The business would provide health and educational classes, either one on one or in a small group setting by appointment only. The home occupation would occupy approximately 300 square feet of an existing residence and would allow one outside employee to visit the property. No external changes are proposed as part of the application. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions of approval. The findings and conclusions on which the decision is based are discussed in Section IV. The applicant shall obtain all necessary permits for any structural, mechanical, electrical, or plumbing work performed as part of the home occupation. 4. The applicant shall obtain and annually renew a City of Tigard business license and any and all State and Federal approvals,permits,and licenses. SECTION III. BACKGROUND INFORMATION& PROJECT DESCRIPTION The project site is located at 9230 SW 74`h Avenue, south of SW Taylors Ferry Road. The property is 16,552 square feet in size and contains a single-family home, two car garage and driveway. The site is surrounded by single family homes on all four sides. This application for a Type II Home Occupation would permit the owner to conduct health and educational classes at the existing residence. At this time, the applicant does not have an outside employee but may in the future.All activities will be contained within a 300 square foot area of the existing residence. The business will not generate more than six daily customers. SECTION IV. APPLICABLE REVIEW CRITERIA& FINDINGS As set forth in Table 18.510.1 of the Tigard Development Code, home occupations are an allowed land use in all residential zones, subject to the approval standards and criteria contained in Chapter 18.742 (Home Occupations). Relevant standards and approval criteria are addressed below. 18.742 Home Occupations 18.742.040 General Approval Criteria A. General criteria. All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. 1. Home occupations may be undertaken only by the principal occupant(s) of a residential property. The applicant is the owner and occupant of the residence that will be undertaking the proposed home occupation. In the future, the owner may have one additional employee; however, it is not proposed at this time. This standard is met. 2. There shall be no more than three deliveries per week to the residence by suppliers. The applicant states that the home occupation will not generate more than three weekly deliveries. This standard is met. 3. There shall be no offensive noise,vibration, smoke, dust, odors,heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725, Environmental Performance Standards. The home occupation is teaching health and educational classes which do not generate any of the items listed above. All classes will be conducted indoors between the hours of 8 AM and 10 PM. This standard is met. 110P2014-00004 SILKI:DEOCA HOME OCCUPATION PERMIT PAGE 2 OF 6 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. All activities associated with the home occupation will be within the primary residence. The home occupation will occupy approximately 300 square feet, approximately 15%, of the existing residence. This standard is met. 5. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit. Any accessory building that is used must meet State Building Code requirements. No changes are proposed and the home occupation is not proposed within an accessory building. This standard is met. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit,if required as per this chapter, and each shall also have separate Business Tax Certificates. A search of city records shows no other home occupations at this site. This standard is met. 7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. The home occupation will not have any storage or distribution of toxic or flammable materials. The proposal was referred to the Tualatin Valley Fire & Rescue for review and comments. TVF& R reviewed the proposal reviewed the proposal and stated no concerns. This standard is met. 8. No home occupation shall require any on or off-street parking other than that normally required for a residence. The project will not require any additional parking than is already provided for the existing residence. The existing residence has a two car garage and a large driveway available for use by the occupants or any employees and visitors. This standard is met. 9. The following uses are not allowed as home occupations: a. Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c.Junk and salvage operations; 110P20I4-00004 SILKE DEOCA HOME OCCUPATION PERMIT PAGE 3 OF 6 d. Storage and/or sale of fireworks The proposed home occupation does not involve any of the above land uses. This standard is met. 10. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. The applicant did not state whether they will be utilizing a vehicle for the home occupation. A condition of approval will ensure this standard is met 18.742.050 Type I and Type II Home Occupations Defined A. Type I and II home occupations defined. Home occupations shall be administered as either Type I or Type II uses.A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040, home occupations shall observe the following additional standards: 2. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises. Therefore the following is allowed for Type II home occupations: a. One non-illuminated sign, not exceeding 1.5 square feet,which shall be attached to the residence or accessory structure or placed in a window; Signage is not proposed with this application. However,if the applicant decides to have a sign,a permit will be required. This standard does not apply. b. No more than one outside volunteer or employee who is not a principal resident of the premises; At this time, only the applicant will engage in the home occupation. However,the applicant indicted that in the future the home occupation may have one additional outside employee. This standard is met c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; The narrative states that health and educational classes will be provided between the hours of 8 AM and 10PM. Classes will be provided by appointment either one on one or in a small group setting. The business will not generate more than six daily customers,who will park on site. This standard is met. d. Storage of materials,goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has not proposed any outdoor storage of materials.Waste associated with the home occupation will be disposed of with normal household garbage and recycling. This standard does not apply. 18.742.060 Permit Procedures for Type I and Type II Home Occupations 1101'2014-00004 SILKE DEOCA I IOME OCCUPATION PERMIT PAGE 4 OF 6 B. Type II home occupation permit.A Type II home occupation permit will be processed by means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and As discussed above and below in this report, the application is consistent with the standards of this chapter, or will be consistent with conditions of approval. This standard is met. 2. Will be subordinate to the residential use of the property; and As discussed above, the home occupation will be subordinate to the residential use of the property. The home occupation will only occupy 300 square feet of the existing residence, or approximately 15% of the total square footage of all structures on the property. This standard is met. 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. As discussed above and below, and as conditioned in Section II of this report, the home occupation is entirely contained within the residence and will not be detrimental or disruptive in terms of appearance or operation. This standard is met. C. Conditions of approval. The Director may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to, the following: 6. Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; As discussed above, a condition of approval has been added that prohibits customers, clients, and employees from parking in the public right of way,in compliance with this provision. 