VI. SITE VISIT BY HEARINGS OFFICER The Hearings Officer visited the site and surrounding area. The hearings officer observed the existing church buildings and parking lot, the field where parking will be expanded, the landscaping on and surrounding the site, and the streets and uses adjoining the site. VII. CONCLUSION AND DECISION The Hearings Officer concludes that the proposed conditional use permit complies with the applicable criteria and standards of the Community Development Code, provided development that occurs after this decision complies with applicable local, state, and federal laws and with conditions of approval warranted to ensure such compliance occurs. In recognition of the findings and conclusions contained herein, and incorporating the Staff Report and other reports of affected agencies and public testimony and exhibits received in this matter, the Hearings Officer hereby approves CUP 94 -004, subject to the conditions of approval recommended in the June 3, 1994 Staff Report. Background Information: HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 1 4 The original sanctuary building was constructed in 1965 and was subsequently remodeled in 1972 and in 1982. Cayton Hall, a 7,656 square foot two story classroom wing, was added in 1974. In 1992, approval was granted (CUP 92 -0001) to add a new Narthex, fellowship hall and classroom addition east of the existing Cayton Hall. The total of those new and expanded spaces was approximately 7,715 square feet. No other development applications have been received for this site. B. Site Information and Proposal Description: The subject site is developed with a Sanctuary facility, Cayton Hall, fellowship hall, classrooms and choir annex. Two separate parking areas are accessible from three driveways on SW Canterbury Lane. The westerly parking area contains 24 parking spaces and the main parking lot, adjacent to SW Canterbury Lane, contains approximately 76 spaces. A ballfield and benches are located to the north of the main parking lot. The site slopes gently to the north and east. The developed portions of this site are landscaped with deciduous and evergreen trees, various shrubs, and lawn. The development proposal consists of the building of a new 9,700 square foot sanctuary, new parking lot area, and modification of existing parking area and access drives. C. Vicinity Information: The 3.58 acre site is surrounded on the north, east and south by properties which are zoned R -3.5 (Residential, 3.5 units per acre). The properties to the west are zoned R- 12 (Residential, 12 units per acre). The historic John F. Tigard House is located to the south of the site across SW Canterbury Lane. A Tigard Water Department storage facility is also located to the south of the site. Most of the surrounding properties are developed with single family residences and condominium/ duplex developments. III. APPLICABLE APPROVAL STANDARDS A. Communi y Development Code: 1. Chapter 18.48.040 lists Religious Assembly as a Conditional Use in the R -3.5 zone. HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 2 2. Chapter 18.130.040 contains the following general approval criteria for a Conditional Use: 1) The site size and dimensions provide adequate area for the needs of the proposed use; 2) The characteristics of the site are suitable for the proposed use considering size, shape, location, topography, and natural features. 3) All required public facilities have adequate capacity to serve the proposal. 4) The applicable requirements of the zoning district are met except as modified by this chapter. 5) The supplementary requirements set forth in Chapter 18.114 (Signs) and Section 18.120.180 (Approval Standards) Site Development Review, if applicable, are met. 6) The use will comply with the applicable policies of the Comprehensive Plan. 3. Section 18.130.150(C)(10) contains the following additional Conditional Use criteria for Religious Assembly and Accessory Uses: a. Lot Size: i. Minimum lot size shall be 20,000 square feet; b. Setbacks: i. The front yard setback shall be a minimum of 25 feet. ii. On corner lots and through lots, the setback shall be a minimum of 20 feet, plus meet visual clearance areas (Chapter 18.102); iii. The side yard setback shall be a minimum of 20 feet; iv. The rear yard setback shall be a minimum of 20 feet: and HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 3 • v. Each setback shall be increased five feet for every 10 feet of building height over 45 feet. 4. Section 18.048.050 (R -3.5 Zone) states that except as otherwise provided in Chapter 18.98, no building in an R -3.5 zone shall not exceed 30 feet in height. 5. Section 18.98 (Building Height Limitations: Exceptions) states that projections such as spires, domes and other similiar objects not used for human occupancy are not subject to the building height limitations. 6. Section 18.100 contains standards for landscaping and screening. a. Section 18.100.015 requires that the applicant submit a landscaping - plan, and that the approval standards are the applicable standards contained in Section 18.100 and which are listed below: b. • Section 18.100.030 (Street .Trees) states that all development projects fronting on a public. private street, or a private driveway more than .100 feet in length shall be required to plant street trees in accordance with the standards in Section 18.100.035. Section 18.100.035(A) requires that landscaping in the front and exterior side yards shall include trees with a minimum caliper of two inches at four feet in height as specified in the requirements stated in subsection 18.100.035(B). Section 18.100.035(B) requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium. or large). c. Section 18.1 00.110 (A) (Screening of Parking and Loading