Your commission is the only group that has ever afforded us the opportunity to discuss our needs and plans outside the public hearing. Present: Commissioners Fletcher, Goslin, Peterson, Severson, Woodard and Chairman Paterson: Ray Rangila, City Planner. ' B. Absent: Commissioners Lewis, Nicoli and Whittaker. III. APPROVAL OP MINUTES A. Do to the fact that the Commission did not receive the minutes of the regular meeting of December 15, 1970, they will be approved at the next meeting. p . .. IV. PUBLIC HEARING A. Conditional Ilse RICHARD BAUER, Applicant 17727156777. conditional use approval to allow a radiator service on a 0.31 acre 0-3, General Commercial parcel located OA the east side of S.W. 90th Avenue approximately 180 feet north of S.W. Greenburg Road. (Map 1S1 35DD tax lot 3800) ' 1. Staff Recommendation a. Staff recommendation for approval with conditions 2. Public hearing a. Mr. Art Mason, 11695 S. 90th,W. expressed concern over the noise caused by possible traffic in and • out of the subject property. He was also concerned about the parking on the street and subject property, and about signing Mr. Bauer may wish to erect. b. Mr. and Mrs. Albertson asked if the shop was to be a regular radiator shop or if it was just to help Mr. Bauer' s son with the orar flow from his shop. • They also stated concern over the traffic on the • driveway leading back to the garage. 0. A question was raised by another person in the audience concerning the zoning in that area. Chairman Paterson elswered by stating that he believed the City adopted the County zoning in that area. ,• . • tt • ft * 30 Commission Discussion and Action a. The Commission asked if Mr. Bauer was present to answer these questions. Mr. Bauer was not present. The Commission discussed adding additional conditions to the request concerning parking and traffic© b. It was moved (Goslin) 9 seconded (Severson) and passed by majority vote of the Commission present that the application be denied (Commissicner Woodard voting no and Chairman Paterson abstaS. tng) . B. Conditional Use CARL WINTHRS9 Applicant A request for conditional use approval to allow a planned residential development of 42 townhouses on two one acre R-79 Single Family Residential parcels located on the east side of S.W. 98th Avenue approximately 400 feet south of S.W. Greenburg Road. (Map is]. 350D tax lots 1600 and 1700) y . 1. Staff Recommendation a. Staff recommendation for approval with conditions. . 2. Public Hearing a. Mr. Charles Polinsky, 9655 S.W. Lewis Lane9 was ' concerned about the fact that apartments seemed• to be surrounding him. , b. A lady from the audience asked how the project was compatible with the surrounding properties. Ray Rangila stated that the design and lay out of the project would help make it compatible9 and that such design control was only possible in a P-R, Planted Residential development. co Mr. Edward Foerster, 11665 S.W. 986, asked to what standards 98th Street would be improved. Ray Rangila answered by stating that 98th would be improved to a minimum of 50 foot right-of-way, with paving, curbing, etc. to meet City standards. d. Mro Forest Whitthar, 11700 Sao 98019 asked what side of 986 would the additional right ,of-way be taken. Ray Rangila stated that the add:I,tional right-of-way would normally come from both sides-- each giving 5 feet. Mr. Whitthar also asked if the improvements would go to the end of the street and if his side would have to give because they gave for improvements some years ago. Ray Rangila stated that it would have to be a co-operative agreement with the people along that street. Mr. Whitthar also stated concern about a back-up of traffic in the morning behind the buses. Chairman Paterson stated that 50 feet of right-of-way with 34 feet of pave- ment is the standard size in the Tigard area. e. Mr. Polinsky asked if there was to be some type of screening. Mr. Winthers explained that he would be glad to put screening either block or cyclone fence up all around the development. f. Chairman Paterson asked the applicant if he understood the conditions the staff imposed. ' Mr. Winthers said he understood. • 3. Commission Discussion and Action ' AO Commissioner Goslin stated that the plans the Commission were looking at were not the plans that