OTHER BUSINESS o Commissioner Ball brought up the topics of recent legal cases in the area of land use law, citing specifically Baker vs. Milwaukie. Ball asked the Commission to re- quest a discussion by the new City Attorney of these • cases before the Commission. o Porter pointed out that there were a number of unresolved issues previously attempted by the Planning Commission over which they had asked some time ago to confer with the City Council in order to discuss the particular policies germaine to the issues involved, o Wakem pointed out that it may be valuable to orient the Council to the Planning Commission's thinking with respect to planning and that such a meeting would be necessary in order to establish rational priorities for future legislative matters. An example cited was that of outdoor advertising Signs and the amendment of the Sign Code. o Sakata asked that the staff address the issue of zoning code enforcement. She stated that she personally had noticed, and it had been frequently brought to her attention, that conditions applied by the Planning Commission to conditional uses were not being adhered to and that other zoning code violations were becoming commonplace, o It was suggested that revocation of conditional uses is a Planning Commission power and that a check list of conditional uses and their conditions should be estab- lished for a vigorous enforcement program. 9, ADJOURNMENT: 10:50 p.m, PC Minutes - 7/1/75 - page 6 STAFF REPORT Tigard Planning Commission July 1, 1975 Agenda Item 5. ,,, CU 1275 (Colonial. Texaco Car Wash - Charles Dunn) Conditional Use for a portable car wash to be installed at Colonial Texaco (11465 SW Pacific Hwy. ) Staff Findings 1. This matter is continued from June 17, 1975. 2. Colonial Texaco was annexed to the City of Tigard in 1973 and was zoned C-3. A service station is ordinarily a conditional use in a C-3 zone; however, an existing con- ditional use subject to an annexation is annexed as a permitted use 3. Land use in the area is highway oriented commercial along Pacific Hwy. , although h a more "urban arterial commercial" character is beginning to be evident. The lots behind the Pacific Hwy. frontage support mixed single family homes and apartments which here seem to be compatibly ' A general impression is of a pleasant, well-- arranged, g p maintained, residential area. The site adjacent the ser- vice station on the west is presently under construction for two restaurants, "Shakeyts Pizza" and "Country Kitchen". 4. The undeve:,oped area in the rear of the site provides an excellent ',suffer between the adjacent commercial and resi- dential uses, but needs to be maintained. Provision of some additional evergreen vegetation would help control noise from the service station somewhat, but will not pro- vide complete sound isolation. +, fencing H t t. - taken down e has been 5, The sight obscuring fencing Formerly Located near the property line adjacent Sha y s The fey apparently by the owner of the Shakeyts site fence had been provided by Texaco and in staff' s opinion it would remain Texacots responsibility. 6, Access to the site appears very good with adequate sight distances for ingress and egress due to appropriate set- backs being present, Traffic conflict with the driveway as located would be expected only during periods of heavy south bound traffic (evening rush hour) 7, Proposed carwash (accoruing to applicant) may slightly increase patronage and consequently the traffic generation station. ,y 'be a u that that could of theffect. Patronage is now 200-25O cars per day. side e g 8. Staff's evaluation of the noise added by this installation is that it is within acceptable limits (similar unit at Barbur Blvd. and Capitol Hwy. Shell Station has been visited by staff) and will not likely increase existing operational noise levels at the property lines. The service station is subject to noise control guidelines established, by the State of Oregon Department of Environmental Quality which limit noise levels at the property lines to levels unlikely to interfere with ordinary conversation. 9. Site proposed is behind existing station building, approxi- mately 45 ft. from the rear lot line. (It would be approxi- mately 60 ft. from the nearest single family dwelling) . 10. Several existing, although comparatively minor violations, of Tigard Code were noted on staff inspection. These were outside storage and display of tires, excessive signs, illegal "A frame', signs and banners and an open trash collection area. 11. The Tigard Community Plan designates the area as ugeneral commercial" and no NPO organization has yet been formed in this area to provide other input. 