W. 58th Avenue • Portland, Oregon 97221 Phone (503) 292.0189 February 19, 1969 Mayor Kyle City Council City of Tigard Tigard, Oregon Dear Mayor Kyle: RECEIVED FEB 19 1960 CITY OF TIGARD In response to the actions of the City of Tigard Planning Commission, taken at their meeting of February 18th, 1969, with respect to the request for a conditional use permit in a C-3 (General Commercial) zone for a proposed 34 unit apartment development at 9960 S. W. Walnut Street (Map #2Sl 2]3D, a part of Tax Lot 2200) , we are sending this memorandum to you outlining our views and requesting an appeal of the Planning Commission decision. As you undoubtedly know, the Planning Commission felt that they should overrule the recommenda- tions of The Planning Commission staff for the granting of this conditional use permit, and should in fact turn this matter over to the City Council for action. It was stated by one of the Planning Commissioners that he was against the granting of this permit since the sewers should be saved for those people who have the proper zoning, and should definitely not be granted to outsiders seeking to develop the City of Tigard. Another Planning Commissioner felt that he was opposed to it since this development would add to the congestion of Walnut Street. He apparently lost sight of the fact that this develop- ment would make it possible for the City to widen that street. We have made every effort to present to LIie City of Tigard a project that would be not only esthetically pleasing, but would also enhance the value of our property and that of the surrounding area. Obviously, denial of the conditional use permit would necessitate our abandoning the proposed project, allowing development of this parcel within the framework of it's current commercial zoning. As you can appreciate, this could very possibly be to the detriment of the surround- ing property owners, In our past discussions with you concerning other projects within the Tigard area, we feel that some precedent has been set as to the legality of using the question of sewers to grant or not grant zone changes or conditional use permits. It is our contention that the project should stand on it's own merit. If it is felt by the Planning Commission, and /or the City Council, this project does not give the A • • , ;- ■••*•, Page - 2 - Mayor Kyle - Continued highest and best use to this parcel, then it should be turned down for that reason alone. To date, no one on the City staff, nor on the Planning Commission has said that this project does not offer the best possible use for this land. The reasons of sewer availability, and road oonjestion do not seem to be proper grounds for denial of this application. With this in mind, we would hope that your City Council will look with favor upon the recommendations of the staff, and grant us a conditional use permit. The parcel of land involved fronts on Walnut Street, and backs up to the Tigard Grade School, and is bordered on one side by the Willows Apartments, and on the other by an office complex. As can be seen from the vicinity map, it is surrounded on the north and west sides by A-2 zoning, and directly across Walnut Street to the east by A-2 conditional use, and only on the south side of the property do you find C-3 zoning in land use. It is our contention that the conditional use ar requested for this prcel would not present a non-conformance with the overall zone plan of the City of Tigard.
