MMD2005-00019 MMD2005 00019 SHURGARD STORAGE 4.,.461A September 23, 2005 CITY OF TIGARD OREGON Shurgard Storage Attn: Steve Tangney 21669 Redwood Road Castro Vally, CA 94546 Dear Mr. Tangney: This letter is in response to your request for Minor Modification (MMD2005-00019) approval to a previous Conditional Use (CU 88-09) to remove the existing office/resident manager's apartment at the Shurgard Storage located at 15700 SW Pacific Highway (WCTM 2S110DC, Tax Lot 300) and replace it with a new office area and upgraded landscaping along the street frontage and in the parking area. The Tigard Community Development Code, Conditional Use Section, states that any modification which is not within the description of a major modification shall be considered a minor modification. Section 18.330.020.B. states that the Director shall determine: that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use. No change in land use is proposed. The site is developed as a storage unit facility. After the modification the site will still be a storage unit facility. 2. A 10% increase in dwelling unit density. The subject site does not involve a residential use. Therefore, this standard does not apply. 3. A change in the type and/or location of access ways and parking areas where off- site traffic would be affected. No change to the existing access way or parking area is proposed. Therefore, this standard does not apply. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified. The applicant has indicated that the new building will be approximately the same size as the existing. However, the applicant has not indicated the square footage of either building. Therefore, the applicant is required to provide a plan showing the square footage of the existing building verses the square footage of the proposed building. The applicant is also required to provide evidence that the floor area of the proposed building does not exceed the existing by more than 10%. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space. There was no common open space required in the original approval. There are no setback requirements within the C-G zoning district and none were specified in the original approval. 7. An elimination of project amenities by more than 10% where previously specified provided such as: 1. Recreational facilities 2. Screening; or 3. Landscaping provisions. The revised office location and related site work will reduce the total landscaped area by approximately 291 square feet. Since the existing site development includes over 30,000 square feet of landscaping, this reduction is less than one percent. 8. A 10% increase in the approved density. The proposed modification is non-residential. Therefore, this standard does not apply. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE CONDITION BELOW: CONDITION: Provide a plan showing the square footage of the existing building verses the square footage of the proposed building. The applicant is also required to provide evidence that the floor area of the proposed building does not exceed the existing by more than 10%. This request is determined to be a minor modification to an existing site. The scope of work in this application is limited to removal of the existing office/resident manager's apartment and replacement with a new office area. There will also be upgraded landscaping along the street frontage and in the parking area to meet current code standards, and minor upgrades to the building elevations that face the street. Other work, such as interior improvements in the storage buildings, is not subject to the Conditional Use process. This application qualifies as a "minor revision" based of the following review of the Code standards. The storage industry has evolved since 1985, to the extent that resident managers are no longer required. The office is staffed during business hours, but thereafter the extensive security systems now available mitigate the need for an on-site presence. The security systems, which include multiple lock down points and surveillance cameras, are controlled at the manager's desk in the base of the lighthouse element. The lighthouse element is a registered corporate identity, which is included in all new Shurgard stores. In addition, it is being introduced to older facilities through remodeling and upgrades as proposed at this facility. Since the lighthouse base is the control are for the manager, it is designed and located to provide excellent views of critical site areas such as the entry gate. CODE CRITERIA: Section 18.330.020(B)2 lists criteria which establish whether a proposal is to be reviewed as a major or minor modification. Each is addressed as follows: "a. A change in land use;" Comment: No change in land use is proposed. "b. A 10% increase in dwelling unit density;" Comment: This criterion does not apply since the project is non-residential. "c. A change in the type and/or location of access ways..." Comment: No change in access or parking that effects off site traffic is proposed since the additional spaces to be provided behind the building are served by the existing driveway. An increase in the floor area...;" Comment: This application will replace the existing office/residence with a new office of approximately the same area. "e. A reduction of more than 10% of the area reserved for common open space...;" Comment: There was no common open space required in the original approval. "f. A reduction of specified setback requirements by more than 20%;" Comment: The CG Zone does not require any setbacks in the area of the new office, and none were specified in the original approval. "g. An elimination of project amenities by more than 10%...;" Comment: The revised office location and related site work will reduce the total landscaped area by approximately 291 square feet. Since the existing site development includes over 30,000 square feet of landscaping, this reduction is less than one percent of the total. "h. A 10% increase in the approved density;" Comment: The project is non-residential, so this criterion does not apply. Section 18.330.030(C) lists approval criteria for a Type I Application as follows: a. "The proposed development is in compliance with all applicable requirements of this title," Comment: The CG zone does not require building setbacks for the front yard nor side yards abutting CG zoned land, so there are no setbacks required for the revised office. The proposed lighthouse element of the office is 36 feet in height, which below the CG zone height limit of 45 feet. The parking requirement, set at 8 in the 1989 Conditional Use modification, is not effected since the use will remain unchanged. b. "The modification is not a major modification as defined in Subsection A above." Comment: The findings above show that this application meets the criteria for a Minor Modification. The application was submitted without the benefit of a pre-application conference. As a result, the