Areas) requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. Section 18.100.130 (Buffer Matrix) requires that where any parking lot with greater than 50 spaces abuts a residential use, there shall be a 20 foot buffer required between the two uses. 7. Section 18.102.020 (Visual Clearance) requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right -of -ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the - street right -of -way and the driveway and then connecting these two 30 foot distance points with a straight line. 8. Section 18.106 (Off -Street Parking and Loading) contains standards for parking and loading. a. Section 18.106.030(B)(8) (Parking) requires 1 space for every 6 fixed seats or every 12 feet of bench length in the assembly area or every 100 . square feet of floor area in . the assembly area where there are no permanent seats, whichever is greater. b. Section 18.106.050(M) requires that artificial lighting on all off - street parking facilities shall be designed to deflect all light so as not to create a hazard to the public use of any road or street. c. The Americans with Disabilities Act (ADA), which became effective on January 26, 1992, requires 6 disabled parking spaces if 151 to 200 parking spaces are provided. d. Section 18.106.020(P) (Bicycle Parking) requires one bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking. aisles, landscape areas, or pedestrian ways. 9. Section 18.108.080 (Access and Circulation - Minimum Requirements) requires that uses which provide greater than 100 parking spaces provide a minimum of HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 5 two accesss with a width of 30 feet. The minimum pavement width shall be 24 feet. In addition, section 18.120.180 (A)(11)(b) requires that circulation patterns within a development be designed to accomodate emergency vehicles. 10. Section 18.108.050(A) requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. 11. Section 18.114.130 (A) (Signs) lists the type of allowable signs and sign area permitted in the R -3.5 zone. 12. Chapter 18.150 requires a permit and contains standards for removal of trees having a trunk 6 inches or more in diameter measured four feet above the - ground on undeveloped residential land. A permit for tree removal must present rationale which complies with specified criteria in order to obtain approval. 13. Chapter 18.164 contains standards for streets and utilities. • a. Section 18.164.030(A) requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section 18.164.030(E) requires Minor Collector streets to have a minimum 60 foot right -of -way and a 40 foot minimum roadway width, and 2 -3 moving lanes. c. Section 18.164.090 requires sanitary sewer service. d. Section 18.164.100 requires adequate provisions for storm water runoff and dedication of easements for storm drainage facilities. B. Applicable Comprehensive Plan Policies. 1. Policy 2.1.1 provides the City will assure that citizens will be provided an opportunity to participate in all phases of the planning and development review process. Policy 4.2.1 provides that all development within the Tigard urban planning area shall comply with applicable federal, state and regional water quality standards. 3. Policy 7.1.2 provides the City will require, as a condition of development approval, that public water, sewer, and storm drainage will be provided and designed to City standards and utilities placed underground. 4. Policy 7.3.1 provides the City will coordinate water services with water districts. 5. Policy 7.4.4 requires all new development to be connected to an approved sanitary sewer system. 6. Policy 8.1.1 provides the City will plan for a safe . and efficient street and roadway system that meets current needs and anticipated future growth and development. 7. Policy 8.1.3 provides the City will require as a precondition of approval that: a. Development abut a dedicated street or have other adequate access: b. Street right -of -way shall be dedicated where the street is substandard in width; c. The developer shall commit to construction of the streets. curbs. sidewalks to City standards within the development. d. The developer shall participate in the improvement of existing streets. curbs, and sidewalks to the extent of the development's impacts: e. Street improvements shall be made and street signs or signals shall be provided when the development is found to create or intensify a traffic hazard. IV. AGENCY COMMENTS HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Pace 7 -1. The City of Tigard Engineering Department has reviewed the proposal and has provided comments which are summarized in the analysis of Section 18.164 below. 2. The Tigard Water Department states that all portions of the building must be within 250 feet of a fire hydrant. It should be required that a fire hydrant be installed at the northwest corner of the property that is accessible to fire fighting equipment. Coordination of placement shall be made with the Tualatin Valley Fire and Rescue and Tigard Water Department. 3. The Tualatin Valley Fire Distric requires that additional hydrants shall be added to comply with fire code requirements or sprinkler the entire structure. Access roadways shall be provided to comply with the Fire Code. No Parking signs shall be installed where driving surfaces will not accomodate 20 feet of unobstructed surface. Signs - shall state "No Parking - Fire Lane - Tow -away Zone - ORS 98.810- 812 ". Location of all signs shall be approved by the Fire Marshal's office. 4. The City of Tigard Maintenance Services states: drainage swale should be private; need for installation of manhole or junction box where 10" storm "T's" into public system. 