13. Limiting the type and number of vehicles or equipment to be parked or stored on the site; and As discussed above, a condition of approval limits the type, number, and location of commercial vehicles to be parked and stored on the property,in compliance with this provision. 14. Any other limitations which the Director considers to be necessary or desirable to make the use comply with the purposes stated in Sections 18.745.040 and 18.742.050. As discussed above, conditions of approval have been added to ensure any improvements to the existing residence or property are in compliance with all building division requirements and that parking is accommodated on site. FINDING: As discussed in the analysis above, the proposal meets, or can meet with conditions of approval, all standards and approval criteria pertaining to Type II Home Occupations. AGENCY COMMENTS On February 25, 2014,Tualatin Valley Fire and Rescue stated they reviewed the proposal and have no objections to the proposal. SECTION VII. The case number: HOP2014-00004 and a proposed Type II Home Occupation application on 9230 SW 74th Avenue, Tigard Or 97223. As a home owner who has lived at 7305 SW Shady Ln. for 9 years, I have witnessed and been alarmed by the major growth in traffic around this neighborhood. Since the connection of SW 74th to SW Landau street a number of years ago, the amount of late afternoon to evening traffic during the weekdays has grown immensely. Many people now use SW 74th as a cut-through to get over to Taylors Ferry (from 99W) and the danger at that intersection is starting to worry many residents. Its nearly blind in both directions and to turn in from Taylors Ferry (onto SW74th) can be particulary hairy as its an uphill and you cannot see oncoming traffic. The road is narrow at the intersection and continues to be until the intersection of SW Cedarcrest St. This is a known bottleneck (the stretch of road in front of Ms. DeOca's residence) and one can observe that NO residents will park on the street there. My concern is that if Ms. DeOca has any size group (which has been suggested can be no larger than 6) - more than one vehicle - this will cause those customers to park on the street. If this happens, this will increase the danger for anyone using SW 74th to get to Taylors Ferry and vice versa. There is a small, in- house hair salon called "Divine Hair Design" on SW 74th as well which usually, from what I have observed, has only 1 customer at a time. This resident has a very large driveway and can support at least three cars. I've not seen any ill-effects from the hair salon and am happy that other residents want to have small businesses. I myself have a Creative Design business in my home, but do not have clients at my residence. My concern with Ms. DeOca's studio is that anymore than 1 person at a time, may increase the danger for residents as well as her customers traveling in a congested part of the street. I would be more than happy to "Approve the proposal with conditions", if there is a way she can keep her customers in her driveway and from parking on the street, itself. The burden of proving a home occupation's nonconforming status rests with the property owner or tenant. C. Violations.Home occupations without City or County approval which cannot prove nonconforming status shall be considered in violation of this chapter and shall cease until the appropriate approvals have been granted. C, 18.742.040 General Approval Criteria and Standards A. General criteria.All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. 1. Home occupations may be undertaken only by the principal occupant(s)of a residential property. 2. There shall be no more than three deliveries per week to the residence by suppliers. 3. There shall be no offensive noise,vibration,smoke,dust,odors,heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725,Environmental Performance Standards. 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet.Otherwise,the home occupation and associated storage of materials and products shall not occupy more than 25%of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet.The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire,health and housing codes. 5. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit. Any accessory building that is used must meet State Building Code requirements. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates. Home Occupations 18.742-2 Code Update:10/09 7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence,its occupants,and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. 8. No home occupation shall require any on or off-street parking other than that normally required for a residence. 9. The following uses are not allowed as home occupations: a. Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c. Junk and salvage operations; d. Storage and/or sale of fireworks. 10. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight(GVW)may be parked outside of a structure or screened area. (Ord. 09-13) 18.742.050 Type I and Type II Home Occupations Defined A. Type I and II home occupations defined.Home occupations shall be administered as either Type I or Type II uses. A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040,home occupations shall observe the following additional standards: 1. Type I home occupations. The following characteristics of a Type I home occupation shall be prohibited: a. Outside volunteers or employees to be engaged in the business activity other than the persons principally residing on the premises; b. Exterior signs which identifies the property as a business location; c. Clients or customers to visit the premises for any reason; d. Exterior storage of materials. 4110 ype II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises.Therefore the following is allowed for . Type II home occupations: a. One non-illuminated sign,not exceeding 1.5 square feet,which shall be attached to the residence or accessory structure or placed in a window; b. No more than one outside volunteer or employee who is not a principal resident of the premises; Home Occupations 18.742-3 Code Update: 10/09 c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; d. Storage of materials,goods,and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. 18.742.060 Permit Procedures for Type I and Type H Home Occupations A. Type I home occupation permit.A Type I home occupation permit will be processed by means of a Type I procedure,as governed by Section 18.390.030,after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.1. B. Type II home occupation permit.A Type II home occupation permit will be processed by means of a Type II procedure,as governed by Section 18.390.040,after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter;and 2. Will be subordinate to the residential use of the property;and 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. C. Conditions of approval. The Director may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include,but are not limited to,the following: 1. Further limiting the hours,days,place and manner of operation; 2. Requiring site and building design features which minimize environmental impacts such as noise, vibration,air pollution,glare,odor and dust; 3. Requiring additional building setbacks,and increased lot area,depth or width; 4. Further limiting the building area and outdoor storage used by the home occupation and restricting the location of the use on the site in relationship to adjoining uses; 5. Designating the size,number,location and design of vehicle access points; 6. Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; 7. Requiring landscaping,buffering and/or screening,of the home occupation from adjoining uses and establishing standards for the continued maintenance of these improvements; 8. Requiring storm drainage improvements,and surfacing of parking and loading areas; 9.
