This acknowledges and confirms the status of inspections and approvals on the above two permits which relate to the conversion to habitable space of approximately 600 square feet on what was identified on the original construction plans (MST2003- 00403) as a third level "bracing floor" with no direct access from the exterior or either of the interior floors. I have attached a copy of our 8/23/06 inspection report for MST2006 -00220 for your files. Mr. & Mrs. Stong, congratulations and thank you for your cooperation in resolving most of the outstanding issues discussed in my previous letter of July 27th, 2006. Mr. & Mrs. Debien, welcome to Tigard. We hope you enjoy your new home. I apologize if this appears to be an unusual and unduly formal welcome letter but, because we have an open building permit, my intention is to make sure that everyone responsible for the property is fully apprised of the status of the building permits issued for work on the property and of what is required to complete that work and secure final inspection approval. Please understand that the City of Tigard considers that the new and former owners share the obligation to complete the conversion project, that we look to the former and new owners, jointly and /or severally, to secure final inspection approval on a timely basis and to refrain from use or occupancy of the conversion space until such final inspection approval is received, and that the City reserves the right to initiate further enforcement action against either or both the former and new owners if it deems such action to become necessary. BUP2006- 00392, covering the addition of a deck on that third level and the exterior stairs from grade to that level and the one above has now received final inspection approval and that permit has been case finalled. 12438 SW Aspen Ridge Dr., Tigard, /06, p. 2 of 3. Permit MST2006- 00220, covering conversion of the interior space, has passed the Framing, Mechanical Rough, and Mechanical Final inspections. (Electrical work was addressed separately under ELC2006 -00382 which received final inspection approval on 8/16/06.) Only the Insulation and Final Inspections remain to be passed and the sole remaining requirement is that R-25 insulation be installed under the floor in the newly converted third level and its presence verified by our inspection. When that insulation has been installed and has received inspection approval from our office we will be able to grant final inspection approval for the permit. Technically, with the change in ownership, permit MST2006 -00220 should be replaced with a new permit taken out by the new owner. We consider, however, that the public interest and the interests of the owners are better served by completing this work promptly than by our charging any additional fees for issuing a new permit. Accordingly, we will not retire MST2006 -00220 at this time but will allow the insulation installation and inspection to be completed under MST2006 -00220 so long as final inspection approval is granted by this office prior to close of business, Friday, September 30, 2006. Please note that, as discussed in my letter of July 27th, until final inspection approval has been received that third level space may not be used or occupied. Further, please note that this conversion establishes the subject residence as a three -story structure and that the crawl/storage space below this third level may not be similarly converted to habitable space under the Oregon Residential Specialty Code (ORSC). Any such conversion creating a fourth level or story would require that the entire building as well as the converted area be brought up to the (commercial construction) standards of the Oregon Structural Specialty Code (OSSC).
