Provide better traffic circulation , Rebuttal : 1 01 Dennis Robertson, Marts & Chase Engineering Firm stated . , . ., . . . • • MINUTES TIGARD PLANNING COMMISSION May 16, 1978 Page 4 • they had conducted a hydrological study which found the storm water detention problems will be adequate in a series of areas throughout the site; the maximum depth will be 2 1/2 feet at center; the impact created by the , commercial areas would be for a short duration only. o Bibianne Scheckla asked for the specific detention • locations. • .o Robertson said they would be in the larger open spaces in the grass for short areas of time. , 0 Bibianne asked that the water areas be protected and there be some form of vector control . 1 o Robert Ames, representing the present property owners , of the site, stated its present use was not safe for children; the number of restaurants is equal to the demand; this would be the greatest restaurant in Tigard; and it is not often you get a nice company like Elmer 's willing to wait around for all the development procedures, • VanLom stated through two (2) drainage studies the • problems had been identified and the lake takes care of the immediate runoff from large storms and was a natural part of the site development, the NPO never said this had to be a planned development ; the site could have developed independently. o Roger Stayer cited the traffic report as showing 60 cars a day (7%) coming off Gaarde which was not enough for a curb cut . o Altman stated the basic framework of the entire development was necessary to be certain they will function together. E. Commission Discussion : o Quimby asked NPO #3 chairman if his committee had any input into or comment on this proposal . 0 Xluempke stated no, but they did not know there was to be a restaurant o Sakata stated she felt an obligation to the community for a long range plan; there were other reds than restaurants; they had made a sham of the NPO Plan and • proceeded to read from NPO #3; this would only add to the strip commercial ; the parking spaces adjacent to the residential area would be noisy; the traffic signal will serve as a shortcut for those turning left off Pacific. o Quimby agreed with Sakata; no need for another restaurant; should be an office; this was not a planned development. o Wood was not generally opposed to the restaurant but felt it was the wrong location for Elmer' s being too small ; a lower intensity use was needed. o flossman opposed the denial stating an Elmer's was urgently needed. # . . • • • • • • • • . . . . He then made a motion to table in order to allow the applicant to attempt to pursue comprehensive • plan changes. - Quimby seconded and verified that the applicant would have to go through Public Hearing then to the City Council for their ultimate approval. . - Wood also asked that the applicant be allowed an expedited meeting schedule and June 13 was set as a special date. Subdivision. -Due to various unspecified delays in recording the f.mal plat the one year expiration of the subject conditional use was overlooked and subsequently lapsed. The applicant is now requesting that the conditional use be reinstated with the same conditions attached ,to the original approval on February 15, 1977. Essentially, no conditions have changed and therefore the original staff report is sufficient and has been atbached. A copy of the minutes from the Pebruary 15, 1977 hearing have also been attached for your revieW. Additional Findings The only item of concern to staff that was no covered in the original staff report would be the matter of the flood plain as related to lot 13 on the south side of Merestone Court. Since the original submission of this subdivision proposal there has been considerable discussion related to the flood plain and subsequent development on the south side of MerestoneCourb. Based on the most current data, including photos taken during the high water in December, 1977 staff 'is confident that a 171 foot flood • plain elevation is appropriate for the site. Section 18. 57.070 , Tigard Municipal Code (floo plain standards for permitted structures) states as follows: 1. The lowest floor elevation of a structure designed for human occupancy shall be at least one and one-half feet above the flood surface elevation; 2. The nature of this proposal is to bring the existing split zoning of R-7 and C-5 into one compatable zoning in relationship to the surrounding neighborhood. Ai 2. The present zoning is not in conformance with the existing City of Tigard Compre- hensive Plan. This request will bring the zoning more into conformance with the q overall plan at urban low-density use levels. 3. The community benefit will be realized by eliminating the commercial activity that would occur under the present zoning and create residences adjacent to • the back yards and across the street from existing homes instead of a neighbor- hood commercial development. 4. The City of Tigard has just recently taken over jurisdiction of S. W. 121st Avenue and has designated it as a major collector. With this type of neighbor- hood traffic, the construction of duplexes as a buffer to the lots further West into the development makes the use of the land more desirable for single-family homes as it transitions into the site. m 5.
