Galer St., Suite 300 Seattle, WA 98119 RE: Tigard Car Toys Minor Modification Approval (MMD2009-00027) 11710 SW Pacific Hwy.;WCTM 1S136CD,Tax Lot 1800 Dear Mr. Surina: This letter is in response to your request for a Minor Modification (MMD2009-00027) of the existing Car Toys site located at 11710 SW Pacific Highway. The applicant has proposed installing two mobile car wash mats. One is proposed within parking along the northwest side of the parcel near Pacific Highway. The other will be placed within the existing garage bays used for vehicle servicing. According to the applicant,approximately three parking spaces will be eliminated bythe outdoor mat. No other changes are proposed by the applicant. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter,states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. Parking requirements are based on building square footage. No building additions are proposed. The applicant states that the current square footage of the building is 5,958 square feet. The current use Motor Vehicle Servicing/Repair. Section 18.765 of the Tigard Development Code requires this use provide a minimum of 2 spaces for every 1,000 square feet of building. Thus the minimum parking requirement is 12 spaces. An aerial photo from the City's Geographic Information System (Tigard Maps) also shows 25 spaces in a slightly different configuration. As noted above, one mat be placed in existing parking spaces near Pacific Highway. This area has two parking spaces and a 20 foot wide garbage collection area according to aenal photos and a site visit. The site plan provided by the applicant shows three spaces and a smaller garbage collection area. The applicant has verified that no changes are proposed to the size or location of the garbage collection/storage area; therefore only two spaces will be impacted. This leaves 23 parking spaces for the use,which exceeds the 12 spaces required. This criterion is satisfied. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to building height. Therefore,this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal is to place a car wash mat within two parking spaces. The proposed location is clear of any accessways and drive aisles. Off-site traffic will not be affected by the proposal. This standard is met. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The applicant projects the traffic will increase by 9-12 cars per week with the new service. This is less than 100 vehicles per day. This standard is met. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. There is no increase proposed to the square footage of the building. Therefore,this criterion is satisfied. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There is no common open space associated with this development. This standard is not applicable. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed car mats will be placed inside the existing building and within existing parking spaces. No landscaping, screening or recreational facilities will be affected. Therefore this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. Staff has performed a search of City Records The original approval for the Car Toys development was issued in August 1997 (SDR97- 00006). A Minor Modification with no case number was approved shortly thereafter (September 1997) to increase the size of the building by 491 square feet. The applicant is not requesting a modification to the conditions imposed at the time of Site Development Review approval, nor does the proposal affect those same imposed conditions. Staff has completed a preliminary review of the submittal materials and is requesting the following items to deem the application complete and process the review: 1. The scope of work on Plan Al states that exterior installation is optional. Is the application requesting approval for both the interior and exterior locations? 2. Please address the Minor Modification criteria found in the Tigard Development Code under Section 18.360.050.B. Provide facts to show how each of the criterion is not applicable to this proposal. The size of the mat is 10'x 20',while spaces appear to be 8' or 8.67'x 16'. The exterior mat will impact two or three spaces. Please show how the minimum parking requirements will still be met. Parking is calculated at 2 spaces for every 1,000 square feet of building. 3. It may be best to re-locate the mat to its original proposed location. The garbage enclosure shown on the site plan differs from what was actually constructed. When I originally saw the plan, I thought you were proposing to change the enclosure. This will involve a washing process, or"pre-rinse" prior to the detailing work. This limited service usually details about 9- 12 cars a week and results in a very small amount of waste water that will be captured and discharged to the on-site sanitary sewer system. Below are some details about the set up: Process 1) •The vehicle is parked on a water reclamation mat. 2) • Pressurized mist application. (Car is sprayed and wiped down) a) •This process uses less than 2 gallons of water. b) •There are no chemicals used in the spray down. c) •There is no washing of the undercarriage or of the engine at all. No grease/oil. 3) •Water is pumped from mat to reclamation tank(60 gallon). 4) • Water is emptied by hand into an existing utility sink (into sanitary sewer). No water is emptied into storm drains. Car Toys is aware of the prohibitions against discharging waste water into the storm sewer and will continue to implement best management practices.
