APPLICATION SUMMARY FILE NAME: Triangle Point, LLC CASE NO.: Minor Modification (MMD) MMD2011 -00018 PROPOSAL: The proposed minor modifications to an existing site plan would allow the installation of a new backup generator, the installation of fencing and gates to secure 7 existing parking spaces, and the addition of rooftop mounted communications equipment. ZONING DESIGNATION: MUE: Mixed Use Employment. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed -use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I -5. This zoning district permits a wide range of uses including major retail goods and services, business /professional offices, civic uses and housing. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.520, 18.620, 18.745 & 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. MMD2011 -00018 Triangle Point, LLC Page 1 of 5 SECTION III. BACKGROUND INFORMATION Site Information: The project address is 13333 SW 68 Parkway in the Tigard Triangle. The 8.6 acre site is located at the southern terminus of 68 Parkway, and adjoins the intersection of Highway 217 and Interstate -5 to the west, east, and south. Office uses adjoin the property to the north. The site is developed with an existing 105,000 square foot office building and associated parking lot improvements. Until 2007 the building was occupied by Farmers Insurance. Recently updated, the building is now occupied by multiple tenants who continue to utilize the structure for office space. Proposal Description: The proposed project is to construct new offices for Clear Channel Communications on floors 3 and 4 of the building, and related exterior improvements necessary to support 24 -hour radio station operations. Interior modifications will occur in areas previously devoted to office space, and will not result in an increase in floor area. Exterior modifications proposed are to include the following: ➢ Installation of a new backup generator to be located on the western side of the building, adjacent to an existing generator and in an area currently devoted to lawn. Screening of the new generator would occur through the installation of slatted chain -link fencing. The new fencing is proposed to match existing fencing on site. ➢ New fencing and gates to secure seven (7) parking stalls along the western boundary of the site. The fencing is necessary to protect radio station vehicles carrying electronic and communications equipment. ➢ New roof -top mechanical and communications equipment. These will include approximately three small condensing units in the center of the roof; one 3.8 meter satellite dish and two 1.2 meter satellite dishes on the southerly portion of the roof; a series of smaller microwave antennae and dishes on the northerly portion of the roof; and a cable penetration housing to be located on the center of the roof. The application also noted an intention for new signage, but that approval will be requested under a separate sign permit. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states a Minor Modification shall be approved, approved with conditions, or denied following the Director's review based on the following findings: 1. The proposed development is in compliance with all applicable requirements of this title. The project conforms with all applicable requirements pertaining to off -street parking, permitted land uses, and development standards within the MUE zoning district and Tigard Triangle Plan Area. Landscaping and screening standards apply to this project. Screening of the new generator is required per TDC subsection 18.745.050.E.2, and the applicant has proposed doing so with a slatted chain -link "to match the existing screen fencing immediately adjacent to the proposed generator location." On January 13, 2012 the applicant submitted a revised plansheet for MMD2011 -00018 Triangle Point, LLC Page 2 of 5 Attachment "C" of the application. This revised plan indicates the height of the generator, with fuel tank, will be 7' -7" in height. The accompanying email states that the surrounding slatted - fencing will be 8 feet in height. With the slatted fencing -five inches higher than the generator, the generator will be fully screened from view. A condition of approval has been added to ensure the height specified in the narrative is reflected on construction drawings. The Tigard Triangle Design Standards also apply to this project. Subsection 18.620.040.A.6 requires roof -top mounted equipment to be screened from view and /or set back or positioned to minimize exposure to adjacent public streets. The project complies with this standard through the use of setbacks and existing parapet walls to the extent practicable as shown in Attachments "F ", "G" and "H" of the application. Wireless Communication Facilities standards also apply to this project. Subsection 18.798.040.B permits antennas on existing commercial structures so long as they are not more than 20 feet higher than the existing structure, there are no more than three providers, and the color blends with the existing structure and surroundings. Sheets A5.2 and A5.3 demonstrate antennae that will not be 20 feet higher than the existing structure. All of the antennae will be controlled by a single provider (Clear Channel). The color of the antennae will blend with the building and will be mounted in locations with minimal visibility from the ground and adjacent roadways. During the course of application review, Tualatin Valley Fire & Rescue discovered a Fire Code violation in the vicinity of the existing and proposed backup generators. This violation was in the form of a designated smoking area with a shelter, benches, and cigarette urns too close to existing and proposed fuel storage. As an interim measure that will immediately abate the hazard, the property owner has submitted a site plan that relocates the smoking area to a point northerly of the main entrance. Pursuant to a letter submitted by the property manager, the interim smoking area will become effective on January 12, 2012. In addition, the property owner has agreed to make a separate land use application to approve a permanent location. A condition of approval has been added to ensure the new location of the smoking area complies with all applicable standards. Therefore, this criterion is met. 2. The modification is not a major modification. Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed: 1. An increase in dwelling unit density, or lot coverage for residential development; There are no dwelling units on the property. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on -site parking in accordance with Chapter 18.765. The proposal does not require additional on -site parking, nor will it result in a change or expansion of use. The building was constructed for office uses in 1968, and utilized as such until 2007. The new tenant will continue the office use after interior tenant improvements are completed within existing interior floor space. No increase in parking demand is anticipated from the new tenant. Seven existing parking spaces are being secured by fencing, but these spaces will be MMD2011 -00018 Triangle Point, LLC Page 3 of 5 utilized by equipment vans that will be parking on the site with or without the fencing. These spaces will remain part of the required parking. • Therefore, this criterion does not apply. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There are no proposed changes in the type of structures, and the affected square footage will continue its historical use as office space. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20 %; There is no proposed change in building height as the rooftop antennae and equipment is exempt from building height regulations per subsection 18.730.020.A of the Tigard Development Code. Therefore, this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off - site traffic would be affected; The proposal does not change the type or location of access ways or parking areas where off -site traffic would be affected. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; As there is no change in use, the proposal does not increase vehicular traffic to and from the site by 100 vehicles per day. Therefore, this criterion does not apply. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The proposed project would not result in an expansion of floor area. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common space and /or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10 %; The project site is not subject to a minimum open space requirement. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; b. Screening; and /or c. Landscaping provisions. The proposal would not affect recreational facilities or screening, as a result these criterion do not apply. Construction of the new backup generator would result in a loss of approximately 126 square feet of lawn, less than 1% of the existing landscaping area and not less than the 15% of existing landscaping according to the application materials. A modification to the conditions imposed at the time of site development review approval which are not the subject of B 1 through 10 above of this subsection. Staff has reviewed the history of this site and found four previous land use actions applicable to the subject property. The conditions relate to trees, streets, and sidewalk improvements. The proposed project would not modify any of these conditions. Therefore, this criterion does not apply. FINDING: Based on the analysis above, staff finds that as conditioned below, the criteria for minor modification of a site development have been met. CONDITIONS: 1. Prior to issuance of building permits, the applicant shall submit building plans that specify eight -foot high slatted fencing around the proposed backup generator. 2. Prior to final building inspection, the applicant shall obtain all necessary land use approvals for a permanent designated smoking area for the occupants of the building. 3. The applicant shall obtain all necessary sign permits. SECTION V. The primary scope of the project consists of interior modifications to the third and fourth floors of a commercial office building. The space will be used for administrative offices and radio broadcast facility for Clear Channel Communications. In support of this operation, a number of minor modifications to the exterior of the building will be necessary and/or desirable. The proposed changes listed below are described in greater detail later in this narrative and in the attachments. Proposed changes include: • New back -up generator • New fencing to secure seven (7) existing parking spaces • New roof - mounted mechanical equipment • New roof - mounted wireless communication devices — antennas, satellite dishes and microwave dishes • New enclosure for cable penetrations of the roof • New tenant signage on the face of the building Evaluation Criteria per Section 18.360.050(B) 1. Dwelling Unit Density: The proposed modifications are to an existing commercial office building, not a residential development. There is no dwelling unit density. 2. Dwelling Unit Ratio: The proposed modifications are to an existing commercial office building, not a residential development. There is no dwelling unit ratio. 3. On -Site Parking: There are no proposed changes that would require additional on -site parking. 4. Height of Building: While some communication devices will extend a bit higher than the parapets, maybe 8 to 10 feet, there is no proposed increase in height of the building. 6. Off-Site Traffic: There is no proposed change in type and location of accessways and parking areas that would affect off -site traffic. 7. Vehicular Traffic Volume: This project will not increase the vehicular traffic to and from the site. 8. Floor Area: There is no proposed increase in floor area. 9. Common Open Space: The space for the new generator is the only proposed reduction in the area reserved for common open space. The generator will not reduce the open space area below the required minimum, nor will it reduce the open space by more than 10 %. 