Ti�ard,OR 97223 � PROPOSAL: The applicant requests that the city reconcile an inconsistency within a conditional use permit approval, Ciry File No. CUP 2002-00003. The 2002 Final Order narranve idennfied a 28,000 square foot structure. The site plan attached to the Final Order depicts a 33,054 square foot structure. No operational differences, changes in access or circulation, greater utility/service demands, or additional impacts to sensitive lands are proposed with this reconciliation request beyond what was originally approved in 2002. LOCATION: 10330 SW Scholl's Ferxy Road;WCTTVI 1S134AB,Tax Lot 3300. COMPREHENSIVE PLAN AND ZONING DESIGNATION: R-12: Medium-Density Residenrial District. The R-12 zoning district is designed to accommodare a full ran�e of housin� types at a tnuumum lot size of 3,050 square feet. A wide range of civic and insntunonal uses are also permitted condirionally. APPLICABLE REVIEW CRITERIA: No addirional development, beyond that set forth in the inirial a�proved plan is proposed. The notice for the uutial approval included the followuig Communiry Development Code Chapters: 18.330, 18360, 18.370, 18.390, 18.510, 18.705, 18.72�, 18.745, 18.755, 18.765, 18.775, 18.780, 18J90, 18.795, 18.797(currendy incorporated into 18.775), and 18.810. Based on the limited nature of this applicarion, the approval standards relevant to this review are set forth in 18.330.030, but only to the extent that the 2002 Final Order suggests tliat compliance with the condirional use criteria were expressly limited to the considexation of a 28,000 square foot structure. SECTION II. DECISION Notice is hereby �iven that the City of Tig�a.rd Communiry Development Director's desi�nee has APPROVED the above request for Conditional Use Permit to reconcile a discrepancy in buildin� square foota�e from the ori�inal Condirional Use Permit (CUP2002-00003). BACKGROUND INFORMATION Site Information and Site Historv: The site is roughly 2.54 acres in size and occupied by the e:�isting facility, modular classrooms, and a parking lot. The site slopes generally from the northeast porrion of the site to the southwest portion of the site. The property was utilized as a single-family residence until 1992. !�t that time, a condirional use permit for the Korean Hope Presbyterian Church was obtained. The �7uslim Educational Trust purchased the property in 2000 to utilize as a place of worship and educarion for Muslims (MMD2000-00014). A Condit�onal Use Permit (CUP2002-00003) was approved in Se�tember 2002 for a two-phase expansion to accommodate a 28,000 square foot facility. Phase I involved site work in preparation for the full build-out and placement of modular buildings to accommodate nine classrooms and 200 students. This phase has been completed. Phase II involves the removal of all buildings and construcrion of the new facility to accommodate 320 students. Vicuut� Information: The site is zoned R-12 and surrounded by a mixture of multi-family and single-family residences. A portion of the green way off of SW Scholls Ferry Road and adjacent to Hiteon Creek also borders the site. Properties across Scholls Ferry Road from the project site are located within the City of Beaverton. Beaverton has had an opporturury to review the project,but did not offer comments. Describtion of the Rec�uest and Process: The Ciry of Tigard approved a conditional use permit (CUP2002-00003) to the applicant to expand the existing worship and educarion facility in 2000. The conditional use permit apphcarion narranve and approval states that the square foota�e of the center is 28,000, while the plans submitted with and approved as part of the application depict a 33,000 square foot building. The applicant has now requested the city to resolve the inconsistency between the different square footages cited within the approval. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Tigard Community Development Code requires that property owners within 500 feet of the subject site be notified of the�roposal, and be g�ven an opp ortunity �or wntten comments and/or oral testimony prior to a decision bemg made. In addirion, staff has posted a notice at the driveway to the site, visible from the street. Staff received the following comments from adjacent property owners and other interested parties.The following comments were received during the original comment period Alan Edwards owns property in the site vicinity. He expressed concerns related to traffic and parking requirements. He noted that the larger building will likely increase traffic in the area and require addirional parking. In addirion he noted that traffic has likely increased along Scholls Ferry Road since the 2002 approval. The applicant's traffic eng�neer, Ejaz Khan, responded to these comments by statin� that additional traffic will not be generated by the square footage reconciliation. The constructton was designed to accommodate a maxirnum of 320 students, and the trip generarion and parking is based upon the number of students and not square footage. The capacity requirements for both traffic and parking will not change with for this proposal. Mr. �dwards responded with further questions about how enrollment is limited to the ma�mum 320 students, and how an increase in traffic along Scholls Ferry Road since the original traffic report was d�ne is addressed. Mr. Khan replied that the facility is only designed to