wrong type of application was submitted. In the General Commercial zone, self service storage is listed as a conditional use application. The good news is that the height increase requirements do not apply to modifications of a conditional use. It is possible that you will be able to meet the minor modification requirements which would mean a Type I land use application instead of the Type II site development review, or a Type III conditional use. If you qualify for a minor modification for which the fee is considerably less than that of the SDR you applied for, you are eligible to a refund of 80 percent of the SDR application fee, if your SDR application is withdrawn at this point. I would suggest you contact your application agents and have them review the relevant provisions of Tigard's Community Development Code and then prepare the appropriate application. I would also suggest that you review the conditions of approval of the original conditional use approval. Certain displays at the site violated the conditions placed by the Planning Commission on the original approval. These will be a consideration in our review of any subsequent applications. The scope of work is limited to removal of the existing office/resident manager's apartment and replacement with a new office area. There will also be upgraded landscaping along the street frontage and in the parking area to meet current code standards, and minor upgrades to the building elevations that face the street. Other work, such as interior improvements in the storage buildings, is not subject to Site Development Review. This application does not qualify as a "minor revision" because the new office includes a corporate lighthouse element which exceeds the existing building height by more than 20%. The lighthouse element is a registered corporate identity, which is included in all new Shurgard stores. In addition, it is being introduced to older facilities through remodeling and upgrades as proposed at this facility. The base of the lighthouse is the manager's central location for security and operations, with its location established for views to critical site areas such as the entry gate. CODE CRITERIA: Section 18.360.050 lists criteria which establish whether a proposal is to be reviewed as a major or minor modification. Each is addressed as follows: "1. An increase in dwelling unit density, or lot coverage for residential development;" Comment: This criterion does not apply since the project is non-residential. "2. A change in the ratio or number of different types of dwelling units;" Comment: This criterion does not apply since the project is non-residential. "3. A change that requires additional on-site parking in accordance with Chapter 18.765;" Comment: The Code specifies that parking for self service storage is based on a ratio of one space per four units. Since the number of units will not be affected by this application the number of parking spaces required is not affected. This criterion is met. "4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code;" Comment: Since this application will replace an existing office with a new office, the building type is not affected. An increase in the height of the building(s)by more than 20%;" Comment: The existing buildings are approximately 15 feet in height, as measured according to the Development Code. The proposed new office includes a lighthouse element, as described above, which is approximately 36 feet in height. While this does meet the Development Code height maximum of 45 feet in the CG District, the 20% threshold is exceeded and therefore a Major Revision is required. "6. A change in the type and location of accessways and parking areas where off-site traffic would be affected;" Comment: This application does not propose any change to the type and location of access and parking. This criterion is met. "7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day;" Comment: The ITE Trip Generation Manual establishes trip generation for self service storage based on a rate per storage unit. Since this application will not affect the number of units, the trip generation will not be effected. This criterion is met. "8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet;" Comment: The existing office is approximately 1300 sq. ft. in area, while the new office will be approximately 1280 sq. ft. This criterion is met. "9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%;" Comment: The CG zone does not require "common open space", so this criterion does not apply. "10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Comment: Recreational facilities are not required in the CG zone. Screening and landscaping provisions of the Code are met by the proposed redevelopment, so this criterion is met. "11. Each is addressed as follows: 1. "Compliance with this Title..." Comment: The various sections of the Code that apply to this application are individually addressed in this narrative. 2. "Relationship to Environment..." A. Building Location. Comment: The new office will be in the same location as the existing office. The positioning is critical to visibility from the street, and for security within the site. 3. "Exterior Elevations..." Comment: This criterion applies to multi-family developments; therefore this standard does not apply. 4. "Adjoining Uses." Comment: The area of work abuts existing office/commercial uses. Consequently, buffering between uses is not an issue. 5, 6, & 7. "All apply to multi-family development." Comment: This standard does not apply. 8. "Floodplain." Comment: Floodplain development is not proposed, so this standard does not apply. 9. "Demarcation of Space." Comment: The design provides for changes in the texture of paving — from asphalt street and parking areas to paved concrete sidewalks and walkways — and elevation changes to indicate different types of areas. Comment: Since security is an essential element of Shurgard's business, this design specifically avoids the creation of isolated areas in parking areas and adjacent the buildings. Comment: Although transit is rarely used by storage customers, there is public transit immediately adjacent this site. A new ADA accessible walkway connects the office to the public sidewalks. The standard has been met. 12. "Landscaping." Comment: This section requires that 15% of the gross site, including 20% of parking and loading areas to be landscaped. Data provided on the accompanying drawings shows that this standard is met. 13. "Drainage." Comment: Since the existing site development precedes current standards for stormwater detention and quality. The accompanying utility plan includes an upgrade to the existing system in the area of work as suggested by City Engineering. 14. "Provisions for Disabled." Comment: The site plan indicates a handicapped parking stall and ADA compliant access. The standards have been met. 15. "Underlying Zone." Comment: This site is zoned CG.
