The city is requesting Planning Commission approval of a Comprehensive Plan Amendment. The plan will amend the Comprehensive Planning map to include land use designations for the River Terrace Concept Plan (RTCP) area and to amend Goal 14 policies which will guide regulation of the RTCP area during and after completion of the community planning process. The proposed land uses are based on recommendations made in the West Bull Mountain Concept Plan (WBMCP). The concept plan is a vision for the River Terrace area created over the course of three years by Washington County with the help of a stakeholder working group (SWG) and a technical advisory committee (TAC). The vision is represented in the land use, transportation and parks framework maps, which are intended to guide the future development of the area. The WBMCP envisions a variety of residential densities and housing types; dispersed densities throughout the community; an area that includes appropriate amounts of commercial uses, parks, trails and open space; and an outline of a multi-modal network of connected streets and walkable blocks. The SWG and TAC both voted to forward the concept plan to the Washington County (WACO) Planning Commission and the county Board of Commissioners for consideration and adoption. In November 2010, the WACO Planning Commission voted to recommend the County Board adopt the concept plan. In December 2010, the County Board adopted the concept plan by Resolution and Order. Since the conclusion of the concept plan, the city annexed a portion of the area (Area 64) in fall 2011. In spring 2012, the city agreed via an intergovernmental agreement (IGA) with Washington County to refine its West Bull Mountain Concept Plan into the River Terrace Community Plan. The concept plan is a vision. The community plan will put into place a means to implement the vision of the concept plan through zoning, development code regulations and other measures that will make urban development possible. The process will include 11 total tasks that also include updates to utility, parks and transportation master plans, including the financial strategies necessary to fund and maintain required infrastructure improvements. One of the tasks is to adopt the concept plan's recommended land uses (Exhibit A of the Staff Report) into the Tigard Comprehensive Plan. This is what the city is asking of the Planning Commission at this meeting. This action will set expectations for the community planning process, as well as allow the city to access a portion of the Construction Excise Tax (CET); funds from Metro that are given to the city through the Intergovernmental Agreement (IGA) with Washington County. The proposed amendments before the Planning Commission at this meeting will not allow urban level development until the River Terrace Comprehensive Plan is complete. These recommended land uses will be further analyzed as part of the community planning process and if there is needed refinement recommendations will be brought back to the planning commission and city council for adoption at the end of the process. The proposed amendments meet the criteria of TCDC (Tigard Comprehensive Development Code), including noticing requirements. A Public Hearing notice was published in the Tigard Times on November 15th. Staff sent out over 600 public hearing notices to property owners inside the River Terrace area and outside the area within the 500' perimeter. Requests for comments were also sent to a number of partner agencies. The City of Beaverton sent in comments (Attachment 1 to the staff report) suggesting more policies to outline collaboration with them during the RTCP process and South Cooper Mountain planning process. The city found sufficient existing policies to signify its commitment to collaboration. City staff has met with Beaverton staff several times and representatives from the City of Beaverton are participants on our TAC. Therefore, staff recommends no changes based on the comments The city also received comments today, which were distributed at the beginning of this meeting (which will be included as Attachment 3 to the staff report and shown as Attachment 1 to these minutes), from Michael Robinson, Perkins Coie law firm, representing property owner West Hills Development Company. Mr. Robinson's correspondence reports they are appreciative of the proposed amendments, but feel some refinements will need to be made to the open space designations during the RTCP process. Staff presented Policy 6 (Exhibit A of the staff report) to the planning commission members to confirm staff anticipates consideration of map refinements during the public planning process. The city included this policy as it developed its work program. Staff expects to analyze each element of the concept plan and refine it as necessary. Staff recommends no changes based on the comments. Also important to note, the city doesn't have an open space/park zoning district. Open space areas will be zoned similar to adjacent land uses and development will be regulated by the