Location: 12930 SOW. Scholls Ferry Road (Wash. Co. Tax Map 1S1 33AD, Tax Lot 2100) . Applicant: Progress Bible Church I. Findings of Fact: 1. The site is designated "Urban Low Density Residential" on the Tigard Community Plan, 1971, and "Urban Medium Density" on the NPO #7 Draft Plan. The site is currently zoned RS1 (County-Suburban Residential) . 2. In a residential zone, churches, schools and their accessory uses are allowed as conditional uses, Section 18. 20 .020 (4) and (12) respectively, (Tigard Municipal Code (TMC) . 3. The site is currently occupied by the Progress Bible Church, a mobile unit (used for 01,assrooms) and a parking lot. The southern portion of the site is vacant. '‘ The church was originally authorizs.d by Washington County but has subsequently been 8,nnexed to the City of Tigard (Ordinance 76-40) . 4. The existing structures are presently on a septic tank system and sanitary sewer service is currently not available, Service is expected to be available in the near future following the construction of the Summer Creek trunk line by the Unified Sewerage Agency, 5. Water service for the site is presently provided via a private well which is apparently adequate for the presenb usage. The nearest Tigard Water District line is a 12 inch line located at 121st and Scholls Berry Road, approximately 1/2 mile to the east of the subject parcel. 6, The applicant is requesting permission, in accordance with Chapter 18.72.020 (Tigard Municipal Code) to reinstate operation of the Progress Christian Academy using the existing church facilities, The applicant's • • (141[ / STAFF REPORT • AGENDA 5 .4 May 16 , 1978 Page 2 narrative states that, prior to annexation to Tigard, a fully accredited church operated school - grades . kindergarten through 12th grade was operated with the permission of Washington County. In 1975 the school was serving 89 students. However, the applicant further states, that .in 1975 they began to experience problems with the septic tank drainfield. This resulted in. the County greatly restricting the school' s capacity, until sewer could be provided. Since that time the school has continued with only about a dozen students. Based on the availability of sanitary sewer service in the near future, the applicant is seeking permission to expand full school services to a minimum of 150 students, which is the capacity of the existing facilities. No additional site development is proposed at this time. 7. The existing parking area is subdtandard, currently only approximately half paved and not landscaped. There . are two graveled parking areas , one north and me south of the paved portion of the lot. The submitted site plan does not designate the number of parking spaces provided. However, the applicant states, that approximately 80 spaces are available. • After an on site inspection, staff has determined that there are 46 marked spaces and estimates an additional 40 unmarked (graveled area) spaces. Section 18.60 .120 (Tigard Municipal Code) minimum space requirements for off-street parking requires: (3b) - Churches - 1 space for every 6 fixed at on every, 12 feet of bench length and/or every 100 • *square feet of gross floor area where no permanent seats are maintained. (3f) - Schools, senior high and equivalent private or parochial school - 15 spaces, plus 5 spaces per classroom or I space per 4 seats or 8 feet of bench length in the main auditorium, which ever is greater. • The applicant states that there is see.ting capacity for 130 people in the main auditorium and 90 desks in the basement classroom area. There are also 2 classrooms in the mobile unit. Therefore, the maximum number of parking spaces requiLed would be 81 spaces or (15, plus 23 for desks, 33 for the auditorium and 10 for the mobile classrooms) . • STAFF REPORT , AGENDA 5.4 A * May 16, 1978 Page• 3 • 8 Access to the site is prc,,4e.13d via a 25 foot access • to Scholls Ferry Road and an essentiallyunrestricted a access off of S.W. 130th Avenue. * Southwest 130th is in extremely s4bstandard condition . (only graveled and full of chuck holes) . In a previous decision, (Summer Lake) the Planning Commission decided not to extend improvements to 130th through to Scholls Ferry Road. However, the street system for this area has not yet been determined by the NPO 07 Planning • group. Although 130th may not ultimately be a through ' street it will still most likely be required to serve the church and adjacent properties the south and west. • The need for improvements to S.W. 130th has not been determined at this time, but some improvements will. be needed as the adjacent properties develop. . II. Conclusionary Findings: 1. The church is an existing use and the Christian Academy t. has been operated, at this site in the past without adverse impacts on the surrounding area. However, until recently, this area has remained essentially • undeveloped. Never the less further development of the area will, result in an increased leed for the services provided. • 2. The intensity of the proposed use is such that it would not result in an incompatible relationship with surrounding properties, provided that buses and/or car- pools are used to transport students to and from the sihe. Typical church activities generate the highest traffic on Sunday mornings and other off-peak hou.ts and should not adversely impact traffic flow on S.W. Scholls Perry Road, although left turns into the site could be a problem. 3. Us 6 of the existing facilities for sctiool purposes is currently severely restricted due to subsurface sewerage problems. This restriction can be eleviated in the near future, with the provision of sanitary sewer service. 4. The mobile classroom unit is an unsightly temporary structure and in accordance with Chapter 18. 130 (Tigard Municipal Code) requires a temporary use permit issued by either the Planning Commission or City Council depending on the duration of the temporary use. 5. The Design Review process applies to all new buildings and structures, and to all physical improvements and relocations, additions, extensions and exterior changes to existing buildings. Y• 2.
