The business would be limited to no more than 528 square feet of the existing structure and not more than one non - resident employee /volunteer. Sales would be limited to online distribution or by appointment only. No more than six daily visitors would be allowed, and not between the hours of 10pm and 8am. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. All Home Occupation standards discussed in this decision, and detailed in the Tigard Development Code Chapter 18.742, must be complied with at all times. SECTION III. PUBLIC COMMENTS RECEIVED The city mailed notice to property owners within 500 feet of the subject site, providing them an opportunity to comment. The city received five written responses and one phone call, all opposing the project. Vonda Marie Purdy Myers and John F. Myers sent an email opposing the project as they were concerned about parki impacts as a result of up to "seven extra cars every day around the corner from us and parking is already a problem in our area ". Gayle Allen sent an email opposing the project on two grounds. First, she is opposed to a commercial business in a residential area. Second, she is opposed on the basis of traffic and parking impacts. She stated that the owners of the property "already [have] two extra cars that park on the street which block the views of the traffic at the intersection on the hill." Marline Fresen wrote a letter and called staff to communicate her opposition to the project. She opposes the location of a business in a residential area. Ardene M. Hatfield submitted two emails opposing the project, stating that cars parked on either side of the street will reduce visibility and force traffic to adopt flow similar to a one -way street. As stated above, opposition to the project was based on one of three issues: the appropriateness of a business in a residential zone, traffic impacts and parking impacts. Staff has examined all three issues in Section IV below, and found the project to be in compliance with relevant approval criteria and standards. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS As set forth in Table 18.510.1 of the Tigard Development Code, home occupations are an allowed land use in all residential zones, subject to the approval standards and criteria contained in Chapter 18.742 (Home Occupations). Section 18.742.040 states that all home occupations except those that have proven non- conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050A.2: 18.742.040.A "1. Home occupations may be undertaken only by the principal occupant(s) of a residential property." The proposed Home Occupation is being undertaken by one of the property owners (Erma Garrison), who is a principal occupant of the property. This criterion is satisfied. "2. There shall be no more than three deliveries per week to the residence by suppliers." The application states there will be no more than three deliveries per week. This criterion is satisfied. "3. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the TDC Chapter 18.725, Environmental Performance Standards." No offensive noise, vibration, smoke, dust, odors, etc. are anticipated based on the proposed Home Occupation business since it will be conducted indoors and involves no manufacturing or assembly. All proposed activities will take place within the residence. No deliveries or customer visits will occur between 10pm and 8am. This criterion is satisfied. HOP2012 -00006 GARRISON HOME OCCUPATION PAGE 2 OF 6 "4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and /or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes." The application states that the business will be conducted primarily within the garage of her home. Washington County Assessor's records show this property containing 1,836 square feet of living space and a 484 square foot garage. Accordin to the written project description proposed by the applicant, the total area devoted to Blue Castle Children s Books will not exceed 528 square feet, or approximately 23% of the combined floor area of the house and garage. This criterion is satisfied. "5. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.144 of this title." No changes to the use classification of the dwelling are proposed. This criterion is not applicable. "6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates." There are no other Home Occupations approved or requested for this site, therefore, this criterion is not applicable. "7. There shall be no storage and /or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and /or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and /or flammable materials associated with the use." On March 26, 2012, Tualatin Valley Fire and Rescue provided oral comments stating no concern regarding the storage and distribution of books from a single family home. This criterion is satisfied. "8. No home occupation shall require any on or off - street parking other than that normally required for a residence." The project will not require any additional parking than is already provided for this single - family detached residential land use. Two off -street parking spaces will remain available. Table 18.765.2 of the Tigard Development Code requires a minimum of one off -street parking space per single - family attached home, no maximum is established. The property contains an existing two -car driveway (approximately 18 feet wide and 30 feet deep) that will continue to remain available for on and off -street parking by the occupants, employee /volunteer and visitors. On -street parking is presently available. The project site is located at the northeast corner of Millen Drive and Copper Creek Drive. City GIS data