5. The City of Tigard Building Department, Tigard Police Department, Tigard Water District, Tualatin Valley Fire and Rescue, Portland General Electric have reviewed the proposal and have offered no comments or objections. V. EVALUATION OF REQUEST Compliance with Community Development Code. Section 18.130.040: The construction of a church in an R -3.5 zone requires a Conditional Use approval. This proposal is consistent with the applicable approval standards. The site will provide adequate area for the proposed sanctuary. Site characteristics are suitable for the expansion. Adequate public facilities are present and currently serve the site or shall be provided by conditions of approval. Compliance with the applicable zoning district requirements. Conditional Use review and Comprehensive Plan Policies can be satisfied by this proposal as demonstrated by the analysis presented within this report and review process. Section 18.130.150(C)(10). is satisfied. The subject site is approximately 3.5 acres. well in excess of the minimum 20.000 square foot lot area. As indicated on the site HEARINGS OFFICER - CUP 94-0004 CALVIN PRESBYTERIAN CHURCH Page 8 plan, the sanctuary setbacks are in compliance with these standards. The site plan indicates a new covered walkway connecting to the sidewalk. Section 18.26.030 defines a structure in part as any piece of work artificially built up or composed of parts joined together in some definite manner. As such, the setback standards apply to the proposed covered walkway. Therefore, the applicant shall revise the proposed site plan to show that the covered walkway is in compliance with the 20 foot setback standard. Section 18.48. The applicant is proposing to expand an existing church facility. A church is classified in code section 18.42 (Use Classifications) as Religious Assembly. Code Section 18.48.040 allows Religious Assembly as a Conditional use. As indicated on the site plan, all setbacks are satisfied. The minimum landscape requirement is satisfied as the applicant is proposing to devote approximately 57,500 square feet - (37 %) for landscaping. Existing structures are in compliance with height limitations. While the R -3.5 zone ordinarily limits building heights to 30 feet, the provisions of section 18.98 apply to this proposal. The portion of the building over 30 feet in height is not intended for human occupancy and is designed as a spire. The conditional. use criteria for a church also requires increased setbacks for buildings over 45 feet in height. This criteria is not applicable as the building is not greater than 45 feet in height. Section 18.100.015. This requirement has been satisfied as the applicant has submitted a plan indicating the type and location of trees and shrubs, and as addressed in the applicable sections below. Section 18.100.030. A staff site visit found existing street trees along both the SW 103rd Avenue and SW Canterburry Lane frontages, thereby satisfying this criteria. Section 18.100.110(A). The preliminary plan indicates the provision of 169 parking spaces. Based on the ratio of one tree per seven spaces, the applicant is required to provide approximately 24 parking lot trees. The site plan shows 26 parking lot trees, located within the new parking lot area. In an effort to provide the required canopy effect. the site plan shall be revised to provide an additional 3 parking lot trees. The west parking area shall have three trees. one in the vicinity of the removed choir annex and two along the 12 spaces to the west. The site plan shall also indicate the type and form of landscaping which screens the parking lot from view. HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 9 ha . Section 18.100.130. As indicated on the site plan this requirement is satisfied as the applicant has provided .a 20 foot buffer along the north property line, adjacent to the proposed new parking lot area. Section 18.102.020. The site plan does not indicate landscaping. A revised site plan shall be submitted which provides landscaping in accordance with the requirements of this chapter. Section 18.106.030(B)(8). The 9,700 square foot sanctuary requires the provision of 97 parking spaces. The site plan shows the provision of 169 parking spaces. The applicants narrative states that 173 parking spaces are provided. The provision of either will exceed the requirements of this section. The site plan also indicates the provision of 3 handicapped accessable parking spaces, whereas 6 spaces are required. - A revised site plan shall be submitted which indicates the provision of 6 handicapped accessible parking spaces. Section 18.106.050(M). The preliminary site plan shows the location of lighting fixtures, satisfying this requirement. Section 18.106.020(P) Based on the ratio of 1 bicycle rack per 15 vehicular spaces this site requires 18 bicylce parking spaces. The site plan does not show any bike racks. A revised site plan shall be submitted which shows the provision of 18 bicycle . parking spaces, thereby satisfying this criteria. Section 18.108.080. The applicant is proposing to modify the driveway layout along SW Canterbury Lane. The proposed site plan shows the closing of the two western - most driveways. These closings will be replaced with a new driveway along SW Canterbury Lane. The applicant is also proposing a new, third driveway onto SW 103rd Avenue. The SW Canterbury Lane entrance is shown with an access width of 30 feet and the SW 103rd Avenue drive with a width of 26 feet. Both of these proposed driveways meet the requirements of this section. Section 18.108.050(A). The preliminary site plan shows the provision of a walkway connecting the front entrance of the building with the sidewalk along SW Canterbury Lane, thereby satisfying this requirement. Section 18.114.130(A). All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division. HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 