accommodate the approved 320 students. In order to have more students, the facili � would need to be expanded. Future expansions would require subsequent land use applications, and tra�fic increases will be addressed at that time. Mr. Khan also noted that the difference in square footage does not increase the traffic, and the applicant is vested with the original approval. He also points out that the original traffic study indicated a large residual capacity from the school's driveway. MUSI.IM lillUCA'1'ION�II.TRUS'I'(CUY201�-00001) Y;1Gl�,2OI�7 The city's design review engineer, Gus Duenas, studied the information submitted by the applicant's traffic engineer and sent the following response to Mr. Khan. Traffic generarion rates from schools are measured on a per student basis. The proposed maximum number of students has not changed, and the size of the proposed building supp�rts that number of students. If an increase in building square footage sufficient to support a larger student population be proposed, the applicant would be subject to another land use acuon. Future land use actton may or may not require an updated analysis. It depends on the size of an�� future proposed use. For the number of students proposed in the current applicarion, there is no further analysis reqwred regarding traffic impact. There are a couple of things to keep in mind regarding traffic from the proposed school on the site: • The trip generation rate per student is derived from a series of studies that result in a best-fit line for use nationwide. This line has �oints above and below it, so we use what the line produces as the average to use in similar situattons. There may be deviarions in the traffic produced (in fact,we expect them) depending upon the specific development, but we use the rate that produces a result we can reasonably expect for a proposed project. In short, the 300 is not a magic number above which the traffic generated would create any issues. • The intersecrion of the drivewa}� with Scholls Ferry Road was signalized as a result of the original land use action. This si�n alization, with dedicated left-turn lane from Scholls Ferry Road, produced residual capacity, which can su�r�rt whatever can be put on the properry. It would take a much larger project covering a much larger area to create a need for an updated traffic analysis for ingress and egress. Jan Mann is a property owner in the adjacent condominium development. There is a chain link fence between the two roperries. Ms. Mann noted that the fence is in disrepair from children consistendy climbing over the �ence. This disrepair creates a safet��hazard for the children. She commented that fence repair and adult supervision when the children are outside are needed in order to prevent injury. The applicant's representative, Brad Kilby with OTAK, replied that the chain link fence is owned by the condominium associanon and existed at the time of the original approval. An agreement between the associarion and MET allowed the fence, along with plantings on the 1�1ET site, to act as a screen/buffer between the uses. MF,T maintains that the children are supervised during recess and are not allowed to climb on the fence. Mr. Kilby noted that MET is willing to work with the condominium homeowners' association to resolve the issue. Because this is not an issue addressed by the development code, the ciry cannot condition a resolution as part of the land use process. However, because the applicant states they are �villing to work with the neighbor on a solurion, the applicant's contact informarion was passed along to I��s. 1�Tann. SECTION V. DECISION MAHING PROCEDURES AND PERMITS Summary Land Use Permits: Chapter 18.310 Defines the decision-making type to which the land-use application is assigned. "I'he original approval was a Condirional Use, which was processed as a Type III-HO (Hearings Officer) decision. The applicant has requested a reconciliarion of a discrepancy� within a previous land use decision. The Tigard Community Development Code ('IDC) does not specify a �rocess for the reconciliation of inconsistences between a��roved plans and approval narrarives for a condiuonal use or any other permit. Because the TDC lacks a requisite process for reconciling discrepancies in permits, the city may choose and apply an existing process as long as the process is consistent with Oregon Revised Statutes (ORS) 197.763 and constituttonal due process. The city has chosen the Type II process to review the applicant's request. This process is consistent with the ORS197.763 rec�wrements for quasi-judicial land use decisions. In addition, the Type II process provides sufficient not�ce to impacted parties, allows the party to be heard by an impartial decision maker, and provides the opportunity for appeal to a higher authority. These provisions comply with the due process requirements. This decision does not supersede but only reconciles an inconsistency within the prior CUP approval (CUP2002-00003). Some requirements of TDC chapters denoted with an asterisk (*) are based upon building square footage. These standards are addtessed only to ensure that the larger building approved on the site plan meet these requirements. SECTION VII. REVIEW CRITERIA AND FINDINGS Conditional Use Permit—Chapter 18.330 Section 18.330.010.A states that the purpose of this chapter is to provide standards and procedures under