and "as- built" plans on file with the city (Copper Creek Stage 3) show both Millen Drive and Copper Creek Drive to have 50' right of ways, with 34 feet of pavement curb - to- curb. This width exceeds that required by their functional designations as a Neighborhood Route (Millen Drive) and Local Street (Copper Creek Drive), both of which allow parking on both sides of the street and two lanes of travel within 32 feet of pavement between curbs. The roadway was designed to allow on -street parking, and as a deep corner lot there is approximately 130 feet of adjoining linear parking area on Copper Creek Drive between the intersection and the next driveway. Two site visits by staff and a review of sixteen (16) aerial photographs taken between 1996 and 2011 indicate a very low utilization of on -street parking in the neighborhood. HOP2012 -00006 GARRISON HOME OCCUPATION PAGE 3 OF 6 With up to six appointments per day, and one employee, no more than seven (7) additional vehicles will be utilizing on or off - street parking in any one day. Existing residential parking facilities can provide the necessary parking. This cnterion is satisfied. "9. The following uses are not allowed as home occupations: a. Auto -body repair and painting. b. Ongoing mechanical repair conducted outside of an entirely enclosed building. c. Junk and salvage operations. d. Storage and /or sale of fireworks." The proposed Home Occupation does not involve any of the above land uses. This criterion is met. "10. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three- quarters ton GVW which may be parked outside of a structure or screened area." The applicant has not proposed exterior storage or a commercially licensed vehicle. This criterion is not applicable. 18.142.050.2 In addition to the general approval criteria, Type -II home occupations allow the following according to the TCDC Chapter 18.142.050: "a. One non - illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window;" The application states there will not be a sign posted on the building or in the window, per the requirements of the Homeowners Association. This criterion is satisfied. "b. No more than one outside volunteer or employee who is not a principal resident of the premises;" The application states that one employee or volunteer may be present. This criterion is satisfied. "c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on- street parking;" The application states that no more than six daily customers or clients will visit per day, by appointment only, and not between the hours of 10pm and 8am. With a limit of six appointments per day, and one employee, no more than 14 additional car trips will be generated. Staff finds this to be a less than significant increase in trip generation, and not excessive. As previously discussed above, adjoining roadways were built to standards that exceed present day requirements for travel land widths and on- street parking, with sufficient on and off - street capacity to accommodate daily parking needs. As a result, staff does not anticipate a monopolization of existing parsing or excessive traffic impacts resulting from the presence of cars parked on the street. This criterion is satisfied. "d. Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback." There will be no outdoor storage of materials associated with the home occupation. This criterion is satisfied. SECTION V. OTHER STAFF COMMENTS HOP2012 -00006 GARRISON HOME OCCUPATION PAGE 4 OF 6 The Tigard Building and Development Engineering Divisions had no comments on the proposal. SECTION VI. AGENCY COMMENTS Tualatin Valley Fire and Rescue stated they had no concern regarding the storage and distribution of books from a single family home. SECTION VII. I have named my business or venture Blue Castle Children's Books. I plan to have at least, (but no more than) three deliveries of children's books per week. My supplier will be Baker and Taylor. I have an open account with them at this time. The business in the exchange of children's books and related items will be conducted in the garage- showroom area within the dwelling. There will not be any noticeable offensive noise, smoke, dust, odors, heat or glare coming from or away from the business transactions. This proposed home business will be conducted entirely within the dwelling unit. I plan to have the majority of the product organized onto fixtures which I now have in the garage. These will be arranged in such a way to give space for browsing around the fixtures to shop the product easily. My plan for customers visiting my shop will be by appointment only. An additional public hearing shall be held by the City Council. APPLICATION SUBMITTAL PROCESS All APPLICATIONS MUST BE ACCEPTED BY A PLANNING DIVISION STAFF MEMBER of the Community Development Department at Tigard City Hall offices. PLEASE NOTE: Applications submitted by mail or dropped off at the counter without Planning Division acceptance may be returned. The Planning counter closes at 5:00 PM. Maps submitted with an application shall be folded IN ADVANCE to 8 x 11 ". One, 81/2" x 11" map of a proposed project shall be submitted for attachment to the staff report or administrative decision. Applications with unfolded maps shall not be accepted. The Planning Division and Engineering Department will perform a preliminary review of the application and will determine whether an application is complete within 30 days of the counter submittal. Staff will notify the applicant if additional information or additional copies of the submitted materials are required. The administrative decision or public hearing will typically occur approximately 45 to 