The opening, imtirovement, or governmental acceptance of the • subject property as an improved public street or road shall not give rise to an action or suit for damages to grantee, their successors and assigns. It is specifically agreed by grantee that if the opening, improvement, or governmental acceptance of the subject property occurs any violations of the land-use regulations of any government caused by the loss of use of the subject property shall be the responsibility of grantee, . . , M. Neupert, President of Consolidated Supply Co., reviewed the history of his company. He stated his desire to mow his two Portland locations and the company's headquarters onto this one site in Tigard. He out- lined the nature of the business done and told what kind of material would be stored in the outside yard. Stewarttill, ageoteehnicalengineerof -Hill, reported on the soil 1 CH2M conditions and geology of the site, His company's study indicated no physicel obstacles to the development as proposed. Ron Adams, attorney, summarized the previous testimony and spoke against the requirement for a 30-foot street dedicatirn as called for by staff recommendation No. 6. He pointed out that the applicant does not need either the 30-foot street dedication requested, nor improvement of the 30-foot unimproved public right of way along the west boundary of the tract for circulation on or through its property, He suggested the owner of the property on the north seek access to his property across the Burlington Northern tracks from S. W. 74th Avenue via a PUC temporary pertit. C. Public testimony: Proponents: tr, 4 None. Opponent: Mr, Harvey King, owner of the parcel to the north of the applicant's property spoke in opposition, He stated he is able to get only a revocablt permit for access to his property across the Burlington Northern tracks, a condition he feels is intolerable. The adjacent uses surrounding this site to the north, east and south are light industry. West of 74th Avenue is open space and industrial park as shown by the Neighborhood Plan *#5. Urban low density residential is shown -farther to the west beyond the open space. 6. The applicant is proposing fifty thousand (50 ,000) square feet. of warehousing, ten thousand (10 ,000) square feet of office and four thousand (4,000) square feet of showrooms 7 . This site is in a wetlands plain which will require proper drainage improvements. 8. This industrial subdivision area i8 expanding the land use designation. At present, the public work improvements include a four hundred and sixty-five foot cul-de-sac terminating approximately one hundred and ninety-five feet east of applicant 's most westerly property line. The applicant's most westerly property line is adjacent parallel with an unimproved thirty foot public right-of-way running north and south from the most northern property line of tax map 2S1 12A, tax lot 1800, south to Fanno Creek Place approximately 3,450 feet. II. Conclusionary Findings: L. The storage area should be defined to allow adequate space but hot to restrict proper vehicle maneuvering. 2 . The storage grounds should be improved with adequate asphalt to support the heavy storage use. 3 In considering the long range potential plans of the applicant to increase his business and the future development of the 4,40 acres north of the subject site (lots 1600, 1700 and 1800) more heavy vehicle transportation is probable and • therefore, expanded circulation system will be necessary. 4 . Eliminating the distance of large, heavy vehicles traveling along a two lane 30 foot right-of-way for approximately 3/4 o a mile is desirable for the interest of health, safety and welfare for the surrounding property owners and drivers. • 5. Increasing traffic circulation where a concentration of large heavy vehicles frequent is also desirable to offset traffi:! congestion, and distribute traffic movement in all possible directions. • 6 The Traffic Safety Program researched by CH2M Hill and adopted by the City in June 1970, states: "Streets can and should be designed and constructed to provide the desired level of service. That is, traffic flow can be stable, safe and efficint„ with consideration of such factors as speed, travel time, freedom to maneuver, traffic interruption, driver comfort, and convenience. To satisfy these conditions, a balanced street network is necessary. " 7. The proposed extension of the cul-de-sac to the perpendicular 30 feet right-of-way west will provide for increase level of Service that will comply with the traffic safety program. 8. Staff Recommendation: Staff recommends approval subject to the following conditions : 1. That the storage area be defined in its size to the approval . of the Planning Commission. 2. That the site construction and drainage plans (especially in regard to the wetland condition) be submitted aid approved by the building department prior to issuance of permits. 34 That the storage yard area be paved to the standards of the building department prior to final inspection of the warehouse. 4 . That a site obscuring fence be placed around the storage yard (type and height) as determined by the Planning Commission (see 'V 13-78) . 5. That the height of the outside storage above the screening be determined by the site design planner. 6. That the applicant dedicate 30 feet of right-of-way along the southern portion of the property from the end of the cul-de-sac to the most western porti9Aof the property line. 7. September 26 , 1978 Page 2 Another aspect that is to the benefit of the public and related to environmental concerns is that Consolidated Supply Co. is a clean industry which does not produce any adverse conditions such as pollution. 4 AS for any environmental changes, there are no major fea- tures that will have to be altered except for the addition • of some culverts to maintain proper site drainage and placing some fill to make the site ready for corwtruction. Consolidated Supply Co. is aware that this property is in a designated wetlands area as defined by the City of Tigard. They have retained CH2M Engineers to conduct a soils and hydrology report to determine if any conditions exist that will need to be in conformance with 7igard's Flood Plains and Wetlands policy. • The tree coverage is minimal as illustrated on the enclosed tree survey. Consolidated Supply Co. plans to provide landscaping around their office and parking. The removal • of any substantial trees will be replaced within these • planned landscaped areas. The economic conditions directly affecting the site that . justifies the requested action is the increased tax revenue for the City of Tigard, and the potential for employment within Tigard. Both of these points will increase with the growth of the company. West of 74th Avenue is open ° space and industrial park as shown by the 'Neighborhood Plan Number 5. Urban low density residential is shown farther to the west beyond the open space. Therefore, the impact or effect that the proposed development will have upon adjacent sites, occupants, activittes, or on im`nedi- ate neighborhoods is minimal. With the site' s proximity to the I-5 Freeway and Highway 217, the ease of access by ' truck minimizes the use of inter-city streets for such heavy commercial traffic. Also, the services of Southern Pacific Railroad contribute to making light industry and Consolidated Supply Co. the best use for the property. With both the proposed Southern Pacific Railroad drill track on, the east, and the Burlington Northern Railroad on the west, the property will be blocked visually from the adjacent uses and any pedestrian or vehicular traffic along these boundaries by the elevated railroad tracks. Consoli- dated Supply Co. has planned a security fence around the perimeter of the outdoor storage area. h 7.
