After the neighborhood meeting, the prospective developer finalizes their submittal package (often taking into account citizen concerns) and submits an application to the City. Sometimes it takes a while before the developer's application is ready to submit, so there could be several months between the neighborhood meeting and the submittal of an application. Once an application is submitted to the City, Staff reviews it for completeness. Once an application has been deemed complete, the formal application review begins. It takes approximately 6-8 weeks from the time the application is accepted for a decision to be made. Many types of applications require a public hearing at which citizens are given the opportunity to provide comments or concerns. For all types of applications, property owners within 500 feet of the subject parcels receive notice of the public hearing (if applicable), notice of the decision, and are given the opportunity to appeal the decision. What If The Proposal Presented At The Neighborhood Meeting Is Not What Is Actually Submitted? Applicants are not required to submit exactly what was presented at the neighborhood meeting if it generally follows the type of development proposed. This provides for the opportunity to address the neighborhood issues and address other changes necessitated by the development or staff. If the project is entirely different, a new neighborhood meeting would be required. In any case, notice of decision is sent to property owners within 500 feet of the proposed development allowing them the opportunity to appeal. How Do I Know What Issues Are Valid? A decision is reviewed based on compliance with the Tigard Development Code. Review the development code to familiarize yourself with what is permitted and what may not be permitted. A copy of the development code is available for viewing at the Tigard City Library or a copy may be purchased at the Community Development Services counter. You may also contact tal City Planning staff and ask what the standards are for a specific issue. Be prepared, however, that you may not LIKE all the standards, but at least you know what they are. The attendance list is attached. Matthew Sprague of Alpha Engineering, Inc. made a presentation of the proposed 15-lot subdivision that is also requesting Development Review Approval for 12 attached units. A pre- application conference with City staff had been held prior to this meeting. The exhibit presented represented a 15-lot subdivision. Mr. Sprague verbally described the recent annexation, the proposed subdivision, attached units and public facilities. Additionally Mr. Sprague expressed the owner/developer would have preferred to develop larger lots that are similar to those within Arlington Heights. The questions raised by neighbors who attended the meeting ranged as follows: - Noted Winterview will extend straight through the property. - They very strongly favored bigger lots. - Will the hedgerow along Bull Mountain Road be saved? - Neighbors expressed a desire that the property not be developed with small lots because they moved to the area for the benefits the larger lots created. Note: A long time resident spoke to this statement that historically they all moved there when the land was primarily farmed in large parcels. This impact felt by new corners to the area is similar to what they experienced when Arlington Heights and other subdivisions in the area developed. - Do you have a plan with you to show what the attached units look like? - How much will the units cost? - What stage are you in for developing the property and will we hear about it again? - What is the process at the city? - How long before the construction will start? There was a discussion relative to what Tract `A' was at the west property line south of Winterview. Mr. Sprague explained that it was anticipated that a water quality facility would be located in that tract. It was a consensus of the group that they wanted the larger lots. The meeting ended at approximately 7:15 PM. The attendants list is attached. Jerry Palmer of Alpha Engineering, Inc. made a presentation of the proposed 9-lot subdivision that was presented at a pre-application meeting with the City staff. A second exhibit was presented showing the overlay of the proposed project on an aerial photograph of the vicinity. A third exhibit was presented which represented a 14-lot subdivision as would be required to meet the minimum density ordinance of the City of Tigard. Based on the pre-application meeting the property would be annexed to the City and developed through the City Code requirements. Mr. Palmer stated that it still is the desire of the property owner to develop larger lots that are similar to those within Arlington Heights. Mr. Robert Ames, who was involved with the Arlington Heights subdivision to the west end, addressed concerns relative to the ultimate street extension of Winterview. He, along with Mr. Dale Johnson, were strong in their opinion that the road should not be extended to the easterly boundary of the Stevens' property. They did appear to agree that a road needed to be extended to the adjoining properties to the south or east and were suggesting that the road