60 days after an application is accepted as being complete by the Planning Division. Applications involving difficult or protracted issues or requiring review by other jurisdictions may take additional time to review. Written recommendations from the Planning staff are issued seven (7) days prior to the public hearing. A 10 -day public appeal period follows all land use decisions. An appeal on this matter would be heard by the Tigard City Council. A basic flow chart which illustrates the review process is available from the Planning Division upon request. Land use applications requiring a public hearing must have notice posted on -site by the applicant no less than 10 days prior to the public hearing. I have named my business or venture, Blue Castle Children's Books. I plan to have at least, but no more than three deliveries of children's books per week. My supplier will be Baker and Taylor. I have an open account with them at this time. The business of exchanging children's books and related items will be conducted in the garage- showroom area within the dwelling. There will not be any noticeable offensive noise, smoke, dust, odors, heat or glare coming from or away from the business transactions. The impact shall not effect the development on public facilities and services. Nor shall it effect the transportation system, including bikeways, the drainage system, the parks system, the water system, the sewer system, or the noise impacts of the development. For each public facility system and type of impact it will meet City standards, minimize the impact of the development of the public at large, public facilities systems, and affected private property users. The Community Development Code requires the dedication of real property interests and shall specifically concur with the dedication requirements, or provide evidence which support the conclusion that the real property dedication requirement is roughly proportional to the projected impacts of the development. The residential zone, R -7PD allows me, (the owner) to have a home occupation permit 2. There will not be a sign posted with the business name on it, per the requirements of the Home Owner's Association. This proposed home business will be conducted entirely within the dwelling unit. No more than 528 square feet will be devoted to the operation of my business. I plan to have the majority of the product organized onto fixtures which I have now in the garage. These will be arranged in such a way to give space for browsing around the fixtures to shop the product easily. I plan to have a definite flow in the arrangement to clearly reflect age group and type of books being shopped. For example: a book case may contain Baby Board Books 4 shelving may contain Children's Picture Books 4 Learn to Read-4 Early Chapter Books etc. Any possible product overflow will be organized into clear storage containers kept under tables displaying product or placed against the wall behind the main checkout counter. All of the customer parking is available on the Copper Creek side of the street which is on the same side of the proposed business property. I want to have a walkway from the sidewalk side of Copper Creek adjacent to the door on the side of the garage. This would make planned book deliveries more accessible. With the help of my family we would like to remove a portion of the fence, that is in poor shape anyway, to make the walkway even more visible from the sidewalk. In my eleven years working for Borders Books I got to know a lot of customers by name and enjoyed helping them find great books for themselves and their children. I believe every community needs a bookstore to be vital, educated and relevant My bookstore will be a children's bookshop focused on supporting the schools and libraries educationally in this community, as well as support the business economy in this area. In a time when more and more people are becoming translated into numbers or data; when people are dealing predominantly with automation and technology; I want to allow my business to contribute to the community in a personal way as well as support the community by giving back. There shall be no more than three deliveries per week to the residence by suppliers. 3. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. 5. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit. Any accessory building that is used must meet State Building Code requirements. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates. 7. There shall be no storage and /or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants, and /or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and /or flammable materials associated with the use. 8. No home occupation shall require any on or off - street parking other than that normally required for a residence. 9. The following uses are not allowed as home occupations: a. Auto -body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely - enclosed building, c. Junk and salvage operations; d. Storage and /or sale of fireworks. 10. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of notmore than three - quarters ton gross vehicleweight (GVW)may be parked outside of a structure or screened area. The Copper Creek neighborhood is trying hard to keep a certain standard and more cars, congestion and commercial businesses in the neighborhood simply shouldn't be allowed to start. Next, the city will grant a motorcycle repair shop in another garage because the owner "promises to keep the garage door down ". Neighborhoods are for living comfortably without commercial business issues. The owner should rent a space /storage. Please reject their request.