which a conditional use may be permitted, enlarged or altered if the site is appropriate and if other appropriate conditions of approval can be met. Mixed Solid Waste and Recyclables Storage—Cha�ter 18.755: Chapter 18.755 requires that new construction incorporates functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated Recyclables prior to pick- up and removal by haulers. The applicant must choose one (1) of the following four (4) methods to demonsuate compliance: Minimum Standard, Waste Assessment, Comprehensive Recycling Plan, or Franchised Hauler Review and Sign-Off: The applicant will have to submit evidence or a plan, which indicates com�liance with this section. Regardless of which method chosen, the applicant will have to submit a wntten sign-off from the franchise hauler regarding the facility location and compatibility. Non-residential buildin s shall provide a minimum storage area of 10 square feet, plus: (1) Office: 4 square feet�1,000 square feet gross floor area (GFA). �2 Retail: 10 square feet/1,000 square feet GFA. 3� Industrial: 6 square feet/1,000 square feet GFA. (4) Institutional: 4 square feet/1,000 square feet GFA. Under that premise, the development would be required to pro��ide four square feet for every thousand feet of building. In phase I, the apphcant is proposing a 60 square foot enclosure based on 10,200 square feet of building. In phase II, the apphcant is proposu-ig to construct a 280 square foot enclosure thereby surpassing the minimum requirement. However, the cnterion is not fully sarisfied. 2002 FINDING: 'I'he applicant has not provided a sign-off from the franchise hauler regarding the facility location and compatibility. 2002 CONDITION: Prior to site work, the a�plicant shall provide a sign-off letter from the franchise hauler that services the site with a letter approving the facility location for both phases. OFF-STREET PARKING AND LOADING (18.765� At the time of the erection of a new structure within any zoning district, off-street vehicle parking will be provided in accordance with Section 18.765.070. Facts from the 2002 staff re�ort: The subject site is located within the Metro Zone A. This designarion establishes a maxirrium parking standard of 7 + 1 space per preschool classroom, 2.5 spaces per elementary or Jr. High classroom, and 1 space for every 3.3 students and staff for Sr. High. The applicant has indicated that eleven classrooms will be elementary classrooms, one classroom will be a preschool classroom, and seven classrooms will be Sr. High classrooms for a total of 19 classrooms. The applicant has also indicated in the narrarive that there will be approximately 100 students and 10 staff inembers representing the Sr. High class. As such, the facility can provide a maximum of 68 parking spaces. The ininimum parking standards are as follows: 5+1 space per classroom, 2.0 spaces per classroom for elementary or Jr. High, and 1 space for every 5 students and staff for Sr. High. r�s such, the minimum parking requirement for the development will be 50 parking spaces satisfying the miniinum requirement. The a�plicant has indicated that there are currendy 28 parking spaces within the e�sting development. Durulg phase II, the ap�licant is proposing 85 spaces. This would exceed the maximum by 17 spaces, however, TDC Sectton 18.765.070(E) states that designated disabled access �arking spaces and designated carpool and van�ool spaces are not considered when determining the ma�mum parking requirement. The applicant has identified 4 designated disabled access-parking spaces and 17 desi�nated carpool spaces withm the design of the parking lot. Deducting these spaces form the maxirrium allowed brings the project into compliance with the standards. 2002 FINDING: The applicant has idenrified that 17 designated carpool spaces and 4 designated accessible parking spaces would be included within the project. 2002 CONDITION: Prior to final occupancy, the applicant shall ensure that the 17 designated carpool spaces and the 4 accessible parking spaces are properly designed and designated pursuant to TDC Secrion 18.7G5.030(F) and (G). STREET AND UTILITY IMPROVEMENTS STANDARDS CHAPTER- 18.810: Chapter 18.810 �rovides construction standards for the implementation of public and private facilities and utihties such as streets, sewers, and drainage. Accommodation of Upstream Drainage: Section 18.810.100.0 states that a culvert or other drainage facility shall be large enough to accommodate potential runoff ftom its entire upstream drainage area, whether inside or outside the development. The City Engineer shall approve the necessary size of the facility, based on the provisions of Desi and Construction Standards for Sanitary and Surface Water Management (as adopted by lean Water Services in 2000 and including any future revisions or amendments). Based upon information provided by the applicant's engineer, the detenuon pond and water quality facility was origuiall}� designed to accommodate the 33,054 square foot builciing. The current swale will be reconstructed per the CL�P2002-00003 approved plan and outside the Clean Water Services vegetated corridor as part of Phase II of the project. OTHER STAFF COMMENTS Tigatd Building Division has reviewed the request and has no objections or comments. City Arborist has reviewed the request and notes that there are no tree related items associated with this review. SECTION