You have requested approval to modify the Durham Elementary School site by constructing a replacement playground on an existing open multi-use field. The existing playground is the site of a pending development project. Seven structures will be new and four structures will be relocated from the existing playground location.In addition,you have proposed to construct a wood mulch pathway from an existing covered play area to the new open playground. The proposed activity is typical of school use,which is permitted conditionally in a R-12 (HD) zone. Past conditional use permits are CUP88-05 and CUP95-00006. The submitted site plan reflects the current and proposed conditions. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Chapter indicates that any modification which is not within the description of a major modification as provided in A through H below shall be considered a minor modification. The Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: A. A change in land use; The existing playground is currently for school use and the playground improvements will continue to be for school use. Therefore,the proposed modification will not cause a change in land use. B.An 10%increase in dwelling unit density; The site is not used for residential purposes. Therefore,dwelling unit density does not apply. C. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The applicant does not propose a change to the accessways or parking areas. D. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The applicant does not propose any changes to the existing building. Therefore, floor area will not increase. E.A reduction of more than 10% of the area reserved for common open space and/or usable open space; The proposed playground will be constructed over the existing multi-use field (usable open space) and will serve the purpose of usable open space. Therefore, the proposed modification will not reduce the area reserved for usable open space. F. A reduction of specified setback requirements by more than 20%; The applicant does not propose any changes to the existing building. Therefore, the proposed modification will not affect building setbacks. The setbacks for the playground will be 27 feet from the east property line, 183 feet from the north property line abutting the right-of-way along Durham Road, 46 feet from the west property line, and 270 feet from the south property line. These setbacks are within the required setbacks for schools,which are 30 feet for the front,20 feet for the side and 30 feet for the rear. As a note, the Durham Elementary School site is designated a Historic District (HD). The proposed modification will not alter the historic school building and will not cause the site to violate the Histonc Overlay standards. City of Tigard—Minor Modification June 2007 SUMMARY The Applicant requests Minor Modification approval of an existing Conditional Use in order to construct a replacement playground at an existing elementary school campus, adjacent to the Durham Elementary School building on a Residential(R-12)zoned site.The playground improvements will convert part of the existing multipurpose sports field into a new, larger playground area. PROPOSAL The Applicant requests Minor Modification approval of an existing Conditional Use in order to construct a replacement playground at an existing elementary school campus, adjacent to the Durham Elementary School building on 2.79 acres zoned R-12. The proposal includes the construction of a new playground area, which includes 11 playground structures. Of these structures 7 are new and 4 will be relocated from the existing playground location. In addition, the playground will be connected to the existing pedestrian circulation network on site utilizing a path that will extend to the elementary school building to the west of the playground site. SITE DESIGN The configuration of the proposed playground and associated improvements can be seen in Exhibit A. The playground is located in the central portion of the lot, directly east of the covered playground area that is attached to the Durham Elementary School building. The site is accessed via SW Shaffer Lane, through the CWS Facility to the west. A pedestrian pathway encircles the proposed playground and connects to the on-site circulation system near the covered play area. LANDSCAPING The lot is a multipurpose sports field in its entirety. The landscape plan shows the turf and the proposed playground configuration. Safety, maintenance, and aesthetics have been integrated into the design of the playground area.The landscape plan is located in Exhibit A. It shows the landscape improvements around the playground area. VEHICLE CIRCULATION Vehicle circulation is provided west of the building on the lot to the west. The site is accessed via SW Shaffer Lane, through the CWS Facility to the west. The parking lot adjacent to the school building provides the requisite amount of parking stalls and bus circulation for picking up and dropping off students. PEDESTRIAN ACCOMMODATIONS Pedestrian connection is provided along SW Shaffer Lane, through the CWS Facility to the west. The playground is linked by on-site sidewalks that connect to the building, parking areas, and the public sidewalk. UTILITIES AND INFRASTRUCTURE All utilities already exist on the site and connect to the building on the lot to the west of the playground. No additional utility connections are proposed. Major modification of approved or existing conditional use. 2. The Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: a. A change in land use; Response: The subject site is currently part of an elementary school campus and will remain part of an elementary school campus. The proposal includes the construction of a playground to be used by the students of the elementary school.No change in land use is proposed. b. A 10% increase in dwelling unit density; Response: No dwelling units exist on site. No dwelling units are proposed. This criterion does not apply. c. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; Response: As part of the proposed playground improvements,no change in the type and/or location of access ways and parking areas where off-site traffic would be affected is proposed. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; Response: The proposed playground improvements will not increase any floor areas on site. