The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Engineer's designee has APPROVED the above request. BACKGROUND INFORMATION Site Information and Proposai Description: The Capital Facilities Division of the City of Tigard is requesting approval to replace an existing sewer line with a new line. The line would be constructed across Derry Dale Creek near SW 110th Ave. The work consists of the excavation of approximately twenty-nine cubic yards. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: The Tigard Community Development Code (TDC), Sensitive Lands Review Section, states that, "The City Engineer shall review the installation of public support facilities such as underground utilities and construction of roadway improvements including sidewalks, curbs, streetlights, and driveway aprons by means of a type I procedure, as governed by Section 18.390.030 subject to compliance with all of the standards in this chapter." The City is replacing a sewer line that is damaged within a drainageway. All applicable permits from CWS and the USACOE have been obtained. DRAINAGE WAY The extent and nature of the proposed land form alteration or development will not create site disturbances to the extent greater than that required for the use. There will be no change of use. Disturbance will be limited to that required to install the sewer. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The work will be subject to an erosion control plan and will be inspected. In addition, a Nationwide Permit in compliance with Section 404 of the Clean Water Act regulates erosion and sediment control. The water flow capacity of the drainage way is not decreased. The flow characteristics of the drainage way will not be altered. Restoration will be accomplished in accordance with the Corps of Engineers Permit. The drainage way will be replaced by a public facility of adequate size to accommodate maximum flow in accordance with the adopted 1981 Master Drainage Plan. The drainage way will remain in place and unaltered. The necessary U.S. Army Corps of Engineers and State of Oregon Land Board, Division of State Lands approvals shall be obtained. The USACOE permit has been obtained and is attached to this application. Where land form alterations and/or development are allowed within and adjacent to the 100-year floodplain, the City shall require the consideration of dedication of sufficient open land area within and adjacent to the floodplain in accordance with the Comprehensive Plan. The land form alteration is not adjacent to the 100-year floodplain. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was mailed to the applicant and owners. Final Decision: This is a Type I Sensitive Lands Review. As such, the Engineer's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL ON MAY 20, 2003 AND BECOMES EFFECTIVE ON MAY 21, 2003. Project Description: The purpose of the project is to replace a damaged by constructing a line across the creek and connecting it to existing manholes. The project is located in Section 3 of Township 2 South, Range l West, in Tigard, Washington County, Oregon. This letter verifies that your project is authorized under the terms and limitations of Nationwide Pern�it No. 12 (utility line activities). Your activities must be conducted in accordance with the conditions found in Special Coc�ditions (Enclosure 2), General Conditions (Enclosure 3), and the following project specific conditions: ' a. Trenching will occur in the dry and during the ODFW recommended in-water work window for tributaries to the Tualatin River, July 1 -- Septcmber 30. Within the ordinary high water line, trenches will be backfilled with native material and capped with clean, rounded, uniformly-graded gravel with a size composition and depth as exists naturally. b. Standard best management practices for erosion control, including silt fences and straw bales, will be installed to prevent turbidity downstream of the project site. c. All damaged areas will be restored to pre-work conditions including restoration of original streambank (ines, and contours. d. All exposed soil surfaces, including construction access roads and associated staging areas, will be stabilized at finished grade. Stream banks will be stabilized with jute mat and bare ground will be seeded with native species, including spike bentgrass and American sloughgrass, immediately following the installation of the new sewer line. On cut slopes steeper than 1 :2, a tackified seed muich will be used so that the seed does not wash away before germination and rooting occurs. [n steep locations, a hydro-mulch will be applied at 1.S times the normal rate. -2- e. Sitka willow cuttings will be planted 2 feet on center along the stream with in the 15-foot wide easement. f. Any lazge woody debris disturbed during construction will be left on site in the wetland area as woody debris for wildlife habitat. The Qregon Department of Environmental Quality has provided their Certification Conditions (Enclosure 4). You must also comply with these conditions. We also direct your attention to the Special Condition m, (Enclosure 2), that requires the transfer of this permit if the property is sold and General Condition 14 that requires you to submit a signed certificate when the work is completed. A "Compliance Certification" is provided (Enclosure 5). Failure to comply with any of the listed conditions could result in the Corps initiating an enforcement action. This authorization does not obviate the need to obtain other permits where required. Permits, such as those