This property is zoned Medium Density Residential, 12 units pr, acre (R-12). The present use of the site is listed as a Conditional Use in this zoning distr!. The site received original Site Development Review approval in 1981 (SDR 26-81) and Cr.(' :Mona! Use approval in 1982 (CUP 20-82) an additional CUP (92-0005) was approved in *W92 for the construction of three (3) classrooms and a library. The Tigard Community Develooment Code, Conditional Use Section, states: "if the requested modification meets any of the major modification criteria, the request shall be reviewed as a new Conditional Use application." Section 18.130.050(B) states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: 1. A change in land use. The use is currently for a church, community center and private school. That use will not change as a result of the proposed modification. 2. An increase in dwelling unit density. The proposal is to add a modular classroom, therefore, this standard does not apply. 3. A ten percent change in the ratio of the different types of dwelling units to the number of units. The proposal does not involve dwelling units, therefore, this standard does not apply. 4. A change in the type of commercial or industrial structures. This proposal does not involve a change in the structural occupancy type, therefore, this standard has been satisfied. 5. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not require a change in accessways or parking areas where off-site traffic would be affected. 6. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. A reduction of more than ten percent of the area reserved for common open space and/or usable open space. The proposal will reduce the open space slightly, however, due to the extensive amount of outdoor open area provided for the .school facility, the open space will not be reduced by more than 10%. 8. A reduction of specified setback requirements by more than 20 percent. The proposed modular location is in the center of the site, thus not affecting required setbacks. The applicant should verify with the Building Division that the building meets fire code requirements for setbacks between buildings. 9. An elimination of project amenities by more than ten percent where previously specified such as: Recreational facilities, Screening; and/or, Landscaping provisions. The proposed addition will result in the removal of some grar,s, however, new landscaping will be added around the proposed building. The proposal will not reduce existing playground or recreational facilities and the overall landscaping will exceed the required 15% landscaping. Therafore, this standard has been met. 10. A ten percent Increase in the approved density. This does not involve a residential development, therefore, this standard does not apply. This request is determined to be a minor modification to an existing Conditional Use. The Director's designee has determined that the proposed minor mmaication of this existing sits will promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties, provided that development which occurs after this decision complies with all applicable local, state and federal laws. The site is close to utilities, and will only result in a loss of grass. New landscaping will be put in around the modular once it is in place. Adequate area for aesthetic design treatment to Mitigate possible adverse effects from the use on surrounding properties and uses. Lot Size: i, There shall be no minimum lot size requirements for scholia other than what is required for the applicable zoning district; b. Setbacks: i. The front yard setback shall be a minimum of 30 feet. On corner lots and through lots, the setback shall be a minimum of 20 feet on any side facing a street, plus meet visual clearance areas (Chapter 18.102); iii. The side yard setback shall be a minimum of 20 feat; and . The rear yard setback shall be a minimum of 30 feet. 4. Section 18.54.050(A)(6e specifies that the minimum landscaping requirement shall be 20 percent. S. Bicycle parking requirements (Section 18.106.0200,) states that one bicycle parking space is required for each 15 automobile parking spaces. 8. Section 18.108.050 requires that a pedestrian walkway extend from the ground floor entrances to the streets which provide the required access and egress. 9. Chapter 18.164 contains standards for streets and utilities. a. Section 18.164.030CA1..requires streets within and adjoining a development to be dedicated and improved based on the classification of the street. b. Section 18.164.030(E1 requires a minor collector to have a minimum 60 foot right-of-way, 40 foot minimum roadway width, and 2 -3 moving lanes. c. Section 18.164.070(A)fi)tb) requires sidewalks adjoining Y,)oth aided of the public right -of -way. d. Section 18.164.090 requires sanitary sewer service. e. Section 18.164.100 requires adequate provisions for storm water runoff and dedication of easements for storm drainage facilities. . 8. Applicable Comprehensive Plan Policies. 1. Policy 2.1.1 provides the City will assure that citizens will be provided an opportunity to participate in all phases of the planning and development review proceed. 2. Policy 4.2.1 provides that all development within the Tigard urban planning area shall comply with applicable federal, rotate and regional :later quality etandarda. 3. Policy 7.1.2 provides the City will require, as a condition of develClpotent approval, that public water, sewer, and storm drainage will be provided and designed to City standards and utilities placed underground. 4. Policy 743:11 provides the City will coordinate water servicest with water districts. 5. Policy 7.4.4 requires all new development to be connected to an approve( sanitary Sewer system. 6. Policy 8.1.1 provides the City will plan for a safe and efficient street and roadway system that meets current needL and anticipated future growth and development. 7. Development abut a dedicated street or have other adequate access; b. Street right-of-way shall be dedicated where the street is substandard in width; c. The developer shall commit to construction of the streets, curbs, sidewalks to City standards within the development. d. The developer shall participate in the improvement of existing streets, curbs, and sidewalks to the extent of the development's impacts; e. Street improvements shall be made and street signs or signals shall be provided when the development is found to create or intensify a traffic hazard. IV. NPO & AGENCY COMMENTS 1. Tigard Water District has no objections to this proposal. However, the Water District notes that all portions of the new addition must be within 250 feet of a fire hydrant. 