SLR2001-00006 SLR2001 00006 CITY OF TIGARD STREAMBED STABILIZATION August 27, 2001 CITY OF TIGARD City of Tigard OREGON Attn: Greg Berry 13125 SW Hall Blvd. Tigard, OR 97223 RE: Sensitive Lands Review for 2S13CD, Tax Lots 8600 and 7200 Dear Mr. Berry: This letter is in response to your request for a Type 1 Sensitive Lands Review approval to stabilize a streambed and adjacent slopes that are eroding. The work includes excavation of seventeen cubic yards of material, placing six log weirs within the streambed, and placing vegetated geogrids for slope stability on the banks. The property is located east of SW 118th Avenue, north of SW Gaarde Street, and is described as, WCTM 2S13CD, Tax Lots 8600 and 7200. The Tigard Community Development Code, Sensitive Lands Review Section, states that, "The Director shall review minimal ground disturbances or landform alterations involving 10-50 cubic yards of material, except in the floodway area by means of a Type 1 procedure, as governed by Section 18.390.030 subject to compliance with all of the standards in this chapter." Section 18.775.070(C)(D) outline the criteria that have been considered in review of this application, and are discussed below. Excessive Slopes 1. The extent and nature of the proposed land form alteration or development will not create site disturbances to an extent greater than that required for the use. The site is currently a drainage way and the proposed action is being performed to improve the streambed and maintain the integrity of the bank. No change of use is requested. 2. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The proposed land form alterations are intended to improve the stability of the slopes and decrease the potential of future erosion. The structures are appropriately sited and designed to ensure structural stability and proper drainage of foundation and crawl space areas for development with any of the following soil conditions: wet/high water table; high shrink-swell capability; compressible/organic; and shallow depth-to-bedrock. No structures are being proposed. This criterion has been satisfied. 4. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.745, Landscaping and Screening. The proposal does not call for removal of any vegetation. In fact, the proposal calls for vegetated geogrids to be placed on the bank for stability. This criterion has been satisfied. Drainageway 5. The extent and nature of the proposed land form alteration or development will not create site disturbances to the extent greater than that required for the use. The landform alterations will be limited to that required to install log weirs to control the grade of the creek and prevent erosion. 6. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The proposed log weirs are intended to stabilize the creek and prevent erosion. This criterion has been satisfied. 7. The water flow capacity of the drainageway is not decreased. The applicant contends that the flow characteristics including capacity of the drainageway will not be altered by this proposal. This criterion has been met. 8. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.745, Landscaping and Screening. There is no natural vegetation in the drainageway. Native vegetation is proposed for installation. This criterion has been satisfied. 9. The drainageway will be replaced by a public facility of adequate size to accommodate maximum flow in accordance with the adopted 1981 Master Drainage Plan. The proposal does not alter or warrant replacement of the existing drainageway. This criterion has been met. Page 2 of 3 10. The necessary U.S. Army Corps of Engineers and State of Oregon Land Board, Division of State Lands approvals shall be obtained. The applicant has attained preliminary approval from the U.S. Army Corps of Engineers and the Oregon Division of State Lands. The approvals are attached to this decision. 11. Where land form alterations and/or development are allowed within and adjacent to the 100-year floodplain, the City shall require the consideration of dedication of sufficient open land area within and adjacent to the floodplain in accordance with the Comprehensive Plan. The land form alteration is not adjacent to a 100-year flood plain. Water Resources Overlay According to the Tigard Development Code, projects such as stream and wetlands restoration and enhancement programs are exempt when, "performed under the direction of the City, and in compliance with the provisions of the City of Tigard Standards and Specifications for Riparian Area Management." This criterion has been satisfied. THIS REQUEST HAS BEEN APPROVED. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR PROPOSED MODIFICATIONS TO THE BUILDING DEPARTMENT. You are proposing to remove existing gabions and riprap, add vegetated geogrids and toe riprap(where needed), install log weirs to control tributary bed degradation, and plant native plants along the riparian zone. The enclosed maps and drawings in Enclosure 1 provide additional project details. The purpose of the project is to repair degraded tributary conditions with bioengineer-based techniques. This project is located in Section 3, Township 2 South, Range I West, Washington County, Oregon. This project has been reviewed for compliance with Section 404 of the Clean Water Act. Based on the information you provided,the Corps verifies that your project is authorized under the criteria of Nationwide Permit (NWP)No. 27. Your project must be conducted in accordance with the Regional Conditions in Enclosure 2 and the NWP General Conditions in Enclosure 3,and the following special conditions: 1. You must comply with the Reasonable and Prudent Measures for erosion control that are conditions to this permit and enclosed as Enclosure 4. 