Smith,Architect 715 SW Morrison Street, Suite 909 Portland, OR 97205 RE: Minor Modification Approval City of Tigard Case File No. MMD2008-00018/Gator's Pub and Eatery Dear Mr. Nestlerode: This letter is in response to your application dated August 28, 2008 for a Minor Modification approval for a deck addition to the existing building located at 11475 SW Pacific Hwy, WCTM 1S136AD, Tax Lot 4301 within the City of Tigard, Oregon. The proposed modifications to the existing development are described in the application narrative and site pan and include a partially covered patio totaling 670 square feet. The following analysis shows that the proposed development is a minor modification and is hereby approved. Section 18.360.060 of the Tigard Development Code Site Development Review chapter,states;"any modification which is not within the descnption of a major modification as provided in section 18-360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The subject development is commercial. This criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The subject development is commercial. This criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed roof alteration and patio extension would not increase the floor area of the existing structure. Therefore,no addition on-site parking would be required. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposed modification does not involve a change to the type of commercial structure. 5. An increase in the height of the building(s) by more than 20 percent. The proposed roof alteration is less than the height of the existing building. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The modification proposal does not include any change in the type or location of accessways or parking areas. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed patio and roof alteration would not result in additional trips other than would be expected from a natural increase in patrons due to an improved reputation from an aesthetic upgrade and patio amenity. Therefore an increase in vehicular traffic as a result of the modification would not be expected to exceed 100 vehicles per day. 8. An increase in the floor areas roposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. Pursuant to the City of Tigard Community Development Code Section 18.120.73, "The floor area of a building, or portion thereof, not provided with surrounding exterior walls shall be the useable area under the horizontal projection of the roof . . ." The proposed modification will not increase the floor area as the existing awnings cover the same area as is proposed for the roof alteration. In any case,the covered area is less than 5,000 square feet. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The Development Code requires a minimum 15% landscaped area.. open space area is otherwise required. As shown in the applicant's site plan and stated in the applicant's narrative,the proposal will reduce the existing landscaped area by 429 square feet (9%) for the patio, leaving 4,041 square feet (19%), consistent with the 15% minimum landscaped area required by the code. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. As shown in the applicant's site plan and stated in the applicant's narrative, the proposal will reduce the existing landscaped area by 429 square feet (9%) for the patio, leaving 4,041 square feet (19%), consistent with the 15% minimum landscaped area required by the code. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria B1 through 10 above. The proposed modifications do not modify any of the three conditions from the original approval dated December 11, 1974,which is included with the applicant's materials. As the findings above show,this request is determined to be a minor modification to an existing development and approved plan and is in compliance with all applicable requirements of Title 18 of the Tigard Municipal Code.
