The findings and conclusions on which the decision is based are noted below. FINDING OF FACT Background The subject site was annexed to the City in January, 197E (Boundary Commission file #887). Site Information and Proposal Description This 1.08 acre site is currently occupied by a house, a machine shop, an Office/garage-shop, two above ground fuel tank atands, p p• g deciduous trees on the site and a concrete um x.n station. There are a few dedid where there but most of the site buil:di is bare or concrete- covered except g ngs. The applicant p I� ro odes construction of a 10,, 500 square foot warehouse that will occupy the northwest corner of the site. The remainder of the p ro p e rt y is to b e used for parking and landscaping. All of the ecisting buildings, except the shop tin the north side the site, will be removed prior to construction of the warehouse. The above - ground fuel tanks will also be removed prior to construction. The site plan shows 32 parking spaces; including 1 handicapped a • � , south of the proposed warehouse. Access is provided by a 25 foot wide entrance from 74th Avenue that crosses over Southern Pacific Railroad tracks, located on the west side of the site. Landscaping includes pear 'ncludes 7 flowerin ear trees, an existing dogwood tree, and ivy ground cover amounting to approximately 10% of the site Agency and NPO Comments The 'Engineering Division has reviewed the proposal and offers the following 'comments; The applicant proposes to construct a 10,500 square foot warehouse building west of SW 74th Avenue. as The applicant has submitted a site and preliminary utility plan showing the existing and proposed buildings. b. Access to the site is provided by a driveway crossing the railroad to SW 74th Avenue. This portion of SW 74th Avenue was not improved by the SW 74th Avenue Local Improvement District. Resolution No. 88 -102' requires that "the developers of properties outside of the 1982 LID (SW 74th.,' Avenue Local Improvement District #27) be required' to construct "two- thirds street improvements" to commercial street standards per Code Section 18. 164.030, (Z) . "Two thirds street improvements means half- street plus one travel lane, adequate to provide for two way traffic." c Resolution No. 8S -102 further requires "that any development makexbetQns substantial truck traffic may requited interim street improvements adequate to accommodate; the expected truck traffic." The proposed project Will convert a concrete pumping business to a warehouse business. Altnough tY is wig l eliminate concrete pumping truck traffic, the applicant expects the proposed warehouse to generate heavy truck traffic. The Building Division points out that demolition permits will be required for the removal of any building. They, also note that', a bond, cash deposit, or other performance' assurance must be provided by the applicant to guarantee removal of the existing building that is proposed to remain until completion of construction of the proposed warehouse, unless the applicant can show that together these two buildings are in conformance with the applicable State Building Code requirements. All other buildings must, be removed prior to construction. The Fire Marshall comments that the applicant must provide sprinklers throughout the proposed warehouse to comply with fire flow and access requirements of the Uniform Mechanical Code. Tigard Water District has no objections to the proposal but indicates that railroad permits must be obtained before water line construction may begin because it will be necessary to install the water line under the railroad tracks. NPO #5, General Telephone; and P.G.E. have reviewed the project and have no objections to it No other comments have been received. There is no minimum lot size or lot width requirement, there are no side or tear setback requirements in the I -L zoning district. The proposal satisfies the 30 foot front yard setback because the proposed structure is set back approximately 126 feet from the front property line. No special circumstances exist that would require screening along these property lines. On the site to the north there is a ` driveway, a parking lot, landscaping, and a sight obscuring fence separating the proposed use from •tGhe, existing use. To the east of the site an industrial building is also built adjacent to the property line. Visual Clearance Areas visual clearance al satisfies the requirements of Code Section 18.102 for p areas at the entrance from 74th Avenue as long as the 2 flowering pear trees proposed to be planted in the visual clearance are maintained so as to provide clear vision between 3 and 8 feet in height. The number of parking spaces proposed exceeds the number of spaces that are required (10) by 22 spaces. All of the spaces, with the exception of the handicapped space, 'ze requirement with respect to width.