IX. AGENCY COMMENTS Clean Water Services and Tualatin Valley Fire and Rescue have reviewed the request and have no concerns or objections as submitted. SECTION X. DATE: February 7, 2011 Ron Bunch, Community Development Director, and I met with representatives from the Muslim Education Trust (ME'I� and OTAK (consultants) on February 4, 2011 to discuss METs wish to proceed with Phase II of a previously approved Condirional Use Permit (CUP2002-00003). MET would like to complete Phase II of development, which includes demolition of e�sting facilities and construction of a new 28,000 square foot building on the Scholl's Ferry site. The original approval for the phased project was granted in September of 2002. The Tigard Community Development Code requires all development phases approved through the CUP process to be completed within 3 years (TDC 18.330.020.D). Many developments approved through a CUP, especially schools, places of worship, and other insriturions, may have trouble funding and constructing such projects within the 3 year time period. Past practice has been to informally extend the time period for these CUPs at the staff level with direcrives from supervisors. These extensions were documented by letter, notes in the permit tracking system, e-mail, or post-it; therefore the same pracuce will be followed for the MET permit. This memo to the file documents the extension. Staff will seek code revisions to remedy the conflict between current code and funding/construcrion realiries for insriturional uses. Ron menrioned the risk of citizen appeal to the Land Use Board of Appeals if MET proceeds because there may be new residents near the site since the CUP was approved, and it is well past the 3 year limitation set by code. The one way to avoid such an appeal is to apply and obtain a new CLP prior to building permits. MET representarives and consultants have discussed the issue and will assume the risk of appeal. To notify neighbors of the construcrion and address community questions or concerns, MET will hold a neighborhood meeting prior to obtaining building permits. In addirion, MET consultants will be submitting plans to the City Planning Division to ensure compliance with the 2002 CUP. I have provided my full contact details below. We own a condominium just down the street, which my sister lives in. My sister is a school teacher. I am concerned about the implications of increasing the size of the structure from 28,000 square feet to 33,000 square feet, which is an 18% increase in size. Scholl's Ferry road is already a busy road, and this building will likely increase the traffic in the area. As you know, increased traffic often results in decreased safety, hence, allowing the building to be 18% larger than originally approved, would likely allow for 18% more traffic than originally planned, and potentially reduce traffic safety. Secondly, the implication of an 18% larger building could imply the need for 18% more parking area, does the lot provide for an increase in the parking areas? The area currently has limited parking, hence, a larger building would seem to further stress the available parking areas. I understand that the plan attached to the 2002 Final Order included a 33,000 square foot structure, but the actual 2002 Final Order narrative only referenced a 28,000 square foot structure. It would seem that most involved in the review at the time would have focused on the narrative, and not the specific drawing of the plan, hence, it would seem that the actual approval was for a 28,000 square foot structure, and not a 33,000 square foot structure. Allowing for an 18% increase in building size does not seem appropriate given that almost 10 years has elapsed since the original approval. A full review of the area, and changes in the area should be required if an 18% larger structure will be built. When we went through the initial CUP, we allowed the MET to utilize that fence towards their screening requirements because there was no objection from the previous owner. The MET maintains that they do not permit their kids to climb the fence, and that the kids are supervised during recess, and that there are cameras on the common area that can be reviewed from the office,so while they are willing to work with the homeowners association to resolve the issue,the fence belongs to the condominium association and they would have to approve and fund any repairs the MET was to make to the fence. • � ►�...,��.,.�,:�. I live in the condominium complex next door in Springwood Village. Being a parent and now a grandparent, my concern is the safety of the children. There is a fence separating the school and the condo complex. The children consistently climb the fence and have caused it to become broken and in disrepair. The disrepair is a huge safety hazard. If this is not repaired and monitored thereafter, a child is going to catch their foot in the tear and be seriously hurt with a broken limb or more seriously by falling on their head and sustaining a head injury. I think the school needs to repai�the fence and they need adult supervision when the children are outside to keep the children off of the fence befo�e something ter�ible happens. Thank you. This method of estimating school generated trips is consistent with the manner in which traffic studies are conducted consistent with the Institute of Transportation Engineers (ITE) and