10 Section 18.150. This requirement will be satisfied as a- tree removal permit will be required for the removal of trees with trunk diameters of six inches or more in diameter. The applicant is proposing to remove a diseased . and broken 48" fir tree located along SW 103rd Avenue. The applicant shall submitt an arborist report which addresses the health of this tree, and whether it should be removed or a protection and maintenance program could be implemented to retain this tree and incorporate into the site plan. PUBLIC FACILITY CONCERNS: Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. TRAFFIC IMPACTS: The revisions to the parking lot include two new driveways; one onto SW 103rd Avenue and one onto SW Canterbury Lane. with the closure to the two existing driveways on SW Canterbury Lane. The existing. driveway adjacent to the westerly boundary of the site will remain. The driveways as proposed are located to provide good visibility, access to the site and on -site circulation. 2. STREETS:. As noted in the applicant's narrative. the site received a conditional use permit in 1992 for the previous building improvements. In compliance with that permit, right -of -way was dedicated along SW Canterbury Lane to provide 30 feet from centerline, in conformance with the Major Collector standards. In addition, SW 103rd Avenue was widened to local street standards and the sidewalk was constructed along that street frontage. The new site plan shows widening of the pavement in SW Canterbury Lane to install a "passenger loading area ". In order to be enforced as a "passenger loading" zone, this will require the approval of the City Council. in the form of a change to the existing ordinances, as prescribed in Section 10.28.136 of the Municipal Code. If the applicant desires a special parking area, a separate application is required in addition to the conditional use permit. The request for any parking restriction should be addressed to the City Engineer. HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 11 In addition, the new site plan shows placement of the sidewalk along the SW Canterbury Lane frontage on private property, adjacent to the new parking lot improvements. The applicant shall dedicate a public sidewalk easement for the sidewalk construction outside the public road right -of -way. Currently, there is sub - standard street lighting along SW Canterbury Lane. The applicant should install new street lighting along the SW Canterbury Lane frontage in accordance with City standards, and complete the street lighting required under the previous application, CUP 92 -0001. Also, the overhead electrical facilities along SW 103rd. Avenue were required to be placed underground or the payment of the fee in lieu of undergrounding, as part of CUP 92 -0001. 3. SANITARY SEWER: - The site is currently connected to the 8 inch public sanitary sewer lines located in SW Canterbury Lane. The main line has sufficient capacity for the proposed addition to the development. 4. STORM SEWER: The site currently drains to an underground pipe connecting. to the new storm drain constructed in SW 103rd Avenue in 1993. The existing. underground storm sewer system has sufficient capacity for the site. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction. The site plan shows the proposed installation of a water quality facility consisting of a graded, grassy swale, that will treat the storm water run -off from the proposed addition to the impervious areas. If the proposed facility provides treatment for only a portion of the area, the applicant should pay the fee in -lieu for the un- treated impervious construction area. 2. Compliance with Comprehensive Plan Policies: This proposed Conditional Use complies with all applicable Comprehensive Plan Policies as follows: HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 12 1. Citizen Involvement. Policy 2.1.1 is satisfied as the applicant was required to hold a neighborhood meeting with nearby property owners, notice of the application and public hearing on this item was provided to the Citizen Involvement Team East Representative, to owners of property in the vicinity of the site and in a newspaper of general circulation. The site has also been posted with a sign which states that a land use development application is pending for this property. 2. Water Quality. Policy 4.2.1 is satisfied as the applicant is providing on -site water quality treatment as required by Unified Sewerage Agency Resolution and Order No. 91 -47. 3. Public Facilities and Services. The conditional use complies with Policies - 7.1.2, 7.3.1, and 7.4.4 because the serving Private Utility Companies and Public Agencies have been provided with copies of the proposed development application. Public facility services were provided in conjuction with the construction of the existing facility and are adequate to serve this proposal. 4. Transportation. This application complies with Policies 8.1.1 and 8.1.3 because the public improvements to the public streets adjoining this site will be required to be consistent with the City of Tigard road improvement standards. The street and access plans do not appear to raise any significant safety or capacity concerns. VI. CONCLUSION AND RECOMMENDATION The Planning Division concludes that the Conditional Use request will promote the general welfare of the City and will not be significantly detrimental nor injurious to surrounding properties provided that development which occurs after this decision complies with applicable local state and federal laws. In recognition of the findings, staff recommends APPROVAL of Conditional- Use Permit CUP 94 -0004 subject to the following conditions: ALL CONDITIONS SHALL BE SATISFIED OR COMPLETION SHALL BE FINANCIALLY ASSURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS SHALL BE MICHAEL ANDERSON IN THE ENGINEERING DEPARTMENT, 639 -4171. A clear vision area shall contain no vehicle, hedge, platting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed), A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right -of -way and the driveway and then connecting these two 30 foot distance points with a straight line. 8. Section 18:114 130 Al (Signs) lists the type of allowable signs and sign area permitted in the R -3.5 zone. 12. Chapter 18.150 requires a permit and contains standards for removal of trees having a trunk 6 inches or more in diameter measured four feet above the ground on undeveloped residential land. A permit for tree removal must present rationale which complies with specified criteria in order to obtain approval. 