Tiedeman Street, north of Fanno Creek (Wash. Co. Tax Map 181 34D, Tax Lot 5601) APPLICANT: Kingswood Development Company/Leon Jallo I . FINDINGS OF FACT: 1. The applicant is requesting permission to locate two duplexes " on two proposed lots of over 10, 000 square feet in a R-7 zone in accordance with Chapter 18. 72 (Conditional Use) of the Ti- gard Municipal Code , 2. The site is designated "Urban Low Density Residential" on the NP II , 1975 and zoned "R-7, Single Family Residential" . 3. The applicable policies of the NP II , 1975 are as' follows : "7, Within the low density residential area, duplexes will be allowed on lots less appropriate for single family homes to include locations at street intersections and as buffers between multi-family and single family areas. " 32. When land is developed and includes a designated bike route, easements should be granted to the City . In cases where development increases the need for the path , construc- tion should also be required. " 4 . Section 18.20, 120 of the Tigard Municipal Code allows duplexes in a R-7 zone on separate 10, 000 square foot lots as a condi- tional use upon a finding that the site is appropriate for the proposed use (18. 72 .010) . 5 . Tentative approval for the minor land partition as shown on the site plan is expected, 6. The flood plain elevation of Fanno Creek is 156 feet mean sea level . 7. The NP II designates S.W. Tiedeman a collector street , • . . - STAFF REPORT AGENDA 5 .7• TIGARD PLANNING COMMISSION May 3, 1977 - 7: 30 P.M. Page 2 . • 8 . The Tigard Area Comprehensive Pedestrian-Bicycle Pathway Plan adopted in March, 1974 designates a Class I pathway along Fanno Creek on this site. II . STAFF OBSERVATIONS : The original tax lot was a 1. 35 acre parcel , vacant and primarily in the Fanno Creek flood plain, which is overgrown with brush and trees . The site is bordered by two duplexes and Fanno Creek, with a single family residence across S .W , Tiedeman Street , Sewerage service is available to the site from a trunk line tran- secting the property, and water service is available from a ten inch main line in S .W. Tiedemat Street . S .W. Tiedeman is a substandard street in both improvement and right-of-way width. Although a ten foot dedication and L.I .D. • agreement will satisfy the requirements of NPO II , concern arises as to pedestrian traffic along S .W. Tiedeman Street . The place- ment of a sidewalk adjacent the relocated property line would cre- ate a safer section of passage for pedestrians , The NP II states that access to abutting properties is a secondary function of col- lectors, and, since no alternative access street exists, a loop or shared driveway would minimize the access problem with the pri- mary function of the collector street--that being to collect and distribute traffic between arterial and local streets . The flood plain portion of the site is unbuildable and included . ( in the greenway element of the Tigard Community Plan , 1971 and • NP IT , both of which encourage its retention as a natural area. This can best be achieved by dedication to the public for green- . way purposes . • The addition of two duplexes in this area increases the need for the pathway as encouraged in the pathway plan , but construction at this time is not necessary . Either an agreement to construct the path or a bond should be provided which would assure its con- . struction when Links are made to this property from adjacent ones, III . CONCLUSIONARY FINDINGS: The following findings can be found for approval of the request : 1. With the attachment of appropriate conditions, the proposal conforms to the NP II in that with duplexes on adjacent lots and being on a collector street the site is less appropriate 4 r STAFF REPORT AGENDA 5 .7 • TIGARD PLANNING COMMISSION • .May 3, 1977 - 7: 30 P.M. • Page 3 for single family residences and appropriate for duplexes on * ' 10,000 square foot lots. 2. The proposal is compatible with the adjacent uses, since it is of the same density and housing type . 3. Adequate water and sewerage facilities exist to serve the de- velopment as proposed, and adequate street facilities will be provided with the attachment of appropriate conditions. IV. STAFF RECOMMENDATION: Sased on the findings of fact and conclusionary findings, staff recommends approval with the following conditions : 1. Ten feet be dedicated along S .W. Tiedeman for street purposes prior to issuance of building permits, and a half street im- provement be provided within one year 2 2 . Either a shared loop driveway or a single common access point for both duplexes be utilized 0 3 Retention of the natural state of the flood plain portion of the site be assured by dedication to the public or the pro- vision of a greenway easement over its entirety. 4 . Eonding, construction or some other assurance acceptable to staff be accomplished for the placement of a pathway to City • standards along Fanno Creek. . , 1 .