required by the City of Tigard when preparing a traffic study. I have personally reviewed dozens of traffic studies for schools throughout my career, and in every case the trip projections have been based on the number of students projected to attend the school as opposed to building size. The 33,000 square feet for the facility corresponds to the requirement of 300 students based on average standard floor area requirement of I10 square feet per student. I have provided my full contact details below. We own a condominium just down the street, which my sister lives in. My sister is a school teacher. I am concerned about the implications of increasing the size of the structure from 28,000 square feet to 33,000 square feet, which is an 18% increase in size. Scholl's Ferry road is already a busy road, and this building will likely increase the traffic in the area. As you know, increased traffic often results in decreased safety, hence, allowing the building to be 18% larger than originally approved, would likely allow for 18% more traffic than originally planned, and potentially reduce traffic safety. Secondly, the implication of an 18% larger building could imply the need for 18%more parking area, does the lot provide for an increase in the parking areas? The area currently has limited parking,hence, a larger building would seem to further stress the available parking areas. I understand that the plan attached to the 2002 Final Order included a 33,000 square foot structure, but the actua12002 Final Order narrative only referenced a 28,000 square foot structure. It would seem that most i � _ � involved in the review at the time would have focused on the narrative, and not the specific drawing of the plan, hence, it would seem that the actual approval was for a 28,000 square foot structure, and not a 33,000 square foot structure. Allowing for an 18% increase in building size does not seem appropriate given that almost 10 years has elapsed since the original approval. A full review of the area, and changes in the area should be required if an 18% larger structure will be built. Cheryl Caines Associate Planner City of Tigard (503) 718-2437 Hi Cheryl, In speaking with the folks at MET,the fence belongs to the condominium association, and she is most likely discussing the location where a tree branch fell from one of their trees and damaged the fence.There is a gate in the fence that was at one point left open so that kids from the previous apartments would be allowed to come over to the MET and play on the playground,or pick fruit from some of the trees, but they were advised to lock the gate for liability reasons. When we went through the initial CUP,we allowed the MET to utilize that fence towards their screening requirements because there was no objection from the previous owner. I live in the condominium complex next door in Springwood Village. Being a parent and now a grandparent, my concern is the safety of the children. There is a fence separating the school and the condo complex. The children consistently climb the fence and have caused it to become broken and in disrepair. The disrepair is a huge safety hazard. If this is not repaired and monitored thereafter, a child is going to catch their foot in the tear and be seriously hurt with a broken limb or more seriously by fatling on their head and sustaining a head injury. I think the school needs to repai�the fence and they need adu/t supervision when the children a�e outside to keep the children off of the fence before something terrible happens. Thank you. The difference between the 28,000 square foot structure approved and the proposed 33,000 square foot structure is 5,000 square feet of floor space. Traffic generation rates from schools are measured on a per student basis. The proposed maximum number of students is 300, and that number has not changed. The size of the proposed building supports that number of students. Should a significant increase in building square footage sufficient to support a larger student population be proposed,the applicant would be subjed to another land use action. Future land use action may or may not require an updated analysis. It depends on the size of any future proposed use. For the number of students proposed in the current application, there is no further analysis required regardingtraffic impact. There are a couple of things to keep in mind regarding traffic from the proposed school on the site: • The trip generation rate per student is derived from a series of studies that result in a best-fit line for use nationwide.This line has points above and below it, so we use what the line produces as the average to use in similar situations. There may be deviations in the traffic produced (in fact, we expect them) depending upon the specific development, but we use the rate that produces a result we can reasonably expect for a proposed project. In short,the 300 is not a magic number above which the traffic generated would create any issues. • The intersection of the driveway with Scholls Ferry Road was signalized as a result of the original land use action. This signalization, with dedicated left-turn lane from Scholls Ferry Road, produced residual capacity, which can support whatever can be put on the property. It would take a much larger project covering a much larger area to create a need for an updated traffic analysis for ingress and egress.