11 Chapter 18,164 contains standards for streets and utilities, a. Section 18.164130(A) requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section 18.164,030(n requires Minor Collector streets to have a minimum 60 foot right -of -way and a 40 foot minimum roadway width, and 2-3 movi 2. Policy 4.2.1 provides that all development within the Tigard urban planning area shall comply with applicable federal, state and regional water quality standards. 3. Policy 7.1.2 provides the City will require, as a condition of development approval, that public wa1 r, sewer, and storm drainage will be provided and designed to City standards and utilities placed underground. 4. Policy 7.3.1 provides the City will coordinate water services with water districts, 5, Policy 7.4.4 requires all new development to be connected to an approved sanitary sewer system. 6, Policy 8.1.1 provides the City will plan for a safe and efficient street and roadway system that meets current needs and anticipated fixture growth and development, 7. Policy 8.1.3 provides the City will require as a precondition of approval that: Development abut a dedicated street or have other adequate access; Street right -of-way shall be dedicated where the street is substandard in width; c, The developer shall commit to construction of the streets, curbs, sidewalks to City standards within the development. d. The developer shall participate in the improvement of existing streets, curbs, and sidewalks to the extent of the development's impacts; Street improvements shall be made ade and street signs or signals shall be provided when the development is found to create or intensify a traffic hazard. IV, AGENCY COMMENTS HEARINGS OFFICER = CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 7 • 1, The City of Tigard Engineering Department has reviewed the proposal and has provided comments which are summarized in the analysis of Section 18.164 below. 2. The Tigard Water Department states that all portions of the building must be within 250 feet of a fire hydrant. It should be required that a fire hydrant be installed at the northwest corner of the property that is accessible to fire fighting equipment. Coordination of placement shall be made with the Tualatin Valley Fire and Rescue and Tigard Water Department. 3; The Tualatin Valley Fire Distric requires that additional hydrants shall be added to comply with fire code requirements or sprinkler the entire structure, Access roadways shall be provided to comply with the Fire Code. No Parking signs shall be installed where driving surfaces will riot accomodate 20 feet of unobstructed surface. Signs shall state "No Parking - Fire Lane - Tow -away Zone » ORS 98.810- 812 ". Location of all signs shall be approved by the Fire Marshal's office. 4, The City efTigard Maintenance Services states: drainage swale should be private; need for installation of manhole or junction box where 10" storm "T's" into public system= 5. The City of Tigard Building Department, Tigard Police Department, Tigard Water District, Tualatin Valley Fire and Rescue, Portland General Electric have reviewed the proposal and have offered no comments or objections, V. EVALUATION OF REQUEST Compliance with Community Development Code, Section 18.130,040: The construction of a church in an R -3,5 one requires a Conditional Use approval, This proposal is consistent with the applicable approval standards. The site will provide adequate area for the proposed sanctuary. Site characteristics are suitable for the expansion. Adequate public facilities are present and currently serve the site or shall be provided by conditions of approval. Compliance with the applicable zoning district requirements Conditional Use review and Comprehensive Plan Policies can be satisfied by this proposal as demonstrated by the analysis presented within this report and review process. Section 18.130.150(C)(10). is satisfied. The subject site is approximately 3.5 acres, well in excess of the minimum 20,000 square foot lot area. As indicated on the site HEARINGS OFFICER - CUP 94 -0004 CALVIN PRESBYTERIAN CHURCH Page 8 plan, the sanctuary setbacks are in compliance with these standards. The site plan indicates a new covered walkway connecting to the sidewalk. Section 18.26.030 defines a structure in part as any piece of work artificially built up or composed of parts joined together in some definite manner. As such, the setback standards apply to the proposed covered walkway. Therefore, the applicant shall revise the proposed site plan to show that the covered walkway is in compliance with the 20 foot setback standard. Section 18.48. The applicant is proposing to expand an existing church facility. A church is classified in code section 18.42 (Use Classifications) as Religious Assembly. Code Section 18.48.040 allows Religious Assembly as a Conditional use, As indicated on the site plan, all setbacks are satisfied. The minimum landscape requirement is satisfied as the applicant is proposing to devote approximately 57,500 