ROLL CALL Present: Commissioners Fletcher, Goslin, Nicoll, Severson, Whittaker, Woodard and Chairman Paterson: Fred Anderson, City Attorney: Keith Thompson, City Engineer: Ray Rangila, City Planner • Absent: commissioner Lewis III. APPROVAL OF MINUTES A. The minutes for the regular meeting of July 20, 1971 were approved as submitted. Tv. PUBLIC HEARING A. Zone Change (carried over from July 20, 1971) • WALLY JOHNSON, Applicant request for a change of zone classification from M-4, Industrial Park to P-D, Planned Development on a 1.23 acre parcel located on the southwest corner of S.W. Grant Avenue and S.W. Tigard Street (Map 2S1 2BA tax lot 800) . 1. Staff Recommendation a, The staff recommended approval. 2. Public Hearing a. Wally Johnson, applicant, testified it favor of the request. b. Mr. Johnson stated that Mr. Graves (the neighbor) was concerned only about the building setback from Tigard Street. c. Public Hearing was closed. Commission Discussion and Action a. Commissioner Whittaker asked what Mr. Graves reaction was if the building was not set back from the side property line. b. Mr. Johnson stated that Mr. Graves had no objections to the building being on the property line. (4r- co Commissioner Whittaker stated he felt that screening should be provided along the setback areas or that the building; should be allowed on the property line. d. Commissioner Fletcher asked if the building would be set back further or made larger if it were on the property line. e. Mr. Johnson stated that the building would be set back ,further and not enlarged. '. Commissioner Severson ~Mated concern for maintenance of the building if it were allowed on the property line. • g. It was moved (Nicoll) , seconded (Goslin) and passed by a unanimous vote of the Commission present to approve the zone change to P-D (with no setback from side property line) with the following provisions: 1. That a detailed tree planting and landscaping plan shall be provided as part of the general plan and program. 2. That utilities, drainage and driveway specifications shall be provided as part of the general plan and program. • 3. That uses other than allowed as out- right permitted uses within the M-4 District shall be reviewed and approved by the Planning Commission in order to preoerve the integrity of the Community Plan and Zoning Ordinance. 4. That the Planning Commission shall review the completed general plan. B. Variance (carried over from July 20, 1971) STAN WILEY INC. Walnut Street (Map 2S1 2BD tax lot 2101) 1,. Staff Recommendation a. The staff recommended approval with. conditions. 2 Public Hearing a. Mr. Mike Bartos represented Stan Wiley, Inc. b. The public hearing was closed. 3. Commission Discussion and Action a. Commissioner Goslin asked what control the City had if the landscaping were not maintained. b. The City Attorney stated that the zoning ordinance had no provisions for condi • c. The City Attorney stated that approving this request may set a precedent, as it appeared that the property owner created the noncomplying lot in disregard to minimum zoning requirements. do Commissioner Whittaker asked if the access is 40 feet. e. Mr. Bartos stated that the access being used now is approximately 30 feet wide. f. Mr. Bartos also stated that the applicants would like the 20 foot easement removed. g. Mr. Anderson advised the Planning Commission to delay making any decision until a title report, legal description and deed are available (pertaining to the existing easements) . h. It was moved (Goslin) , Seconded (Fletcher) and passed by unanimous vote of the Commission present to table the request until the next regular Planning Commission meeting. C. Conditional Use TIGARD MASONIC TEMPLE ASSOCIATION, Applicant A rquest for conditional use approval to allow a Masonic Temple on a 0-39 General Commercial parcel located on the east side at' S.W. Pacific Highway across from S.W. Watkins Avenue (Map al 200 tax lot 1100) . 1. Staff Recommendation a. The staff recommended approval with conditions. 2. Public Hearing a. Mr. . Jack Annand, 14600 S.W. Pacific Highway, represented the applicant. b. Mr. Annand asked that the fencing requirements in condition number 2 be eliminated. c. Public hearing was closed. 3 ) Commission Discussion and Action a. Chairman Paterson asked if the area behind the building would be open. b. Mr. Annand stated that the area behind the building would be a picnic area. .f c. Commissioner Goslin asked if the public would be allowed to use the picnic area. d. Mr. Annand stated there would be no objection . to the public using the area. e.