2. You must complete the monitoring report, Ehclosure 5,within 30 days of completing your project. 3. The elevation difference between upstream and downstream side of the log weir shall not exceed 6 inches (see sheet 7 of Enclosure 1). Failure to comply with any of the conditions or a change in project scope may render your authorization invalid and could result in the Corps initiating an enforcement action. Other permits such as one pursuant to Oregon's Removal-Fill Law and other appropriate local authorizations, may also need to be obtained. The Oregon Department of Environmental Quality has certified use of this NWP; it is provided as Enclosure 6. You are also required to comply with these conditions. -2- Please note that you must also complete, sign, and submit the enclosed "Compliance Certification" (Eticlosurc 7)for-the completed work (see General Condition 14 of Enclosure 3). If you sell the property where this authorized project is located, Regional Condition 5 of Enclosure 2 requires you to transfer the permit to the new owner. The"Notice Of Property Transfer" form is available upon request. After reviewing your proposal,the Corps has determined that the net impacts will not exceed the minimal impact guidance for this NWP. This letter of verification is valid until June 7, 2005, unless this nationwide permit expires, is modified,reissued,or revoked before that date. If you commence or are under contract to commence this activity before the date the nationwide permit expires, you will have 12 months from the expiration date to complete the activity under the present terms and conditions of the current nationwide permit. The Corps has used a programmatic procedure, developed with the National Marine Fisheries Service,to evaluate you proposal for compliance with the Endangered Species Act and the Magnuson-Stevens Act for essential fish habitat. Please note that there are certain requirements that you must comply with for this procedure to be used. You must submit, ; 30 days of project completion,a completed Enclosure 4. Part of this requirement includes taking pre-dredging and post-post pictures to be included in the report. Because your will likely be dredging more than once,you should make a copy of Enclosure 4 so you have a copy of this enclosure for subsequent monitoring reports. This programmatic procedure also requires that we provide the following declaration: NOTICE. If a dead, injured, or sick endangered or threatened species specimen is located, initial notification must be made to the National Marine Fishery Service Law Enforcement Office, located at Vancouver Field Office, 600 Maritime, Suite 130,Vancouver, Washington 98661; phone: 360-418-4246. Care should be taken in handling sick or injured specimens to ensure effective treatment and care or the handling of dead specimens to preserve biological material in the best possible state for later analysis of cause of death. In conjunction with the care of sick or injured endangered and threatened species or preservation of biological materials from a dead animal, the finder has the responsibility to carry out instructions provided by Law Enforcement to ensure that evidence intrinsic to the specimen is not unnecessarily disturbed. Fish Passage. Nationwide permit activity affecting"waters of the U.S." must not restrict the passage of aquatic life. Activities that require the placement of culverts,diversion structures, or changes to the channel morphology must be designed to be consistent with passage standards developed by Oregon Department of Fish and Wildlife (ODFW)and National Marine Fisheries Service (NMFS) entitled, ODFW Standards and Criteria for Stream Road Crossings. 2. Federal Threatened & Endangered Species. If at any time during the conduct of work authorized, the permittee becomes aware that a federally listed threatened or endangered species (as identified under the federal Endangered Species Act) or the habitat of such species may be affected, the permittee must notify the Corps. 3. Cultural Resources & Human Burials. If at any time during the conduct of work authorized, the permittee or agent(s)discovers that human burials,cultural resources, or historic properties (as identified by the federal Historic Preservation Act)may be affected, they must notify the Corps. 4. Inspection of Permit Area. To ensure that the nationwide permit terms and conditions are met, the permittee must allow representatives of the Corps to inspect the authorized activity. Personnel from DEQ are considered to be authorized"representatives" for Section 401 water quality inspections. A request for access to the site will normally be made sufficiently in advance to allow a property owner or representative to be on site with the agency representative making the inspection. 