2. The City of Tigard Building Division and Operations Department, City of Tigard Polic9 Department, the State Highway Division, Portland General Electric, and General Telephone have reviewed this proposal and have offered no comments or objections. V. EVALUATION OF REQUEST A. ornijancconY_____MununitDevelomitS1Dde. Section 18.130.040: The construction of school facilities in an R-12 zone requires a conditional Use approval. This proposal is consistent with the applicable criteria. The site provides adequate area for the construction of the proposed classrooms and library. There are no apparent physical obstaclea to thie use on the site. Adequate public utilities are available to serve this use as addressed further in this report. Setbacks, lot coverage, and building height requirements of the R-12 zone, and the applicable Comprehensive Plan Policies can be satisfied by this propoSal. Section 18.130.150(C1(9$: The construction of the proposed classrooms and library either meet or exceed all lot area and setback requirements of this code section. Thid site is approximately 0.96 acres in area. The front yard setback of the existing Kelly Center is approximately 30 feet. The rear yard is approximately 50 feet. The north and south side yard setbacks of the expansion will be approximately 55 and 20 feet respectively. Section 18.106.0300.= (Parking) can be satisfied by the three existing off-Site parking lots Which cdttently Serve the Kelly Center, Saint Anthuny'S Church, and Saint Anthony 's SchoOl. The two proposed classrooms will provide a total of new 70 seats. The library and science room are not full time classrooms but will be used by classes on an intermittent basis. Therefore, based on the ratio of one space for every eight seats, the proposed use requires the provision of a total of 9 additional parking spaces. The applicant's narrative states that 90 parking epaces are provided by the adjacent parking lots. The oubject site currently provides no parking spaces of its' own and none are proposed in conjunction with this application. Even though the adjacent parcels are under different ownerships, the uses are directly connected. Since the hours of operation of some of the uses on these adjacent parcels differs from that of the Kelly Center, the parking for the Kelly Center has historically been provided by these adjacent parcels. Adequate bicycle parking is provided by the adjacent schobl. Though this parking arrangement has been used for a number of years, the City has no evidence of a parking agreement to guarantee this arrangement. Therefore, while no parking spaces are provided on the subject site, the parking requirements shall be met upon the provision of a reciprocal use agreement between the site and those parcels which currently provide the required parking. Section is.s4,g91mi6i. requires that at least 20 percent of the site be landscaped. The applicant etatee that the landecaping will form a transition leading from the baseball field and playground to the proposed expansion. GraBe will be replanted in areas disturbed by construction in addition to providing arborvitae in planters which are located to the east of the proposed addition. The applicant also states that the areas immediately to the north and south of the addition will be planted with rhododendrons under the eaves of the building to match the planting scheme of the existing building. More than 20 percent of the oite will be landscaped upon completion of this expansion. In addition, a large portion of the surrounding tax lots are presently landscaped or being used ao playground and recreation areas. Therefore, this code section is satiefied. Seetion 18.108.050 requiree that a pedestrian walkWay extend from the ground floor entranCes to the street Which provides the required access and egress. since this parcel Le in the Center of the block, it is not pradtical to construct a dedicated pedestrian walkway leading to SW McKenzie Street. Rather, the site plan shown three existing WalkWaysi that lead to the parking areas which serve this bite. Staff contends that by demonstrating that the use of this site is connected to the parking area° which serve the site by these existing walkways, the intent of this cede section has been Met. Therefore, this code requirement has been satisfied. The reciprocal parking agreement would confirm this Site may also use other existing walkway extensions. Section AgAgl (Trees) The applicant's narrative States that all existing majOr fir trade will be retained. The preliminary site plan and subsequent Site visit do not indicate the need td remove any trees over six inches in diameter as a result of this expansion. Therefdre, HEARINGS OFFICER P. CUP 92-0006 ST. ANTHONYWPAULSEN PAGE 6 • a tree removal permit will not be required unless it is shown that such trees will need to be removed. Section 18.164.030(E) (Minimum Rights -of -way and Street Widths) contains the regulations pertaining to street standards. In discussions with the applicant during the pre - application conference, it was determined the majority of the traffic would be utilizing the parking area adjacent to the south side of the school (along Pacific Highway). Access to this parking area is from SW Johnson Street. Southwest Johnson Street is classified as a minor collector, and therefore is required to meet the following minimum standards (all distances are from centerline of right- of-way): 30 feet of right -of -way, 20 feet of pavement, curb and sidewalk. There currently is 25 feet of right -of -way, approximately 15 feet of pavement and no curb or sidewalk. The i applicant should be � p required to provide half - ,street improvements from the intersection of SW Johnson Strnet and Pacific Highway to the west end of the second driveway on Johnson Street (west of the convent). Minor variations in both the sidewalk and right -of -way standards should be allowed, if necessary, to avoid conflicts with the existing building. Therefore, no conditions should be required concerning the public sanitary sewer line. Johnson St. St. Anthony's Church and associated buildings encompasses the entire block, except a small portion in the southeast corner, bounded by S.W. Johnson/Grant/McKenzie and Highway 99. In addition, the church property is under several tax lots. The construction site is located in the center of the block with legal access onto S.W. McKenzie, though actual access is from several different points. In discussions with the applicant during the pre-application process it was determined the majority of the traffic would be utilizing the parking area adjacent to the school. Access to the parking area is from S.W. Johnson St. S.W. Johnson St. is classified as a minor collector, and has the following minimum standards (all distances are from centerline of right-of-Way): 30 feet of right-of-way, 20 feet of pavement, curb and sidewalk. Currently there is 25 feet of right-of-way, approximately 15 feet of pavement and no curb or sidewalk. The applicant should be required to provide half-street improvements from the intersection of S.W. Johnson St. and Highway 99 to the west end of the second driveway located on Johnson St. The standard half-street improvements will place the sidewalk and right-of-way close to the existing school building.