required from the Oregon Division of State Lands (ODSL) under Oregon's Removal /Fill Law, must also bc obtained before work begins. Exceptions to these time periods requires specific approval from the Corps. On tribal lands the Corps will coordinate exceptions to the timing guidelines with the Environmental Protection Agency. (b) Upland Disposal: All excess material will be taken to a suitable upland location for disposal. The material shall be placed in a location and manner that prevents its discharge into waterways or wetlands. (c)Heavy Equipment: Heavy equipment shall be operated from the bank and not placed in the stream unless specifically authorized by the District Engineer. (d)Fish Screening: Fish Screening will comply with standards approved by the National Marine Fisheries Service or the Oregon Department of Fish & Wildlife,as appropriate. (e) Cultural Resources& Human Burials: If at any time, during the conduct of the work authorized, the permittee or agent(s)discovers human burials, cultural resources,or historic properties, as identified by the National Historic Preservation Act, that may be affected, they must notify the District Engineer. (n Fish Passage: Perrnittee shall insure activities authorized by nationwide permit will not restrict passage of aquatic life. Activities such as the installation of culverts or diversion structures, or other modifications to channel morphology must be designed to be consistent with fish passage standards developed by the Oregon Department of Fish and Wildlife(ODFW) and the National Marine Fisheries Service(NMFS). This guidance can be found in the most recent edition of the document entitled "ODFW standards and Criteria for Stream Road Crossings". The streambed shall be returned to pre-construction contours after construction unless the purpose of the activity is to elirninate a fish barrier. (g) Riparian Vegetation Protection & Restoration: When working in waters of the C7nited States or riparian areas the construction boundary shall be minimized to the maximum extent practicable. Permittee shall mark and cicarly define the construction boundary before beginning work. Native riparian vegetation will be successfully established along tributaries where the vegetation was removed by construction. The plantings shall start at the ordinary high water mark and extend 10 feet back from the top of the bank. The plantings must be completed by the end of the first planting season following the disturbance. (h) Erosion Controls: fldequate erosion control devices shall be installed and maintained in good working order throughout construction to prevent tlie unauthorized discharge of material into a wetland or tributary. The devices shall be installed to maximize their effectiveness, i.e. sediment fences st�all generally be buried or similarly secured. These eontrols shall be maintained until permanent erosion controls are in-place. F,ncl. 2 (i) Maps and drawings: In addition to the ite►ns required in nationwide permit general condition 13, all preconstruction notifications shall contain maps showing the project location as well as plan-view and cross- sectional drawings showing the proposed work. The map(s) shall be of a scale and detail to clearty identify the project location(s). Drawings shall be sufficient in number and detail to accurately portray the project. (j) Bank Protection: Riprap shall be clean, durable, angular rock. The use of other materials such as broken concrete, asphalt, tires, wire, steel posts or similar materials is not authorized. The project design shall minimize the placement of rock and maximize the use of vegetation and organic material such as root wads to the exten[practicable. Riparian plantings s}�all be included in all project designs unless the permittee can demonstrate they are not practicable. The permittee must notify the District Engineer in accordance wiih nationwide permit general condition #13 if the activity involves the placement of more than 10 cubic yards of riprap per 100 linear feet of streambank. Prior to any�site clearing, grading or construction the vegetated corridor and water quality sensitive areas shall be surve�ed, staked, and temporarily fenced per approved plan. During construction the vegetated corridor shall remain fenced and undisturbed except as allowed by Section 3.02.4.b.4. and per approved plans. 5. Prior to any activity within the sensitive area, the applicant shall gain authorization for the project from the Oregon Division of State Lands (DSL)and US Army Corps of Engineers (USACE). The applicant shall provide the District with copies of all DSL and USACE project aufhorization permits. , 6. For vegetated corridors 50 feet wide or greater, the first 50 feet closest to the sensitive area shall be equal to or better than a "good"corridor condition as defined in Section 3.02.6, Table 3.2. (within the easement area--both temporary and permanent) 7 Enhancement/restoration of the vegetated corridor shall start by the 1�day of July 2002 and be completed by the 1�'day of October 2002. Clean Water Services shall be notified 72 hours prior to the start and completion of enhancemenUrestoration actrvities. Enhancement/restoration activities shall comply with the guidelines provided in Appendix E: Landscape Requirements (R&0 007:Appendix E). 8• Prior to any site clearing, grading or construction, the applicant shall provide the District with the required vegetated corridor enhancement/restoration plan. 9� Maintenance and monitoring requirements shall comply with Section 2.11.2 of R8,0 00-7.