would be appro .red o that the final plan, would allow 27 units in groups of three instead of 42 units in groups of three. b. Commissioner Pletcher asked the applicant if he agreed to 27 units instead of 42. Mr. Winthers • said he agreed. c. Chairman Paterson asked Mr. Winthers if he under- stood what the Local Improvement District procedure i was. Mr. Winthers said he did. d. Commissioner Severson stated concern over the patios being on the second floor level. Mr. Winthers stated that all the patios would be on the ground level and that there would be screening. e. Commissioner Goslin moved to amend staff condition number 2 to read that one stage before final % plans or preliminary plans the Commission would ' have the opportunity to review the preliminary •,, plane screening and other features that they may wish to consider. f. Commissioner Goslin stated that he wished to change his previous amendment from condition 2 to condition , ,Ii 3 of the staff recommendation by having the Commission approve the final plane . I g. The builder stated that he was building this sable project elsewhere. Commissioner Goolin asked the 4. builder if he could bring pictures of the develop- ) merit for the Commission to seed The builder agreed. x he It was moved (Goslin.- , seconded (Pletcher) and passed by unanimous vote of the Commission present to approve the request with the following conditions. That the total number of dwelling units shall be no more than 27 and shall be com- patible to surrounding reside...tial developments. 3. That final plans showing typical elevations, landscaping, building locations, storm drain- age specifications, adequate utility provisions and off-street parking shall be submitted for Planning Department, Public Works Department and Planning Commission approval prior to issuance of building permits. V. OTHER ITEMS A. Shell Oil Sign (Corner of S.W. Greenburg Rd. and S.W, Shady Lane) to Shell requested a sign 35 feet high with a l2 ° y. l2° pecten. a. Ch&irman Paterson explained that a representative from Shell Oil, Ray Rangila and himself had gone out to the site and Shell Oil had an 8° x d° letter "E" raised to 35feet and that this seemed suitable. r b. Mr. Goslin pointed out that the sign Shell Oil was requesting was 25% larger than the one that was shown to Chairman Paterson. co Commissioner Goslin moved that the sign be 25 feet high with an 8° x 8° pecten. He stated that this would provide guide lines for other service stations. Commissioner Fletcher seconded the motion. d. Commissioner Severson stated the sign would be too small. Travelers would not be able to see it. The motion was defeated by a vote of 3-3. e. Commissioner Woodard moved that the sign be 35 feet high with an 8° x 8' pecten. It was seconded by Commissioner Peterson. Commissioner Peterson amended the motion by stating the sign must be turned off when the station closes. The motion was approved by a vote of 5 to 1. B. "Kinder College" (S.W. Grant Avenue) 1. The applicant was asking for a 42 square foot none illuminated sign facing S.W. Pacific Highway--man amendment to the original conditional use approval by the Planning Commission in 1969. a. Staff recommended for a 32 square foot sign. b. Commission asked what the proposed. Sign Code would allow. The applicant explained that the sign would be 2° x 16° with 14 inch letters. It was moved (Peterson) , seconded (Pletcher) and passed by unanimous vote of the Commission present that a non-illuminated 32 sq. ft. sign be approved. '•I C. Katherine Street extension to 121st 1. Ray Rangila explained that the Tigard School District was planning to extend Katherine Street to 121st Ave. It was moved (Pletcher) , seconded ( xoslin) and passed by unanimous vote of Commission present to approve the connection of Katherine St. at 121st Ave. D. Murray Blvd. Corridor Hearing 1. Ray Rangila told the Commission of the Murray Blvd. Corridor hearing in the :vJgard high School on Thursday night (January 21, 1971) at 7ti30 P.M. Bo Date for Planning Commission Study Meetings 1. Ray Rangila explained the need for the Planning Commission to hold study sessions to consider such items as Planned Development requests, subdivisions, etc. The fourth Wednesday of each month at 8000 P.M. was set aside for study sessions.