12. Waste water disposal will be accepted by the Unified Sewer- age Agency, but a sand and grease trap will likely be re # quired under the State Plumbing Code. Phone 64.40749 . . i .. The "Why For" and "What For" of the "SWAB BEE" Car Wash. , The exists today a ready market in the Car Wash industry for a simple, reliable, highly-efficient Car Washing machine at a low cost. It is . generally believed that only noisy, sophisticated, unreliable, trouble- - some, expensive equipment is available on today's Car Wash market, This has been true in the past, but ElBee Mfg, has now done something to change . . al]. this. , We at ElBee Manufacturing have developed a simple, uncomplicated, trouble- free machine at low initial investment and minimal maintenance, that will . ,.. . _ challenge this ready market. Our machine named, the "Swab Bee", offers ,,, the following features which are all new to the Car Wash industry, , 1, I,2121:021aAema,111. - Entire assembly is powered by one 1-4- h.p. . . . _4. electric motor at 110 v. - 20 amp fuse, (unit draws 13 amps under full load). Plugs in like a dishwasher! 2, ,. Low noise factor - When washing an automobile) the sound does . . not go above voice level. 3. Low water use - Because the wash swabs are made of a soft ozite . , ., material, the function becomes that of a sponge and uses 2.5 or less gallons of water per wash. 4. Minimum water discharge - The water supply is provided by any 3/4" • . . . garden hose at city pressure which minimizes waste to the sewer. 5. Portable, - The machine is on caster wheels and can be readily .. . i moved from place to place. (' . 6. FreStanding - The unit does not require a building for install- . . .).1 ation, 7, No 91LIti.11 - Almost all existing Car Wash machinery is powered by means of a hydraulic oil system. The system becomes trouble- .) , 1 some after use where deteriation of seals and hoses cause oil leaks and the spill goes to the sewers. Our machine can not do this . 1 / because it is all electric. all 8. Soft water saturated low-speed ozite mops instead of mono-filament) hi-speed plastic brushes are used for the preservation of the finish on your automobile, . Page 2 g 9. Minimum loss of production due to breakdowns means more revenue. 10. Minimal maintenance expense. 11. Conve; or system - A simple and trouble-free, aboveground instal- lation with 2 horse-power, 110 volt power source. In addition to these outstanding features we have a combination soap and wax we use that gives the car a protective coat of wax and a glistening finish. In other words we can "tell a customer" we can "wash, wax and polish" your car in one operation, To round out the performance picture of the `Swab Bee" we can install a complete water recycling unit for reclamation of water and chemicals when and where desired or needed. ElBee Manufacturing feels the revolutionary features of our product are both timely and important to the environment and Car Wash ;industry. This will give us immediate acceptance over the existing equipment now being used. Contacts and sales made by our sale: people to date substantiate this belief. We realize we do have to change the stigma associated with car washers at present. Not only the Public but Government Agencies, Planning Commission, D.E.Q. and financial institutions that have had unpleasant relationships with present machines. To do this we are placing machines in conveniently located areas so one can see the "Swab Bee" in action, Once a purchaser or user has witnessed the "Swab Bee" in operation or driven their car through the washer, they will immediately recognize all the advertised features of the machine to be facts. Our president, Mr, Evans is a former member of the Hanna organization and for the past five years has owned and operated a Hanna System. In spite of over $11,000.00 dollars paid out in maintenance and repair parts in 1974 and considerable loss of revenue due . 4 to "down-time", Mr. Evans showed a profit. So we do know our competition as will as our own product and know we can present a positive and profit- able picture to prospective customers. Because the "Swab Bee" requires such a low initial investment, minimal space, practically no environmental impact, no costly repair parts and the very minimum "down-time", we believe we can establish a new horizon for the "Car Wash" industry. In our humble opinion once we have demonstra- ted the "Swab Bee" gives as good or better car wash than the expensive, complex machines now on the market, the "Swab Bee" will be accepted not only as the "Oar Washer" of "today" but of the "future" as well, ., 1. , . . t w :1 :10 ., ' iiir. One projection deals with a station other oper- ating under allocation and the oer on a pro-forma basis. These figures are based on actual performance, not on an estimate or guesstimated basis. They reflect only the sales, costs and profits as a result of installing the "Swab Bee' cat wash0 which averages approximately 85% of the customers, The remaining 15% buy gas only, which is not reflected in these figures. These projections are made on the basis a customer must fill his tank to obtain a free wash. Our records show an average purchase of 12 gallons to ,. . the customer. If we divide the 36,000 gallons purchased to obtain a free . ‘ wash by 12 gallons we arrive at 3,000 cars washed. This represents 60% of . .' the customers and if we divide 3,000 washes by 60 we come up with 50 cars re • . presenting 1%• If 25% of the customers purchase a car wash we must multiply 1 . the 25% by 50 cars and come up with 1,250 ca xs that purchase washes a $1.25 .. each. The remaining 15% reflect the customers who purchase gasoline only, which as stated previously does not affect this projection. .