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space; Response: The proposed playground improvements will not reduce common open space and/or usable open space. The playground will be constructed over current multiple use field area (usable open space), and will remain usable open space in the form of a structured playground area. f. A reduction of specified setback requirements by more than 20%; Response: No setback reductions are proposed as part of the playground improvements. The proposed playground structures will be located approximately 27 feet from the east property line, 183 feet from the existing ROW property line along SW Durham Road, 46 feet from the western property line, and 270 feet from the southern property line. Please refer to the Development Plan Set in Exhibit A for more information. g. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening; or (3) Landscaping provisions; and Response: The proposed playground improvements will not reduce project amenities. The playground will be constructed over current multiple use field area(usable open space), and will remain usable open space in the form of a structured playground area. City of Tigard—Minor Modification June 2007 addition of 7 playground structures serves to increase the amenities on the elementary school campus,and the subject site in particular. h. A 10% increase in the approved density; Response: The proposed playground improvements will not create an increase in density. The playground will simply serve to replace usable open space of one type with usable open space of another type. 3. Upon the Director determining that the proposed modification to the conditional use plan is a major modification,the applicant shall submit a new application in accordance with Section 18.390.050. Response: The responses to specific code criteria and the development plans included in this application submittal provides evidence that this proposal meets all the criteria necessary to be qualified as a Minor Modification. C. Minor modification of approved or existing conditional use. 1. Any modification which is not within the description of a major modification as provided in Subsection B above shall be considered a minor modification. Response: The responses to specific code criteria and the development plans included in this application submittal provides evidence that this proposal meets all the criteria necessary to be qualified as a Minor Modification. 2. An applicant may request approval of a minor modification by means of a Type I procedure, as regulated by Section 18.390.040, using approval criteria in Subsection C3 below. Response: The Applicant respectfully requests approval of a Minor Modification to an existing Conditional Use by means of a Type I procedure, as regulated by Section 18.390.040, using approval criteria in Subsection C3 below. 3. A minor modification shall be approved, approved with conditions, or denied following the Director's review based on the findings that: a. The proposed development is in compliance with all applicable requirements of this title; and Response: This narrative, attached exhibits and the Development Plan Set provide evidence that the proposal is in compliance with all applicable requirements of this title. b. The modification is not a major modification as defined in Subsection A above. Response: Please see the responses to the applicable criteria above. 18.330.030 Approval Standards and Conditions of Approval A. Approval standards. The Hearings Officer shall approve,approve with conditions, or deny an application for a conditional use or to enlarge or alter a conditional use based on findings of fact with respect to each of the following criteria: 1. The site size and dimensions provide adequate area for the needs of the proposed use; Response: The site is 2.79 acres, or 121,532 square feet, and measures approximately 619 feet by 242 feet, which provides the area and dimensions for adequate clearance for the 9,300 square feet of proposed playground area that measures approximately 206 feet by 87 feet. 2. The impacts of the proposed use of the site can be accommodated considering size, shape,location,topography,and natural features; Durham Elementary School Improvements 6 WRG Design,Inc. City of Tigard—Minor Modification June 2007 Response: The proposed use will not create any new impacts of any kind. The current site is used as a multiple use elementary school sports field, while the proposal is to construct a playground structure within the current field area. The playground will simply serve to replace usable open space of one type with usable open space of another type. In addition,no impervious surfaces will be constructed. 3. All required public facilities have adequate capacity to serve the proposal; Response: The proposal will not require any public facility support of any kind. No utilities or public right-of-way is required for the proposal.This criterion does not apply. 4. The applicable requirements of the zoning district are met except as modified by this chapter; Response: All applicable requirements of the zoning district are met. Evidence is provided within this narrative,the Development Plan Set,and associated Exhibits. 5. The applicable requirements of 18.330.050; and Response: See Section 18.330.050 of this narrative for more information. 6. The supplementary requirements set forth in other chapters of this code including but not limited to Chapter 18.780, Signs, and Chapter 18.360, Site Development Review, if applicable,are met. Response: This narrative, attached exhibits and the Development Plan Set provide evidence that the proposal is in compliance with all applicable requirements of this title and all applicable chapters. B. Conditions of approval. The Hearings Officer may impose conditions on the approval of a conditional use,which are found necessary to ensure the use is compatible with other use in the vicinity, and that the impact of the proposed use on the surrounding uses and public facilities is minimized.These conditions may include,but are not limited to the following: 1. Limiting the hours,days,place and/or manner of operation; Response: The playground is utilized during recess on scheduled school attendance days for children's play activities. The new proposed playground will function as the existing playground currently functions. Upon relocation of the playground equipment from the existing playground, the new playground will be the only playground on site. Limiting the hours,days, place and/or manner of operation of the playground appears unnecessary due to the original conditional use approval allowing the existing playground and other school activities. 