city's sensitive lands code. This will include Clean Water Services (CWS) mandated stream and wetland buffers, which is the majority of the open space shown in Exhibit A. Although the city didn't get formal comments from ODOT (Oregon Department of Transportation), DLCD (Department of Land Conservation and Development) or Metro, city staff worked with them during formulation of the policies in Exhibit A and all agencies are comfortable with this action. QUESTIONS Commissioner Muldoon had questions about future proceedings. Mr. Wyss responded that the concept plan will go thru a series of 11 tasks. This action is the first task; the concept plan and what's included in it. Each task will be a proposal that will be adopted through the legislative process. Ultimately, council will decide what is or is not included in the community plan. TESTIMONY IN FAVOR Michael Robinson, 1120 NW Couch St, 10th Floor, Portland OR 97208-4128, introduced himself as the land use attorney acting on behalf of West Hills Development Company. Mr. Robinson said city staff is off to a great start but they want to be clear that there is an expectation that there will be refinements to the concept plan. They are looking forward to partnering with the city on this development but expect they will be asking for some changes during the process of translating the vision into actual development on the ground. Dan Grimberg, (West Hills Development Company) West Hills/Arbor, 735 SW 158th, Beaverton, OR 97006, had signed up to testify but waived his time after Nit. Robinson spoke and said simply that he was also looking forward to working with the City to bring his development into the area. Gretchen Buehner, 13249 SW 136th Place, Tigard OR 97223, a Tigard City Councilor, said she was not at the meeting in her capacity as a city councilor but as the attorney representing a couple of property owners from in what was Area 64 and the Urban Reserve immediately to the west. Councilor Buehner stated that she would be recusing herself when this matter comes before the Council. Regarding her clients' properties, Councilor Buehner said due to an administrative oversight at Washington County, a portion of the Urban Reserve was not included in the original concept plan area, the property right along Scholls Ferry. She wanted to make sure the Planning Commission is aware of that and would hope the Planning Commission's recommendation to City Council will include those pieces of property. There will be another Urban Growth Boundary (UGB) expansion in 2014 and any urban reserve must be concept planned before it can be considered for inclusion in the UGB. Staff asked Mr. Wyss if he had knowledge of the properties Ms. Buehner was discussing. Mr. Wyss said the amendment before the Planning Commission at this meeting was just for the area that is currently included in Urban Growth Boundary. The properties Ms. Buehner is talking about are in the Urban Reserve Area. That will be a separate planning process. Councilor Buehner said regardless, she wants to keep reminding the Planning Commission and Council about her clients' properties to make sure the right things get done. MOTION The following motion was made by Commissioner Muldoon: "I move for approval of the application CPA 2012-00002 comprehensive plan amendment for the Tigard Comprehensive Plan Amendment to adopt the West Bull Mountain Concept Plan recommended land uses and associate policies." Commissioner Rogers seconded the motion. The motion was voted on and carried unanimously. CITY COUNCIL GOAL SETTING Interim Community Development Director Tom McGuire participated in a discussion with Planning Commission members to edit the recommendations the Planning Commission will present to City Council as their recommended goals for the Councilors to consider when setting the 2013 Council goals. (See finalized version shown as Attachment 2 to these minutes). I am writing on behalf of West Hills concerning the proposed River Terrace Comprehensive Plan map and text amendments. By adopting these comprehensive plan amendments now, the City of Tigard is setting the stage for the adoption of the River Terrace Community Plan and implementing land use regulations. West Hills very much appreciates the City's work on these amendments because West Hills is ready to develop its properties in the River Terrace area. The proposed map and text amendments, while setting the stage for the River Terrace Community Plan and implementing land use regulations, will not allow urban development in the River Terrace area until such time as the Community Plan, including land use regulations, is adopted. Therefore, while proposed Comprehensive Plan Goal 14.3, Policy 6, provides that the proposed land use designations will be the basis for the Community Plan and that refinements to the map amendments "shall be considered during the public planning process for the River Terrace Community Plan," West Hills would like the Planning Commission to know that it will be important to adopt some refinements.to the land use designation.
