The fence south of the Struvite Recovery Facility shall be of a type that is vision obscuring. 2.) Applicant shall call the Planning Division for final approval after installation. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is located at 16580 SW 85`'' Avenue and consists of the Durham Advanced Wastewater Treatment Facility and its associated Struvite Recovery Facility. The site has an existing conditional use approval for Basic Utilities. The proposed mechanical unit is not visible from the east or north and is not near a vehicle right of way other than the railroad. No public access is allowed. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION TO CONDITIONAL USE: Section 18.330.20.B contains the following criteria for approval of a request for Minor Modification of a Conditional Use: Section 18.020.B.2 states that the Director shall determine that a major modification has resulted if one or more of the changes listed below have been proposed: a. A change in land use; The subject property has a conditional use classification of Basic Utilities. No change in land use will be proposed as part of this project. b. A ten% increase in dwelling unit density; The proposed project does not affect dwelling unit density. c. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; There are no proposed changes to access ways or parking areas. d. An increase in the floor area proposed for non-residential use by more than 10 %where previously specified; There is no proposal for increase of non-residential floor area. A reduction of more than 10 % of the area reserved for common open space and/or usable open space; The proposal does not reduce area reserved for common open space or usable open space. f. A reduction of specified setback requirements by more than 20 %; There is no reduction of setback requirements. g. An elimination of project amenities by more than 10%where previously specified, such as: 1. Recreational facilities; No recreational facilities will be eliminated. 2. Screening; Screening of the mechanical unit will be provided by ensuring that the fence south of the Struvite Recovery Facility is sight obscuring. 3. Landscaping provisions; There are no proposed changes to the landscaping. h. A 10 % increase in the approved density; There is no approved density associated with the conditional use of Basic Utilities. FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a conditional use have been met. SECTION V. Clean Water Services (CWS)desires to replace the heating unit at the Durham Advanced Wastewater Treatment Facility's Struvite Recovery Facility located at Soh Ave 8fd 16580 SW 85th Avenue. The purpose for this change is because the building's existing unit is of inadequate capacity, not currently functional and is over 35 years old. Current Situation. CWS's old influent pumping station was converted to a Struvite Recovery Facility in 2009. The building's heating unit had been installed as part of the building's initial construction in the mid-1970's and as the years progressed was abandoned because of age, state of disrepair, and because the pumps ancillary electrical equipment shed enough heat to maintain a reasonable building temperature. The heating demands of the new building function require a new heating unit. Proposed Changes. CWS is proposing replacing the existing interior unit with a new unit. Heating demand of the new building function dictate the size of the new unit which coupled with and space limitations require the new unit to be a pad mounted unit adjacent to the building. Compliance of Proposed Changes with 18.330.020(B)(2)Criteria. Below are itemized responses to the criteria indicated in 18.330.020(B)(2): a. A change in land use: This portion of the overall Durham Facility is zoned I-R (Industrial Park) and is a `basic utility' use according to the Community Development Code—the Clean Water Services Durham Wastewater Treatment Facility. The proposed change is a very minor improvement consisting of addition of a concrete pad-mounted heating unit adjacent to an existing building. b. An 10% increase in dwelling unit density: There are no dwelling units on site as this site is not residential and the proposed change only alters the Durham Facility site via this minor improvement. c. A change in the type and location of access ways and parking areas where off site traffic would be affected: This improvement project includes no changes to the type and location or function of access ways and parking areas and no impact on off-site traffic. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified: This project does not alter any existing structure on the site - it simply adds an outside the building concrete pad-mounted heating unit. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space: This project converts a small portion of non-assessable (to the public) lawn area to a concrete equipment pad. f. A reduction of specified setback requirements by more than 20%: This project has no impact on the setback to the west towards Cook Park(pad is further away from the west property line than the existing building footprint which is an approximately 818 feet of setback). To the south, which is the Burlington Northern Railway right-of-way, the pad is approximately 15 feet(out of an approximate 170 foot setback)closer to the right-of-way than the existing building; but such a line is almost asymptotic to the curve in the railroad right-of- way. g. An elimination of project amenities by more than 10% where previously specified provided such as: Recreational facilities, screening, or landscaping provisions: This project again only converts approximately 75 square feet of lawn to a concrete pad-mounted heating unit. o Recreational Facilities: This project has no impact on recreational facilities. o Screening: This project is being done in conjunction with the recent conversion of the building function from pump station to process facility. The overall project has added a significant amount of landscaping to beautify the immediate plant area including flower and tree plantings to the west of the subject building thus increasing the screening of the area. See attached picture of landscaping done fall 2009 near the building and Cc'KYO�PG, note that three treesfiave subsequently been added to the building to the /.4d,,,,loea.�) west (to the left on the picture shown) for additional screening . o Landscaping: Per the above two items, this project reduces the lawn area slightly while increasing the amount of landscaping in the area of this building and corresponding screening from the direction of Cook Park. h.