5. Sale of Property/Transfer of Permit. If you sell the property associated with this permit, you must transfer the permit to the new owner(s)and obtain their signature(s). A copy of this permit with new owner(s) signature shall be sent to this office to validate the transfer of this permit authorization. 6. In-Water Work Periods. All in-water work, including temporary fills or structures, shall occur between 1 July and 30 September. Exceptions to these recommended time periods require specific approval from the Corps. 7. Heavy Equipment. Heavy equipment shall not operate in the waters of a flowing stream to perform work authorized by this verification unless specifically authorized. 8. Fish Habitat and Passage. Fish habitat and passage shall be protected by ensuring that the final work does not create an impoundment to fish passage and that there are no changes in stream gradients. Encl 2 • Nationwide Permit General Conditions (From Federal Register, Vol 65,No. 47, 9 March 2000) The following general conditions must be followed in order for any authorization by an nationwide permit(NWP)to be valid: 1. Navigation.No activity may cause more than a minimal adverse effect on navigation. 2. Proper Maintenance.Any structure or fill authorized-shall be properly maintained,including maintenance to ensure public safety. 3.Soil Erosion and Sediment Controls.Appropriate soil erosion and sediment controls must be used and maintained in effective operating condition during construction,and all exposed soil and other fills,as well as any work below the ordinary high water mark or high tide line,must be permanently stabilized at the earliest practicable date. 4.Aquatic Life Movements.No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody,including those species which normally migrate through the area,unless the activity's primary purpose is to impound water.Culverts placed in streams must be installed to maintain low flow conditions. 5. Equipment.Heavy equipment working in wetlands must be placed on mats,or other measures must be taken to minimize soil disturbance. 6. Regional and Case-By-Case Conditions.The activity must comply with any regional conditions which may have been added by the division engineer(see 33 CFR 330.4(e))and with any case specific conditions added by the Corps or by the State or tribe in its Section 401 water quality certification and Coastal Zone Management Act consistency determination. 7.Wild and Scenic Rivers.No activity may occur in a component of the National Wild and Scenic River System;or in a river officially designated by Congress as a"study river"for possible inclusion in the system,while the river is in an official study status;unless the appropriate Federal agency,with direct management responsibility for such river,has determined in writing that the proposed activity will not adversely affect the Wild and Scenic River designation,or study status.Information on Wild and Scenic Rivers may be obtained from the appropriate Federal land management agency in the area e.g.,National Park Service, U.S. Forest Service,Bureau of Land Management, U.S. Fish and Wildlife Service. 8. Tribal Rights.No activity or its operation may impair reserved tribal rights,including,but not limited to,reserved water rights and treaty fishing and hunting rights. 9.Water Quality. (a)In certain States and tribal lands an individual 401 water quality certification must be obtained or waived(See 33 CFR 330.4(c)). (b)For NWPs 12, 14, 17, 18,32,39, 40, 42, 43, and 44,where the State or tribal 401 certification(either generically or individually)does not require or approve a water quality management plan,the permittee must include design criteria and techniques that will ensure that the authorized work does not result in more than minimal degradation of water quality.An important component of a water quality management plan includes stormwater management that minimizes degradation of the downstream aquatic system,including water quality.Refer to General Condition 21 for stormwater management requirements. Another important component of a water quality management plan is the establishment and maintenance of vegetated buffers next to open waters,including streams.Refer to General Condition 19 for vegetated buffer requirements for the NWPs. 10.Coastal Zone Management. In certain states,an individual state coastal zone management consistency concurrence must be obtained or waived(see Section 330.4(d)). I I. Endangered Species. (a)No activity is authorized under any NWP which is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation,as identified under the Federal Endangered Species Act,or which will destroy or adversely modify the critical habitat of such species.Non-federal permittees shall notify the District Engineer if any listed species or designated critical habitat might be affected or is in the vicinity of the project,or is located in the designated critical habitat and shall not begin work on the activity until notified by the District Engineer that the requirements of the Endangered Species Act have been satisfied and that the activity is authorized.For activities that may affect Federally-listed endangered or threatened species or designated critical habitat,the notification must include the name(s)of the endangered or threatened species that may be affected by the proposed work or that utilize the designated critical habitat that may be affected by the proposed work.As