knuckle and bend to the south at the existing home. They had strong opinions about the lost opportunity to work with Mr. Stevens in the past to arrange for a "logical" street extension to service the Stevens' property as well as the balance of their ownership's to the east and south. They stated their feelings about the lack of cooperation of Mr. Stevens during the process of previous development studies and proposals in the area. They asked me to pass on their concerns to Mr. Stevens. Other neighbors also spoke to the proposal. The questions ranged as follows: - Why not cul-de-sac Winterview? - They very strongly favored the bigger lots (9-lot plan) and absolutely not the 14-lot plan. - Mr. Kevin Cappuzzi suggested that the Arlington sound wall along Bull Mountain Road could, and should, be extended along the Stevens' property. - Mr. Cappuzzi also offered the observation that the Stevens' property could be annexed to the Arlington Heights Home Owners Association with 75% vote of the property owners within Arlington Heights. - It was mentioned that there is a spring on the proposed lots 1 and 2. I:1532-0OI\word1532 t meeting_mins There was discussion relative to the future streets plan as it would affect properties to the south and to the east. Mr. Johnson suggested that there could be a future street plan without further access to Bull Mountain Road and only a south connection to a road leading to Beef Bend Road. Some of the neighbors reacted negatively to that. Some felt that there should be an extension north to Bull Mountain Road so that circulation going north would be minimized through Arlington Heights. Again, Mr. Ames felt that a straight extension of Winterview to the easterly Stevens boundary would not be feasible for ultimate development to the east, because it was unfeasible to build a future road extension with partialization and improvements as they are now. All seemed to see a future streets plan with a connection to Aspen Ridge Drive to the west and an extension to the south that would lead down to Beef Bend Road. There was a discussion relative to what Tract `A' was at the west property line south of Winterview. Mr. Palmer explained that that was anticipated to be a water quality swale in that tract. Mr. Palmer also explained that it would be desirable to look to other options and that the water quality or the storm water detention systems has not been finalized. There were concerns raised about the trees that had been planted at the subject properties west property line that were a part of the consideration for the development of Arlington Heights. The neighbors obviously wanted to see as many trees saved as possilbe. It was a consensus of the group that they wanted the larger lots. They do not want the minimum density rule to be applied and forced into the 14- lot subdivision. They ask that we continue to keep them informed and utilize the sign-up sheet for mailings, or even if possible, to have another meeting as our plans evolved. Staff has conducted a preliminary review of the application and determined that the following required information needs to be submitted before your application can be deemed complete: • Submit 2 sets of pre-stamped addressed envelopes for the property owners within 500 feet of the subject site. • Provide an arborist report prepared by a certified arborist. The tree removal and mitigation plan is required to be prepared by a certified arborist. The plan must also inventory the trees to determine the health and feasibility of retaining specific trees. • Submit a compliance letter (Service Provider Letter) from Unified Sewerage Agency (USA) in accordance with the standards that became effective on February 5, 2000. • Submit a copy of the reduced site plan (8 '/2 x 11). • Revise the narrative to address the block standards in more detail. Section 18.810.040.B.2 states that "bicycle and pedestrian connections on public easements or right-of-ways shall be provided when full street connection is not possible. Spacing between connections shall be no more than 330 feet, except where precluded by environmental or topographical constraints, existing development patterns, or strict adherence to other standards in the code." The plan must either be revised to show this pedestrian connection or you must submit justification for why a connection is not possible in this area. • Specify which lots are proposed to have attached units and submit elevation plans of the attached units for staff to review for compliance with the Design Compatibility standards. • Revise the future street plan. Venture properties is working with tax lot 1100 and 1200 to the south and have already expressed concern with the future street plan. As proposed, it would force an extra long cul-de-sac on these parcels. It does not appear that storm water will receive full treatment in the swale. The water would enter in the middle, which is not a good design. Submit a plan that shows the storm line in Winterview extending to the east property line. Once the required information is submitted, staff will deem the application complete and begin the review process. The estimated processing time once and application is deemed complete is 6-8 weeks.