square feet (37 %) for lanciscaping, Existing structures are in compliance with height limitations. While the R -3.5 zone ordinarily limits building heights to 30 feet, the provisions of section 18.98 apply to this proposal, The portion of the building over 30 feet in height is not intended for human occupancy and is designed as a spire, The conditional use criteria for a church also requires increased setbacks for buildings over 45 feet in height. This criteria is not applicable as the building is not greater than 45 feet in height, Section ,18,100,015. This requirement has been satisfied as the applicant has submitted a plan indicating the type and location of trees and shrubs, and as addressed in the applicable sections below. Section _18,100,030. A staff site visit found existing street trees along both the SW 103rd Avenue and SW Canterburry Lane frontages, thereby satisfying this criteria, Section 18,1.00.110 A . The preliminary plan indicates the provision of 169 parking spaces, Based on the ratio of one tree per seven spaces, the applicant is required to provide approximately 24 parking lot trees, The site plan shows 26 parking lot trees, located within the new parking lot area, In an effort to provide the required canopy effect. the site plan shall be revised to provide an additional 3 parking lot trees. The west parking area shall have three trees. one in the vicinity of the removed choir annex and two along tic 12 spaces to the west. The applicant shall submitt an arborist report which addresses the health of this tree, and whether it should be removed or a protectit.n and maintenance program could be implemented to retain this tree and incorporate into the site plan. PUBLIC FACILITY CONCERNS: Sections 18.164.0M (Streets), 18 .11 64.090 (Sanitary Sewer), and 18.1 f 4.100 (Storm Drains) shall be satisfied as specified below: 1. TRAFFIC IMPACTS: The revisions to the parking lot include two new driveways; one onto SW 103rd Avenue and one onto SW Canterbury Lane, with the closure to the two existing driveways on SW Canterbury Lane. The existing driveway adjacent to the westerly boundary of the site will remain. The driveways as proposed are located to provide good visibility, access to the site and on -site circulation. 2. STREETS: As noted in the applicant's narrative: the site received a conditional use permit in 1992 for the previous building improvements. In compliance with that permit, right -of -way was dedicated along SW Canterbury Lane to provide 30 feet from centerline, in conformance with the Major Colle.to° standards. In addition, SW 103rd Avenue was widened to local street standards and the sidewalk was constructed along that street frontage, The new site plan shows widening of the pavement in SW Canterbury Lane to install a "passenger loading area". In order to be enforced as a "passenger loading" zone. this will require the approval of the City Council, in the form of a change to the 'existing ordinances, as prescribed in Section 10.28.136 of the Municipal Code. If the applicant desires a special parking area, a separate application is required in addition to the conditional use permit. The request for any parking restriction should be addressed to the City Engineer. HEARINGS OFFICER - CUP 94-0004 CALVIN PRESBYTERIAN CHURCH Page 11 In addition, the new site plan shows placement of the sidewalk along the SW Canterbury Lane frontage on private property, adjacent to the new parking lot improvements. The applicant shall dedicate a public sidewalk easement for the si ' ,talk construction outside the public road right -of -way. Currently, there is sub - standard street lighting along SW Canterbury Lane. The applicant should install new street lighting along the SW Canterbury Lane frontage in accordance with City standards, and complete the street lighting required under the previous application, CUP 92 -0001. Also, the overhead electrical facilities along SW 103rd. Avenue were required to be placed underground or the payment of the fee *n- lieu of undergrounding, as part of CUP 92 -0001, 3, SANITARY SEWER: The site is currently connected to the 8 inch public sanitary sewer lines located in SW Canterbury Lane. The main line has sufficient capacity for the proposed addition to the developm'ntr 4. STORM SEWER: The site currently drains to an underground pipe connecting to the new storm drain constructed in SW 103rd Avenue in 1993, The existing underground storm sewer system has sufficient capacity for the site. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of ore -site water quality facilities or fees in -lieu of their construction. The site plan shows the proposed installation of a water quality facility consisting g of a graded, grassy swale, that will treat the storm water run -off from the proposed addition to the impervious areas. Policy 2.1.1 is satisfied as the applicant was required to hold a neighborhood meeting with nearby property owners, notice of the application and public hearing on this item was provided to the Citizen Involvement Team East Representative, to owners of property in the vicinity of the site and in a newspaper of general circulation. The site has also been posted with a sign which states that a land use development application is pending for this property. 2, Water Quality. Policy 42.1 is satisfied as the applicant is providing on -site water quality treatment as required by Unified Sewerage Agency Resolution and Order No, 91 -47. 3. Public Facilities and Services. The conditional use complies with Policies 7.1.2, 7.3.1, and 7.4.4 because the serving Private Utility Companies and Public Agencies have been provided with copies of the proposed development application. Public facility services were provided in conjuction with the construction of the existing facility and are adequate to serve this proposal. 