a result of formal or informal consultation with the FWS or NMFS,the District Engineer may add species-specific regional endangered species conditions to the NWPs. (b)Authorization of an activity by a nationwide permit does not authorize the"take"of a threatened or endangered species as defined under the Federal Endangered Species Act.In the absence of separate authorization,e.g.,an ESA Section 10 NW General Conditions I of 6 Encl 3 (10)For NWP 31,Maintenance of Existing Flood Control Projects,the prospective permittee must either notify the District Engineer with a PCN prior to each maintenance activity or submit a five year(or less)maintenance plan. In addition,the PCN must include all of the following: (i)Sufficient baseline information so as to identify the approved channel depths and configurations and existing facilities.Minor deviations are authorized,provided the approved flood control protection or drainage is not increased; (ii)A delineation of any affected special aquatic sites,including wetlands;and, (iii)Location of the dredged material disposal site. (II)For NWP 33,Temporary Construction,Access,and Dewatering,the PCN must also include a restoration plan of reasonable measures to avoid and minimize adverse effects to aquatic resources. (12)For NWPs 39, 43,and 44,the PCN must also include a written statement to the District Engineer explaining how avoidance and minimization of losses of waters of the United States were achieved on the project site. (13)For NWP 39,Residential,Commercial,and Institutional Developments,and NWP 42,Recreational Facilities,the PCN must include a compensatory mitigation proposal that offsets unavoidable losses of waters of the United States or justification explaining why compensatory mitigation should not be required. (14)For NWP 40,Agricultural Activities,the PCN must include a compensatory mitigation proposal to offset losses of waters of the United States. (15)For NWP 43,Stormwater Management Facilities,the PCN must include,for the construction of new stormwater management facilities,a maintenance plan(in accordance with State and local requirements,if applicable)and a compensatory mitigation proposal to offset losses of waters of the United States. (16)For NWP 44,Mining Activities,the PCN must include a description of all waters of the United States adversely affected by the project,a description of measures taken to minimize adverse effects to waters of the United States,a description of measures taken to comply with the criteria of the NWP,and a reclamation plan(for aggregate mining activities in isolated waters and non-tidal wetlands adjacent to headwaters and any hard rock/mineral mining activities). (17)For activities that may adversely affect Federally-listed endangered or threatened species,the PCN must include the name(s)of those endangered or threatened species that may be affected by the proposed work or utilize the designated critical habitat that may be affected by the proposed work. • (18)For activities that may affect historic properties listed in,or eligible for listing in,the National Register of Historic Places,the PCN must state which historic property may be affected by the proposed work or include a vicinity map indicating the location of the historic property. (19)For NWPs 12, 14,29, 39, 40, 41, 43, and 44,where the proposed work involves discharges of dredged or fill material into waters of the United States resulting in permanent,above-grade fills within 100-year floodplains(as identified on FEMA's Flood Insurance Rate Maps or FEMA-approved local floodplain maps),the notification must include documentation demonstrating that the proposed work complies with the appropriate FEMA or FEMA-approved local floodplain construction requirements. (c)Form of Notification:The standard individual permit application form(Form ENG 4345)may be used as the notification but must clearly indicate that it is a PCN and must include all of the information required in(b)(1)-(19)of General Condition 13.A letter containing the requisite information may also be used. (d)District Engineer's Decision: In reviewing the PCN for the proposed activity,the District Engineer will determine whether the activity authorized by the NWP will result in more than minimal individual or cumulative adverse environmental effects or may be contrary to the public interest.The prospective permittee may,optionally,submit a proposed mitigation plan with the PCN to expedite the process and the District Engineer will consider any proposed compensatory mitigation the applicant has included in the proposal in determining whether the net adverse environmental effects to the aquatic environment of the proposed work are minimal.If the District Engineer determines that the activity complies with the terms and conditions of the NWP and that the adverse effects on the aquatic environment are minimal,the District Engineer will notify the permittee and include any conditions the District Engineer deems necessary.Any compensatory mitigation proposal must be approved by the District Engineer prior to commencing work.If the prospective permittee is required to submit a compensatory mitigation proposal with the PCN,the proposal may be either conceptual or detailed.If the prospective permittee elects to submit a compensatory mitigation plan with the