2. Requiring design features which minimize environmental impacts such as noise, vibration,air pollution,glare,odor and/or dust; Response: The proposed playground improvements are completely within the purview of the existing conditional use approval and associated conditions of approval. No increase or additional environmental impacts such as noise, vibration, air pollution, glare, odor and/or dust will be created during normal use of the proposed playground improvements. During a limited construction period,there may be added environmental impacts such as noise, vibration, air pollution, glare, odor and/or dust, which will be minimized by utilizing industry standard mitigation techniques. 3. Requiring additional setback areas,lot area,and/or lot depth or width; Response: Additional setback areas, lot area, and/or lot depth or width appears unnecessary due to the size and area of the school campus site. The subject site is 2.79 acres, while the entire Durham Elementary School Improvements 7 WRG Design,Inc. City of Tigard—Minor Modification June 2007 school campus is 10.94 acres, including the subject site. 4. Limiting the building height,size or lot coverage,and/or location on the site; Response: The playground has been located directly east of the existing covered play area in order to increase the efficiency of supervision and logistics for faculty and staff. The possible limitation of utilizing this location appears unnecessary. 5. Designating the size,number,location and/or design of vehicle access points; Response: Access to the school is not part of this proposal. All access points will remain unchanged. 6. Requiring street right-of-way to be dedicated and street(s)to be improved; Response: The playground improvements will be made prior to an access reconfiguration, which will be submitted sometime in the future. Due to the expiration of the access easement currently used for the school, the Major Modification and subsequent access improvement is inevitable. During the major Modification review process, any right-of- way and street improvements that are deemed applicable will be made. The Applicant requests that any future dedication and/or street improvements be applied to the Major Modification, if applicable. 7. Requiring landscaping, screening, drainage and/or surfacing of parking and loading areas; Response: All landscaping, screening, drainage and/or surfacing of parking and loading areas will remain unchanged. 8. Limiting the number,size,location,height and/or lighting of signs; Response: No signs are proposed. This criterion does not apply. 9. Limiting or setting standards for the location and/or intensity of outdoor lighting; Response: No outdoor lighting is proposed.This criterion does not apply. 10. Requiring berms,screening or landscaping and the establishment of standards for their installation and maintenance; Response: The proposed playground structures will be located approximately 27 feet from the east property line, 183 feet from the existing ROW property line along SW Durham Road, 46 feet from the western property line, and 270 feet from the southern property line. No additional berms, screening,or landscaping is warranted. 11. Requiring and designating the size,height,location and/or materials for fences; Response: The school property is bounded by a fence on all sides. 12. Requiring the protection and preservation of existing trees, soils, vegetation, watercourses,habitat areas and/or drainage areas; Response: The proposed playground improvements do not impact any trees, significant soils, vegetation, watercourses, habitat areas and/or drainage areas. This criterion does not apply. 13. Requiring the dedication of sufficient open land area for a greenway adjoining and within the floodplain when land form alterations and development are allowed within the 100-year floodplain; and Response: The proposed playground improvements are not located within any 100-year floodplain. Requiring the construction of a pedestrian/bicycle pathway within the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Response: The adopted pedestrian/bicycle pathway plan does not indicate any routes through or near the subject site. 18.330.050 Additional Development Standards for Conditional Use Types A. Concurrent variance application(s). A conditional use permit shall not grant variances to the regulations otherwise prescribed by this title. A variance application(s) may be filed in conjunction with the conditional use application and both applications may be heard at the same hearing. B. Additional development standards. The additional dimensional requirements and approval standards for conditional use are as follows: 8. Schools: a. There shall be no minimum lot size requirements for schools other than what is required for the applicable zoning district; Response: The subject site is zoned Residential-12 w/ Historic District Overlay (R-12(HD)). The minimum lot size for this district is 0.07 acres. The subject site is 2.79 acres. This criterion has been met. b. Setbacks: (1) The front yard setback shall be a minimum of 30 feet; Response: As seen in the Development Plan Set in Exhibit A,the front yard setback is 183 feet from the existing ROW of SW Durham Road to the closest play structure. This criterion has been met. (2) On corner lots and through lots, the setback shall be a minimum of 20 feet on any side facing a street,plus meet visual clearance areas,Chapter 18.795; Response: The subject site is not a corner lot or a through lot.This criterion does not apply. (3) The side yard setback shall be a minimum of 20 feet;and Response: As seen in the Development Plan Set in Exhibit A, the side yard setback is 27 feet from the eastern property line, and 46 feet from the western property line to the closest play structure.This criterion has been met. (4) The rear yard setback shall be a minimum of 30 feet. Response: As seen in the Development Plan Set in Exhibit A,the rear yard setback is approximately 270 feet from the southern property line to the closest play structure. This criterion has been met. CHAPTER 18.740 HISTORIC OVERLAY 18.740.020 Applicability of Provisions B. Designated activities.The provisions of this chapter apply to: 1. Response: The subject site is part of an elementary school campus, comprised of a total of three taxlots,which includes an historic structure. The historic structure is not located upon the subject site (taxlot 2S113BA00401). No demolition, alterations, or new construction in relation to an historic structure is proposed. The Historic Overlay criteria are not applicable. CONCLUSION The Applicant is requesting Minor Modification approval to an existing Conditional Use for playground improvements at an existing elementary school campus.