4. Transportation. This application complies with Policies 8.1.1 and 8.1.3 because the public improvements to the public streets adjoining this site will be required to be consistent with the City of Tigard road improvement standards. The street and access plans do not appear to raise any significant safety or capacity concerns, VI. TRAFFIC IMPACTS: The revisions to the parking lot include two new driveways; one onto SW 103rd Avenue and one onto SW Canterbury Lane, with the closure to the two existing driveways on SW Canterbury Lane. The existing driveway adjacent to the westerly boundary of the site will remain. The driveways as proposed are located to provide good visibility, access to the site and on-site circulation. 2. STREETS: As noted in the applicant's narrative, the site received a conditional use permit in 1992 for the previous building improvements. In compliance with that permit, right-of-way was dedicated along SW Canterbury Lane to provide 30 feet from centerline, in conformance with the Major Collector standards. In addition, SW 103rd Avenue was widened to local street standards and the sidewalk was constructed along that street frontage. The new site plan shows widening of the pavement in SW Canterbury Lane to install a "passenger loading area", In order to be enforced as a °passenger loading' zone, this will require the approval of the City Council, in the for of a change to the existing ordinances, as prescribed in Section 10,28,136 of the Municipal Code. If the applicant desires a special parking area, a separate application is required in addition to the conditional use permit. Existing uses and structures : The site is developed with a one -story sanctuary that was huilt in 1965 and was remodeled in 1972 and 1982. It contains about 5015 square feet and has a seating capacity of 200 people. There is an 8 -foot overhang that serves as an exterior corridor. The sanctuary roof includes a tall monumental cross. A two -story classroom and multi- purpose building known as Cayton Hall was built in 1974. It contains about 7656 square feet. There is an 896- square foot annex west of the sanctuary and Cayton Hall. There is a 24 -space parking lot west of the buildings on the site and a 76 -space parking lot east of the sanctuary. D. Proposed use and structures : The applicant proposes to build a new narthex, fellowship hail, and classroom addition containing about 5115 square feet about 15 feet east of Cayton Hall; to enclose about 1145 square feet of corridor between the new building and Cayton Hall; and to enclose .about 1260 square feet of corridor adjoining and between the sanctuary and Cayton Hall. The proposed structures will not exceed a height of 30 feet above grade. The applicant also will rebuild the sanctuary roof to remove the monument cross. E. Existing and proposed vegetation : The area around the church buildings is landscaped with trees, shrubs and grass. Most of the undeveloped area of the site is covered in grass, however, there is one mature fir tree near the east edge of the site. The applicant proposes to landscaPe the area around the proposed structures, principally with grass and shrubs. Topography and drainage : The site is relatively level. sloping from a high point of about 92 feet above mean sea level at the southwest corner of the site to about 80 feet at the northeast corner. The applicant does not propose to improve this street, and City staff do not recommend the applicant be required to do so. 2. The east edge of the site adjoins SW 103rd Avenue, a local street with L. 14-foot half-width paved section in a 20-foot half-width right of way without curb or sidewalk adjoining the site There also is substandard half-width pavement and no curb sidewalk on the east side of the street Immediately north and south of the site, the west half- width of the street is improved to City standard, including curb and sidewalk. The site does not have direct vehicular access to this street, and none is planned at this time A future deve'oprnent plan provides for direct vehicular access to this street. APPLICABLE APPROVAL STANDARDS A. Tigard City Code Title 18 (Community Development Code). 1. Section 18.48.040 lists Religious Assembly as a conditional use in the R-3.5 zoning district. 2. Section 18.100 require' s landscapm* g and screening of certain' development, and issuance of a tree removal per it before significant trees are removed« 3. Section 18.106 requires one parking space to be provided for every six fixed seats, for every 12 feet of bench length in an assembly area, and for i every 100 square feet of gross floor area in an assembly area where there are not fixed seats n a Religious Assembly building and one bicycle parking space for every 15 parking spaces. 4. Chapter 18.120 requires a conditional use to comply with site development review requirements. 5. The proposed expansion is considered a major amendment to a conditional use, based on Section 18.130.050(B)(6). Section 18.130.140 contains the following additional standards for a conditional use: a. The supplementary standards set forth in Chapter 18.114 (Signs) and Section 18.120180 (Site Development Review), if applicable, are met. f. The use will comply with the applicable policies of the Comprehensive Plan. 6. That policy allows an applicant to pay a fee in lieu of undergrounding utilities under certain circumstances. B. Applicable Comprehensive Plan Policies. Policy 2.1.1 requires that adjoining property owners, the local NPO and the general public be notified of and provided an opportunity to comment on the proposed change in use. C. Resolution and Order 91-47. Washington County Resolution and Order 91-47 requires all new developments that add additional impervious surface to include a water quality treatment facility. TV. HEARING AND TESTIMONY A. Hearing. The Hearings Officer received testimony at the public hearing about this application on April These 13,1992. A record of that testimony is included herein as Exhibit A (P ee of Record), Exhibit B ('raped Proceedings), and Exhibit C (written Testimony). exhibits are filed at the Tigard City Hall. B. Testimony. 