PCN,the District Engineer will expeditiously review the proposed compensatory mitigation plan.The District Engineer must review the plan within 45 days of receiving a complete PCN and determine whether the conceptual or specific proposed mitigation would ensure no more than minimal adverse effects on the aquatic environment.If the net adverse effects of the project on the aquatic environment(after consideration of the compensatory mitigation proposal) are determined by the District Engineer to be minimal,the District Engineer will provide a timely written response to the applicant stating that the project can proceed under the terms and conditions of the nationwide permit.If the District Engineer determines that the adverse effects of the proposed work are more than minimal,then he will notify the applicant either: (I)That the project does not qualify for authorization under the NWP and instruct the applicant on the procedures to seek authorization under an individual permit; (2)that the project is authorized under the NWP subject to the applicant's submission of a mitigation proposal that would reduce the adverse effects on the aquatic environment to the minimal level;or NW General Conditions 3 of 6 Encl3 (a)Compensatory mitigation at a minimum I:l ratio will be required for all wetland impacts requiring a PCN. Consistent with National policy,the District Engineer will establish a preference for restoration of wetlands to meet the minimum compensatory mitigation ratio,with preservation used only in exceptional circumstances. (b)To be practicable,the mitigation must be available and capable of being done considering costs,existing technology,and logistics in light of the overall project purposes.Examples of mitigation that may be appropriate and practicable include,but are not limited to:reducing the size of the project;establishing and maintaining wetland or upland vegetated buffers to protect open waters such as streams;and replacing losses of aquatic resource functions and values by creating,restoring, enhancing,or preserving similar functions and values,preferably in the same watershed; (c)The District Engineer will require restoration,creation,enhancement,or preservation of other aquatic resources in order to offset the authorized impacts to the extent necessary to ensure that the adverse effects on the aquatic environment are minimal.An important element of any compensatory mitigation plan for projects in or near streams or other open waters is the establishment and maintenance,to the maximum extent practicable,of vegetated buffers next to open waters on the project site. The vegetated buffer should consist of native species.The District Engineer will determine the appropriate width of the vegetated buffer and in which cases it will be required.Normally,the vegetated buffer will be 25 to 50 feet wide on each side of the stream, but the District Engineer may require wider vegetated buffers to address documented water quality concerns.If there are open waters on the project site and the District Engineer requires compensatory mitigation for wetland impacts to ensure that the net adverse effects on the aquatic environment are minimal,any vegetated buffer will comprise no more than 1/3 of the remaining compensatory mitigation acreage after the permanently filled wetlands have been replaced on a one-to-one acreage basis.In addition,compensatory mitigation must address adverse effects on wetland functions and values and cannot be used to offset the acreage of wetland losses that would occur in order to meet the acreage limits of some of the NWPs e.g.,for NWP 39,1/4 acre of wetlands cannot be created to change a'/:acre loss of wetlands to a'/.acre loss;however,/2 acre of created wetlands can be used to reduce the impacts of a1/3 acre loss of wetlands.If the prospective permittee is required to submit a compensatory mitigation proposal with the PCN,the proposal may be either conceptual or detailed. (d)To the extent appropriate,permittees should consider mitigation banking and other appropriate forms of compensatory mitigation.If the District Engineer determines that compensatory mitigation is necessary to offset losses of waters of the United States and ensure that the net adverse effects of the authorized work on the aquatic environment are minimal, consolidated mitigation approaches,such as mitigation banks,will be the preferred method of providing compensatory mitigation,unless the District Engineer determines that activity-specific compensatory mitigation is more appropriate,based on which is best for the aquatic environment.These types of mitigation are preferred because they involve larger blocks of protected aquatic environment,are more likely to meet the mitigation goals,and are more easily checked for compliance.If a mitigation bank or other consolidated mitigation approach is not available in the watershed,the District Engineer will consider other appropriate forms of compensatory mitigation to offset the losses of waters of the United States to ensure that the net adverse effects of the authorized work on the aquatic environment are minimal. 20.Spawning Areas.Activities,including structures and work in navigable waters of the United States or discharges of dredged or fill material, in spawning areas during spawning seasons must be avoided to the maximum extent practicable.Activities that result in the physical destruction e.g.,excavate,fill,or smother downstream by substantial turbidity of an important spawning area are not authorized. 