Dear Steve,
We are in receipt of your request for an alternate method of construction for the
above referenced project. The proposal submitted was to provide two (2)
additional sprinkler heads above the opening in the lyophilizer equipment that
separates the smaller control area from the rest of the building, which is the
second control area. Additionally, the equipment interface with the adjoining one -
hour constructed wall will be fully fire caulked with a listed product having a fire -
resistive rating of not less than one -hour to further seal the penetration. This is in
lieu of the required one -hour rated opening required by Section 715 of the 2004
OSSC.
The total amount of Class II combustible liquids in the tenant space is 300
gallons. Two control areas were created to reduce the amounts of liquids to 150
gallons per control area. This is 90 gallons less than the 240 gallons permitted
per control area. Based on the added protection, the low amounts of combustible
liquids and the fact that they are used when the equipment is closed, we feel the
opening is adequately protected for this particular application.
This request has been evaluated by the City of Tigard Building Division staff as
well as by Eric McMullen, Deputy Fire Marshal for Tualatin Valley Fire & Rescue.
Mr. McMullen is in concurrence with our assessment of the proposal and
approval.

Therefore, in accordance with Section 104.10 of the 2004 Oregon Structural
Specialty Code, your request for an alternate method of construction is approved.
This approval is for this specific project and is a one time approval. Any further
requests for this same application on any other site or project will require the
same submittal and approval process.

Thank you for your submitted request for approval of an Alternate Method of Construction. In
review of your submitted request dated May 11, 2005, to utilize section 104.10 of the Oregon
Structural Specialty Code, no evidence was submitted showing that the submittal meets this section
as stated for review. The request submitted seems to be asking for a waiver of the code for opening
protection in the fire barrier wall.
The Building Official has no authority to waive code requirements as stated in section 104.1, "The
building official shall have the authority to render interpretations of this code and to adopt policies
and procedures in order to clarify the application of its provisions. Such interpretations, policies and
procedures shall be in compliance with the intent and purpose of this code. Such policies and
procedures shall not have the effect of waiving requirements specifically provided for in this
code."
RESPONSE
According to the control area in question the sprinkler system was installed to allow 100 percent
increase per Table 307.7(1) from 120 gallons to 240 gallons of class II combustible liquid. Your
proposing to have 300 gallons class II combustible liquid which is 60 gallons over what's allowed
in that area without one of those rooms becoming a control room required by Table 307.7(1) and
section 414.2.1 for 1 -hour fire barrier construction requirements to meet chapter 7 sections 706.
Also, Chapter 7 section 706 does not give a substitution for installing a sprinkler system in lieu of 1-
hour walls. As far as an incidental use area per chapter 3 section 302.1.1 this area does not apply.
Control areas are regulated by section 307 and 414 along with the Fire Code. The opening in
question within the control area is regulated by section 715.
Therefore, if you want to utilize section 104.10 please provide information showing you meet the
requirement as stated in section OSSC 104.10. EXAMPLE; like increased density in sprinkler
coverage at openings that have equipment and with a tight seal made up of heavy stainless steel

metal flanged flashing around the opening, caulked with a listed and tested fire and smoke caulking
as per Chapter 7 smoke and fire stop requirements or any other method you believe would meet the
equivalent of the code requirement.
In closing, just a reminder section 104.10 states that "The provisions of this code are not intended to
prevent the installation of any material or to prohibit any design or method of construction not
specifically prescribed by this code, provided that any such alternative has been approved. An
alternative material, design or method of construction shall be approved where the building official
finds that the proposed design is satisfactory and complies with the intent of the provisions of this
code, and that the material, method or work offered is, for the purpose intended, at least the
equivalent of that prescribed in this code in quality, strength, effectiveness, fire resistance,
durability and safety."

1. I am requesting approval of alternate design and methods of construction in accordance with
IBC section 104.11 for the protection of an opening in a fire barrier. Refer to drawings A2.3
and M0.1 for the opening in rooms 311A and 311B where the lyophilizer equipment is bulk
headed through an opening in the wall of a control area. These areas are designed to be
control areas for less than exempt amounts (150 gal vs the allowed 240) of a Class II
combustible liquid. The control area requirement for these areas is per section 414.2.1 of the
IBC.
2. Requested alternate method of construction: Where IBC 2003 section 715 requires that rated
window or door assemblies protect an opening in a fire barrier wall according to the provisions
of the section. I am requesting that the opening where the equipment is bulk headed be
exempt from the one hour rated construction requirement due to the building containing an
automatic sprinkler system, which reduces the requirement to a non -rated construction.
3. Explanation and Code Reference: The equipment is a tight seal to the wall in the area it is bulk
headed and therefore creates a seal. Most of this seal consists of the heavy stainless steel
shell of the unit, the remaining amount metal flanged flashing around the opening. However,
the unit is not capable of being listed as a one -hour assembly and therefore would not meet
the requirement of the code for one hour construction. It is clear that the intent of the code in
many areas regarding one -hour construction is to allow a reduction to non -rated construction
when the building has automatic sprinklers installed. The references to reduction of one hour
rated construction to a non -rated construction are present in the IBC under table 302.1.1 for
incidental use rooms, of which this could be considered, and under table 601 fire resistive
rating requirements, where the requirement for a one -hour construction is removed with a
sprinkler system in place.
The control area rooms 311A and 311B comply with the code on all aspects of a one -hour •
construction except for the bulk headed equipment.

Subject: REVISION #2 Alternate Means Request for Protecting Opening in 1 -Hour Fire Barrier
(Created in Response to Reply from City of Tigard Letter Dated May 18,2005 which
denied initial request letter dated May 11, 2005)
1. I am resubmitting my request approval of alternate design and methods of construction in
• accordance with OSSC section 104.10 for the protection of an opening in a fire barrier. This
resubmitted letter provides additional information on our plan for meeting the code
requirement. Refer to drawings A2.3 and M0.1 for the opening in rooms 311A and 311B where
the lyophilizer equipment is bulk headed through an opening in the wall of a control area.
These areas are designed to be control areas for less than exempt amounts (150 gal vs the
allowed 240) of a Class II combustible liquid. The control area requirement for these areas is
per section 414.2.1 of the OSSC.

and therefore would not meet the requirement of the code for one hour construction. The
equipment flashing does create a smoke /fire seal and protects the opening. By providing two
additional sprinkler heads located one foot horizontally from the opening and two feet vertically
above the top of the opening, the opening should be provided sufficient protection from fire
penetrating the opening for one hour as is required. Additional protection would be installed
around the flashing by using an approved fire caulking between the flashing and the wall. See
provided sketch for details.
