Portland, OR 97211 Dear Ken, • This letter is drafted as a notice o you and to the City of Tigard that Main Street Development, Ltd. will enter into an agreement with you and the City to provide an irrevocable, non- exclusive emergency access point along our common, adjoining, north property boundary. With this letter signifying our intent, we will work with the Tigard Planning Department and our mutual architect, Joe VanLom, to locate a point of access that will be approved by both the Fire District and Police Department, It is our intent, per pre- vious discussions with the City that this access will .strictly be for emergency access and will at all times have an approved barrier that may only be removed by emergency vehicles. Since the access point will be located on property to be developed by us at a future date we will sign an easement in your favor granting an irrevocable, non-exclusive right of access easement that yo'l may record. MINUTES: The minutes of March 27, 1979, were considered. Wcod asked they be corrected as follows: Page 3, it paragraph, the motion was corrected to read: ". .. on the ground that it does not comply with the NPO #4 Plaa require- ments for the MINIMUM SIZE DEVELOPMENT. The motion was.. ." (Underscore indicates the correction.) Page 4, 3rd line, the word OWNS should be PURCHASED, making the sentence read, "It was established that the applicant PURCHASED the property without conditions,. ." And on the same page the modified Condition 1 should conclude: ".. .that an agreement be reached tu pro- vide such access upon development of the INTERVENING PARCELS.", On page 5, under New Business , the typographical error in the second paragraph is corrected, making it read, "At this point (10:15 P.M,) . . ." President Tepedino opened the PUELIC HEAPING by reading the usual notice referring to the ordinance giving authority for the procedure to be followed. He then askea Commissioner Wood to report on the activitieo of the subcommittee under hi chairmanship which was named to work on the proposed revision of the Sensitive Lands ordinance. Wood reported at some length purpose and accom- plishments of the subcommittee of four Commission members, pointing out that the impact on the first item on the agenda; however, the ground rules established for the subcommittee precluded any discussion of, or calculation of possible effects on, the first item to be heard this evening, which involves consideration of sensitive lands (floodplait) . This was said to allay concerns of possible viola- . tion of the open meetings statute. If the access is over parcels not yet developed, that an agreement be reached to provide such access upon development of the parcel. 2. That site construction and drainage plans with bonds and necessary - agreements be submitted and approved by the City Engineer and Building Departments prior to issuance of building permits. 3. It was established that the applicant owns the property without conditions, to the expressed amaze- ment of Commissioner Wood. Mr. Bishop affirmed conversations with previous staff lead him and the applicant to believe that in consideration for the dedication of greenway, serious consideration would be given to the density and access problems. Smith moved for denial on the basis of the access situation. The motion was seconded but failed. Thereupon Wood MOVED for approval of Conditional Use CU 37-78 subject to the six conditions recommended by staff. The motion was seconded. Clariffcation of the emergency access condition was asked for, and Mr. Bishop stated that in the present condition of the field to the north, access by emergency vehicles is impossible because it is too soggy. Thereupon Wood, with the consent of the seond, amended his motion to modify Condition #1 to read as follows! • 1. "That a second access point be provided (preferably'to the north) as approved by the Tualatin Rural Fire Protection District and the Tigard Police Department. The applicant's request is in keeping with the provisions of the zoning regulations for this parcel. • 2 . Density: .91 acres x 12 dwelling units per acre = 10.92 dwelling units. Therefore, the applicant's request for ten apartment units and one single family residence is in keeping with the number of dwelling units permitted in Section 18.24.030 TMC. 3. Sewer and water are available. 4 The applicant will be required to dedicatq the Greenway area to the City per the Environmental Dezign and Open Space Ordinance 77-70. III. Staff Recommendations: Staff recommends approval subject to the following conditions: 1. That a second emergency access point be provided (preferably to the north) as approved by the Tualatin Rural Vire Protection District and the Tigard Police Department. 2 That site construction and drainage plans with bonds and necessary agree- ments be submitted and approved by the City Engineer and Building . Departments prior to issuance of bOlding permits. 3. That the Fenno Creek and greenway area be dedicated to the City prior to issuance of building permits. 4. That the applicant receive approval from site design review for land- scaping, ,site plan, etc. prior to issuance of building permits. 5. That the applicant increase the driveway access an additional 12 feet with paving prior to issuance of building permits. 6. No changes will be made to approved plats or specifications unless formal . application is made to the appropriate department and changes are approved •''t by that department. Application for chang will be made in writing and shall include applicable drawings, engineering specifications and other details requested by the department. No construction shall take place :n these instances until after the changes have been approved.