21.Management of Water Flows.To the maximum extent practicable,the activity must be designed to maintain • preconstruction downstream flow conditions e.g.,location,capacity,and flow rates.Furthermore,the activity must not permanently restrict or impede the passage of normal or expected high flows(unless the primary purpose of the fill is to impound waters)and the structure or discharge of dredged or fill material must withstand expected high flows.The activity must,to the maximum extent practicable,provide for retaining excess flows from the site,provide for maintaining surface flow rates from the site similar to preconstruction conditions,and must not increase water flows from the project site,relocate water,or redirect water flow beyond preconstruction conditions.In addition,the activity must,to the maximum extent practicable,reduce adverse effects such as flooding or erosion downstream and upstream of the project site,unless the activity is part of a larger system designed to manage water flows. 22.Adverse Effects From Impoundments.if the activity,including structures and work in navigable waters of the United States or discharge of dredged or fill material,creates an impoundment of water,adverse effects on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow shall be minimized to the maximum extent practicable. 23.Waterfowl Breeding Areas.Activities,including structures and work in navigable waters of the United States or discharges of dredged or fill material,into breeding areas for migratory waterfowl must be avoided to the maximum extent practicable. 24. Removal of Temporary Fills.Any temporary fills must be removed in their entirety and the affected areas returned to their preexisting elevation. 25. Designated Critical Resource Waters.Critical resource waters include,NOAA-designated marine sanctuaries,National Estuarine Research Reserves,National Wild and Scenic Rivers,critical habitat for Federally listed threatened and endangered species,coral reefs,State natural heritage sites,and outstanding national resource waters or other waters officially designated by NW General Conditions 5 of6 Encl 3 • REASONABLE AND PRUDENT MEASURES (as required the Programmatic Biological Opinion) 1. You must have erosion control materials,e.g., silt fence or weed-free bales,available on-site to respond to sediment emergencies. An oil-absorbing, floating boom must be available, on-site, during all phases of construction whenever surface water is present. All temporary erosion control materials are in- place and appropriately installed downslope of project activities within the riparian area. Effective erosion control measures will be in-place at all dimes during the construction period and not removed until permanent erosion control measures are effective. 2. When heavy equipment is required,you shall use equipment having the least impact, e.g., minimally sized, rubber tired. All heavy equipment, vehicle staging, maintenance, and refueling and the fuel storage areas shall be fueled a minimum of 150 feet horizontal distance from any stream. All equipment that is used for in-stream work will be cleaned prior to operations below the bankfull elevation and all external oil and grease will be removed,along with dirt and mud. No untreated wash and rinse water will be discharged into streams and rivers without adequate treatment. All vehicles operated within 150 feet of any stream or water body will be inspected daily for fluid leaks before leaving the vehicle staging area. Any leaks detected will be repaired before the vehicle resumes operation. When not in use, vehicles will be stored in the vehicle staging area. 3. Site preparation is completed in the following manner, including removal of stream materials,topsoil, surface vegetation and major root systems. a. Any in-stream large wood or riparian vegetation that is moved or altered during construction will stay on site or be replaced with a functional equivalent. b. Clearing and grubbing will not exceed 250 square feet within 150 feet of any stream occupied by listed salmonids during any part of the year, or within 50 feet of any stream not occupied by listed salmonids. c. Tree removal will be strictly limited. i. All perennial and intermittent streams: No tree greater than 3 inches in diameter at breast height will be removed from within 50 feet horizontal distance of the ordinary high water mark. ii. On any stream supporting a listed salmonid:No more than 5 trees(3 inches diameter at breast height or greater)total may be removed from the area spanning 50 feet to 150 feet horizontal distance from the ordinary high water mark. iii. Tree removal will be mitigated for onsite by a 2:1 replanting ratio. d. Native channel material,topsoil and native vegetation removed for the project shall be stockpiled for redistribution on the project area when the project area is to be revegetated or restored. 