1. Ron Pomeroy testified for the County and summarized the staff report. 2, Russell Leach, Stephen McShane and John Merrifield testified for the applicant. Mr. Leach summarized proposed plans and requested that improvement of 103rd Avenue be deferred. He argued it is untimely to improve 103rd Avenue, because the proposed development does not add significant traffic to that street, the site does not have direct access to that street, and additional planning work is needed to determine how the street improvements should interface with a driveway from the site to the street in a future development project. He argued the grade change between the street and the o site makes such additional planning work necessary. He testified that the neighborhood association supported the request to defer improvements, but did not offer substantial evidence to support that statement. Assistant Pastor McShane testified about the commitment of the congregation to undertake the proposed and future improvements on the site. Mr. Merrifield argued that it is inappropriate to require the church to install underground utilities, because other properties in the vicinity have above- ground utilities. 3. 'The hearings officer held open the record to receive additional information from the City regarding the underground utilities poky and to undertake a site inspection. C. Agency and IVO Comments. 'The hearings officer incorporates by reference the agency and NPO continents in section II of the City Staff Report dated April 13, 1992. The proposed use complies with Chapter 18.48, because the proposed use is listed as a conditional use in the R-3.5 zone. 2. The proposed use can comply with Chapter 18.100, because the existing and proposed landscaping will provide adequate screening of the parking and loading areas, development areas will be landscaped, a tree removal permit can be obtained, and replacement trees can be planted. A condition is warranted requiring submission and approval of a landscape plan and tree removal permit to ensure compliance with this chapter. 2. The proposed use complies with Chapter 18.102, because a new intersection requiring visual clearance will not N.: created by the proposal conditional use. The proposed use complies with Chapter 18.106, because the existing and proposed uses on the site require a total of 77 parking spaces, and the site already provides about 100 spaces including two handicapped spaces. The sanctuary requires 34 parking spaces, Cayton Hall requires 15 spaces, and the new fellowship hall requires 28 spaces. However, bicycle spaces are not identified on the site plan. A condition of approval is warranted requiring a minimum of three handicapped parking spaces and seven bicycle parldng spaces to comply with this chapter. 4. The proposed use complies with Chapter 18.120 because the applicant has ,, • submitted all of the document and plans required by the Code or will submit them as a condition of approval. 5. The proposed use complies with Chapter 18,130, because: a. The site size and dimensions accommodate the proposed development while preserving existing mature vegetation and providing new vegetation needed to buffer the use and make it aesthetically compatible with adjoining residential uses, b. The characteristics of the site are suitable for the pmposed use, because it is large enough to accommodate development and landscaped buffers, and it does not contains significant physical hazards or natural features that would be adversely affected by development c, Public sewer and water are available to the site and have capacity to serve the Site d. The applicable provisions of the R-3,5 one are fulfilled as noted above. e. The development will be subject to Code provisions regarding signage and she development review, f. A condition warranted requiring approval of drainage and utility connection plans or permits to comply with this chapter. b. The applicant is required to improve the frontage of SW 103rd Avenue to comply with City standards. A condition to that effect is warranted. The hearings of c r finds that t the applicant lieu not comply with any of the criteria for allowing an `pro guarantee improvements, because: (1) The site complies with property design standards in Section 18.164.060. (2) A partial improvement would not create potential safety hazards to motorists or pedestrians. On the contrary, failure to make the improvement now allows existing hazardous conditions to remain uncorrected. Southbound vehicular traffic on 103rd Avenue now must meander from a fully improved street section north of the site to a narrower, substandard width section adjoining the site, creating a potentially hazardous condition. Southbound pedestrian traffic must adjoining the site to traverse the site frontage. Lastly, section step off the sidewalk north of the site and walk on site the narrow street se j i ` g g y, the open drainage ditch along the site frontage could be a hazard to unwary vehicles and pedestrians. Therefore, the improvement is needed to eliminate existing potentially hazardous conditions. (3) Street improvements have been made north and south of the site. (4) Additional planning work is not required to define the appropriate design standard for the street. The street is classified as a local street. The City Code contains a design standard for such a strreet. The grade change along the site frontage earth retention nn f creatures.