10. Project Amenities: The addition of the back -up generator will have a very minor impact on landscaping. The slight reduction in lawn area is less than 1% of the total landscaping, and will not reduce the open space area below the minimum required by the code. New Back -Up Generator Uninterrupted power is essential for a broadcast facility. We proposed to install a 100 to 200 KVA diesel - powered generator at the west corner of the building. See Narrative Attachment A, Site Plan and large format sheet S1.1. The generator will be housed in a weather enclosure approximately 11' -3" long by 4' -0" deep by 6' -9" tall. The generator will be screened by a slatted chain link fence to match the existing screen fencing immediately adjacent to the proposed generator location. Exhibit B shows photos of the existing nearby generator enclosure and Exhibit C shows a typical generator weather enclosure. There is no separate fuel storage tank. Fuel is stored in a double- contained tank in the base of the unit. New Fencing at Secured Parking Area Station vehicles require a secure parking area due to the electronic and communications equipment that they carry. We propose to enclose seven (7) existing parking spaces with 6 -foot high slatted chain link fencing and gates to match the existing screen fencing nearby. Exhibit E is the proposed layout of the existing fourth floor. No increase is proposed in the floor area of the building. Existing F is the proposed layout of new roof - mounted equipment. New Roof - Mounted Mechanical Equipment Additional cooling above the current building capacity is necessary due to the specialized electronic equipment and 24 -hour operation of radio broadcasting. Three (3) small condensing units will be located close to the center of the fourth floor roof as shown in Exhibits F, G and H. These units are 4' -5" tall and should not be visible from the ground from anywhere on the site. Exhibit I is a manufacturer's cut sheet of the unit. New Roof Top Communication Equipment One 3.8 meter satellite dish and two 1.2 meter satellite dishes will be mounted on new ballasted steel frames at the south end of the third floor roof. The existing parapet will screen the 1.2 meter dishes. The 3.8 meter dish may be partially visible, but only from an extreme distance. See Exhibits F, G and H. Exhibit J is a manufacturer's cut sheet of the 3.8 M dish. Exhibit K is a cut sheet of the ballasted steel mounting frame that will support the satellite dishes. Antennas and microwave dishes will be pole- mounted on the machine room wall, the highest portion of the building, as shown in Exhibits F, G and H. Exhibits L and M are cut sheets of the microwave dish and antennas. Cabling from the dishes and antennas to the rack room on the fourth floor will penetrate the roof through an enclosure as shown in Exhibit N. New Tenant Signage on Building As a major tenant in the building, the Clear Channel name will be displayed near the top of the end wall of the stair tower of the east - facing wing and the south - facing wing. Photos of the building and proposed sign locations are shown in Exhibit O. A local sign contractor will submit the required documents for a sign permit at a later date. The only impact to landscaping will be the addition of the back -up generator which will cover a small portion of the existing lawn at the northwest corner of the building. All other landscaping will remain as is. Neighboring Properties We have learned that it sometimes helps to have a sense of the neighborhood that surrounds the subject property when evaluating proposed changes. The surrounding neighborhood consists of freeways and office parks. Exhibit R contains photos from the roof of the building looking north, east, south, west and east/southeast. North of the Triangle Point property is occupied by additional office buildings. Interstate 5 runs along the east side. Oregon Highway 217 borders the west and south sides of the property. Kruse Way extends off to the southeast. Existing Covenants and Restrictions There are no existing covenants and restrictions on the property and none are proposed with this project. Conclusion The City of Tigard in general, and the Triangle Point building will benefit from the addition of Clear Channel as a tenant at this location. The proposed use is in keeping with the area, and the proposed visual impacts to the building and site are very minor. The Clear Channel application process will be more streamlined with the landlord making a separate submittal on the proposed permanent location for the smokers' area. Regarding the height of the fence to screen the generator: Just checked with our electrical engineer. He finished compiling the total service load for the back -up generator and is waiting for final confirmation from the manufacturer on the total actual size. He pointed out to me that the height we submitted (6' -9 ") failed to take into account the fuel tank which is below the engine. It could add as much as 12 inches to the height, making the overall dimension 7' -9 ". We can set the fence height at 8' -0" or the height of the generator enclosure whichever is greater. Will that suffice for now or will we need to resubmit our drawing? Is there anything else we need to do on this end to get an official approval from your department? We are nearing completion on our package to go for plan review in the building department. We're looking to get that submitted next week if at all possible. Again, thanks for all your help. Specifically that the Seattle area was within the 25' distance of the existing and proposed fuel storage for the Sacramento building generators. Although the fuel storage for the existing generator is on the far Irvine side of the enclosure and 25' away from the covered "smoker's" canopy, the smokers congregate well within the 25' distance when standing outside of the canopy. We agree this is unacceptable and are currently moving the smoker's area (will be completed by 1/12) to an alternate location. This location is shown on the attached plan. We will execute this move by moving the seating and smoker's urns to the temporary location and provide signage closing the current location to smokers and directing them to the temporary area. We plan on relocating the current canopy to a location farther away from the current and proposed transformers to make a more permanent smoker's area. We will determine this location and apply for a permit for the new location separately from Clear Channel's application. Thank you for bringing up this issue to us. I hope that this proposed plan is acceptable to the City of Tigard. Submit a revised site plan that moves the designated smoking area at least 25 feet from both the proposed and existing backup generators, and associated fuel storage tanks. The revised plans must include any shelters associated with the smoking area. Or 2. Submit a revised site plan that omits the backup generator from proposal, and resubmit for this improvement in a separate application. The Fire Code prohibits smoking within 25' of flammable fuel storage — the area adjacent to the emergency generator and fuel storage is currently being used as a smoking area even though there are No Smoking signs are posted there — please see attached picture. Please enforce the no smoking prohibition and relocate your smoking area a safe distance away from the emergency generator and the fuel storage.