4. Earthwork, including drilling, blasting,excavation, dredging,filling and compacting, is completed in the following manner: a. Boulders,rock,woody materials and other natural construction materials used for the project must be obtained from outside of the riparian area. b. During excavation, native streambed materials will be stockpiled above the bankfull elevation for later use. Once riprap has been placed, native materials will be placed over the top of the riprap. c. Material removed during excavation will only be placed in locations where it cannot enter streams or other water bodies. d. All exposed or disturbed areas will be stabilized to prevent erosion. i. Areas of bare soil within 150 feet of waterways,wetlands,or other sensitive areas will be stabilized by seeding with native plants,mulching, and placing erosion control blankets and mats, if applicable,as quickly as reasonable after exposure,but within 7 days of exposure. ii. All other areas will be stabilized as quickly as reasonable, but within 14 days of exposure. iii. Seeding outside of the growing season will not be considered adequate nor permanent stabilization. End 4 e. All erosion control devices will be inspected during construction to ensure that they are working adequately. i. Erosion control devices will be inspected daily during the rainy season, weekly during the dry season, monthly on inactive sites. ii. If inspection shows that the erosion controls are ineffective, work crews will be mobilized immediately, during working and off-hours, to make repairs, install replacements, or install additional controls as necessary. iii. Erosion control measures will be judged ineffective when turbidity plumes are evident in waters occupied by listed salmonids during any part of the year. f. If soil erosion and sediment resulting from construction activities is not effectively controlled,you shall limit the amount of disturbed area to that which can be adequately controlled. g. Sediment will be removed from sediment controls once it has reached 1/3 of the exposed height of the control. Whenever straw bales are used, they will be staked and dug into the ground 5 inches(12 cm). Catch basins will be maintained so that no more than 6 inches (15 cm)of sediment depth accumulates within traps or sumps. h. Sediment-laden water created by construction activity will be filtered before leaving the right-of- way or entering a stream or other water body. Silt fences or other detention methods will be installed as close as reasonable to culvert outlets to reduce the amount of sediment entering aquatic systems. 5. Site restoration and clean-up, including protection of bare earth by seeding, planting, mulching and fertilizing, shall be done in the following manner. a. All damaged areas will be restored to pre-work conditions including restoration of original streambank lines, and contours. b. All exposed soil surfaces, including construction access roads and associated staging areas, will be stabilized at finished grade with mulch, native herbaceous seeding, and native woody vegetation prior to October 1. On cut slopes steeper than 1 vertical to 2 horizontal, a tackified seed mulch will be used so that the seed does not wash away before germination and rooting occurs. In steep locations, a hydro- mulch will be applied at 11/2 times the normal rate. c. Disturbed areas will be planted with native vegetation specific to the project vicinity or the region of the state where the project is located, and will comprise a diverse assemblage of woody and herbaceous species. d. Plantings will be arranged randomly within the revegetation area. e. All plantings will be completed prior to 15 April. f. No herbicide application will occur within 300 feet of any stream channel as part of this permitted action. Mechanical removal of undesired vegetation and root nodes is permitted. g. No surface application of fertilizer will be used within 50 feet of any stream channel as part of this permitted action. 11. Fencing will be installed as necessary to prevent access to revegetated sites by livestock or unauthorized persons. i. Plantings must achieve an 80 percent survival success after three years. i. If success standard has not been achieved after 3 years,the applicant will submit an alternative plan to the Portland District Regulatory Branch office. The alternative plan will address temporal loss of function. ii. Plant establishment monitoring will continue and plans will be submitted to the Portland District Regulatory Branch office until site restoration success has been achieved. 6. You must allow reasonable access to your project site for long-term monitoring of the effectiveness of the above conditions and other reasonable and prudent measures to avoid and minimize taking listed species. For projects proposed in areas with no discernible gradient break (gradient of 2%or less),monitoring shall take place at 4 hour intervals and the turbidity standard may be exceeded for a maximum of one monitoring interval per 24 hour work period provided all practicable control measures have been implemented. This standard applies only to coastal lowlands and floodplains,valley bottoms and other low-lying and/or relatively flat land. For projects in all other areas,the turbidity standard can be exceeded for a maximum of 2 hours(limited duration)provided all practicable erosion control measures have been implemented. These projects may also be subject to additional reporting requirements. Turbidity shall be monitored during active in-water work periods. Monitoring points shall be at an undisturbed site (representative background) 100 feet upstream from the turbidity causing activity,i.e.,fill or discharge point, 100 feet downstream from the fill point,and at the point of fill. A turbidimeter is recommended,however,visual gauging is acceptable. Turbidity that is visible over background is considered an exceedance of the standard. • Practicable erosion control measures which shall be implemented,as appropriate,include the following: a. Place fill in the water using methods that avoid disturbance to the maximum practicable extent,e.g.placing fill with a machine rather than end-dumping from a truck; b. Prevent all construction materials and debris from entering waterway; c. Use filter bags,sediment fences,sediment traps or catch basins,silt curtains,leave strips or berms,Jersey barriers,sand bags,or other measures sufficient to prevent movement of soil; d. Use impervious materials to cover stockpiles when unattended or during rain event; e. Erosion control measures shall be inspected and maintained daily to ensure their continued effectiveness, f. No heavy machinery in a wetland or other waterway; g. Use a gravel staging area and construction access; h. Fence off planted areas to protect from disturbance and/or erosion;and i. All in-water work,including temporary fills or structures,shall occur within the time periods recommended by Oregon Department of Fish and Wildlife(ODFW)for in-water work specified in the most current version of Oregon Guidelines for Timing of In-Water Work to Protect Fish and Wildlife Resources. All exceptions to the Guidelines shall require specific approval from the Corps after consultation with ODFW or National Marine Fisheries Service(NMFS). On Tribal lands,the Corps will coordinate exceptions with the U.S.Environmental Agency(EPA). 3. Riparian Vegetation Protection and Restoration. Riparian,wetland,and shoreline vegetation in the project area shall he protected from disturbance to the maximum extent possible and be restored and enhanced when unavoidably disturbed due to activities associated with the authorized work. Replace all damaged or destroyed vegetation with native plant materials. After five years,the standard for success is generally 80 percent survival for native plant species that replace the habitat type lost or damaged. Planted areas will be temporarily fenced,or otherwise protected from damage,until the vegetation is established. Project sites shall be revegetated to the extent possible up to the bank-full stage or line of non-aquatic vegetation,whichever is greater. When any wetland areas are adversely affected,revegetation shall extend to the upland limits of the wetland area. 4. Stormwater. Stormwater from new construction developments,conveyed or discharged through outfalls,shall be first treated by a biofiltration swale,stormwater detention pond,or other treatment facility specifically designed to remove stormwater contaminants,before entering streams or wetlands,including mitigation wetlands,so as to minimize pollutants entering those water bodies. 5. Bank Stabilization. a. The linear threshold for bank stabilization projects under any nationwide is 250 feet. All projects exceeding the threshold require individual water quality certification. b. Bioengineering is required. Native plantings,such as willow saplings,shall be incorporated into stream bank stabilization structures in order to provide bank erosion protection,variable habitat for wildlife,and shade. The extent and nature of the proposed land form alteration or development will not create site disturbances to an extent greater than that required for the use. There will be no change of use. Disturbance will be limited to that required for erosion prevention measures. 2. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The proposed land form alterations are intended to improve the stability of the slopes. No other development is proposed. 3. The structures are appropriately sited and designed to ensure structural stability and proper drainage of foundation and crawl space areas for development with any of the following soil conditions: wet/high water table; high shrink-swell capability; compressible/organic; and shallow depth-to-bedrock. No structures are proposed. 4. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.745, Landscaping and Screening. No natural vegetation will be removed. . Drainageway. 1. The extent and nature of the proposed land form alteration or development will not create site disturbances to the extent greater than that required for the use. The landform alterations will be limited to that required to install log weirs to control the grade of the creek and prevent erosion. 2. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The proposed log weirs are intended to stabilize the creek and prevent erosion. 3. The water flow capacity of the drainageway is not decreased. The flow characteristics of the drainageway will not be altered. R 4. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.745, Landscaping and Screening. There is no natural vegetation in the drainageway. Native vegetation will be installed. 5. The drainageway will be replaced by a public facility of adequate size to accommodate maximum flow in accordance with the adopted 1981 Master Drainage Plan. The drainageway will remain in-place. 6.
