STAFF RECOMMENDATION / ACTION REQUEST Amend Ordinance 11 -07 to extend the date of phase -in of city property taxes for Area 64. Adopt a resolution to extend the phase -in of city property taxes for those areas annexed by triple - majority annexation to July 1, 2014. (This is after the estimated date for Tigard's adoption of the River Terrace Community Plan. Currently, the Plan's completion and consideration by Council is expected to be in spring, 2014.) KEY FACTS AND INFORMATION SUMMARY Resolution 12 -09 establishes city policy to guide Tigard's actions related to annexation of unincorporated lands into city limits. The resolution provides incentives to annex that include the waiver of the city annexation application fee, and a three -year phase -in of property taxes at the rate of 33 percent first year following annexation; 67 percent second year; and 100 percent the third year as allowed by Oregon Administrative Rule (OAR 150- 222.111). The Council has extended these incentives each year since 2007 in an effort to ease the transition of annexation for property owners. At the August 21 workshop where the council received the annexation background report, and at the request of property owners considering annexation, the Council discussed and asked for proposed legislation that would delay the phase -in of increased city property taxes until after the city adopts the River Terrace Community Plan. This would apply to three areas subject to the River Terrace Community Planning process that have annexed through the triple- majority process. The intent of the proposal is to respond to concerns that property owners in these areas would be paying property taxes for city-level services before the Community Plan and associated zoning is adopted that would allow development of their property. Area 64 property owners annexed to the city in 2011. Area 63 and Roy Rogers West property owners have not yet annexed to Tigard. All three areas are part of the River Terrace Community Plan area. To provide parity and certainty to all property owners who are covered by the River Terrace Community Plan, the Council suggested that all properties in the planning area should be subject to a delayed phase -in of property taxes to the time when Tigard adopts the Community Plan. One implication of further delaying the phase -in of property taxes is that the city will not collect expected revenues that help offset the costs of annexation transition. Staff estimated that property tax revenue that would be foregone from extending the phase -in could total up to $92,000 for all three areas if calculated through the year 2016 (Area 63, 64, and Roy Rogers West). This policy change requires the administration to quickly notify Washington County of a change in Tigard's property tax phase -in policy, since tax assessments are due to be mailed to property owners in mid- October (which affects property owners in Area 64). If it is not possible for Washington Councy to withhold the tax assessment for This year, the City may issue the Area 64 property owners a rebate or payment to offset the 33% of increased city property taxes owed in the first year after annexation. OTHER ALTERNATIVES Council may elect to retain the current incentives for annexation as adopted in February 2013. SECTION 2: The City Council shall continue to review its annexation policy and associated incentives in February of every year. SECTION 3: The incentives recited in Section 1 of this resolution are retroactive as to any property annexed into the city limits by way of voluntary triple majority annexation approved by Council on or after August 23, 2011. WHEREAS, the Tigard City Council ( "Council ") adopted Ordinance No. 2011 -07 on August 22, 2011, effective September 30, 2011, annexing certain contiguous real property into the boundaries of the City of Tigard ( "City"); and WHEREAS, the City annexed such real property pursuant to ORS 222.170(1) referred to as "triple majority" annexation; and WHEREAS, the City initially set property taxation levels for the annexation area at levels consistent with Resolution No. 11 -08; and WHEREAS, the Council has since adopted Resolution No. 12 -_, amending Resolution 11 -08 to establish additional property tax incentives for voluntary triple majority annexation; and WHEREAS, the provisions of Resolution No. 12 -_ apply retroactively to property annexed into the city limits by way of voluntary triple majority annexation approved by Council on or after August 23, 2011; and WHEREAS, the Council desires to extend the incentives established by Resolution No. 12 -_ to the property annexed by Ordinance No. 2011 -07; and WHEREAS, the County process for printing and delivering property tax statements is already underway for the past assessment year. Craig Dirksen, Mayor Approved as to form: City Attorney Date ORDINANCE NO. 12- Page 2 50014-36794 1050_Final Draft - Ordinance Amending Ricer Terrace Tax Rate.docxIDRF /9/27/2012 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL RESOLUTION NO. 07- ) 3 A RESOLUTION OF THE CITY OF TIGARD ESTABLISHING POLICY TO GUIDE CITY AC:'IONS PERTAINING TO ANNEXATION OF UNINCORPORATED LAND TO THE MUNICIPAL CITY LIMITS WHEREAS, Oregon law provides standards and procedures that permits annexation of unincorporated lands to cities and the City of Tigard has adopted, as part of its acknowledged Comprehensive Plan, guiding policies pertaining to annexation; and WHEREAS, Washington County and the City of Tigard have, by intergovernmental agreement, mutually determined: a) the extent of an area called the Tigard Urban Services Area (TUSA) within which the City shall be the ultimate provider of urban services and, b) these lands shall be eventually part of the City of Tigard; and WHEREAS, accessible governance and complete urban services are essential to the quality of urban life and annexation is a necessary means to: a) ensure delivery of complete urban services to the TUSA, and b) guarantee the cost of services are more equitably shared among all those that use them; and WHEREAS, annexation is an important tool to establish and maintain regular and logical city boundaries necessary for effective planning for public facilities services; the provision of said services and timely response by law enforcement; and WHEREAS, parts of Tigard's municipal boundary are irregular and confusing, and there exists unincorporated lands (islands) completely surrounded by the City; and this situation is incongruous with the City's responsibility to promote the effective and efficient provision of urban services; and WHEREAS, the City of Tigard offers a wide range of benefits to its citizens including, full urban services; proximate and responsive governance and political representation; opportunities for civic participation, and quick to respond law enforcement, and consequently many property owners within the unincorporated TUSA have expressed interest in annexation; and WHEREAS, the City wishes to promote the benefits of being part of the City and wishes to encourage voluntary annexation. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that SECTION 1: The City shall not resort to involuntary annexation of unincorporated land, except in cases where it is found that such action is in the overall City's interest, such as to resolve public safety and /or health issues where it is necessary to extend or provide essential City services consistent with an adopted Community RESOLUTION NO. 07 1,3 Page 1 Investment Plan (CIP) or Public Facility Plan (PFP), and /or resolve incongruous municipal boundaries. SECTION 2: Tigard shall work with other cities, Washington County, Metro and the state to promote regional and statewide policies and actions that recognize that logical, efficient and economically sustainable urban development can best occur in existing incorporated cities. SECTION 3: The City shall proactively promote the benefits of being within the municipal City limits and invite owners of unincorporated properties to voluntarily join the City. However, each annexation shall be evaluated on its own merits to ensure it is in the City's overall interests. SECTION 4: The City shall communicate with and otherwise work directly with those that express voluntary interest in annexation to facilitate the annexation process. This shall include providing incentives to annex such as the following: • Waiver of the City annexation application fee until July 1, 2008. • Phasing in of increased property taxes over a three -year period at the rate of 33 percent, 67 percent, and 100 percent, for properties that annex during the period of March 13, 2007 to February, 2008, per Oregon Administrative Rule (OAR 150 - 222.111). KEY FACTS AND INFORMATION SUMMARY OTHER ALTERNATIVES At their November 15, 2011 joint meeting, the CCDA board and the City Center Advisory Commission (CCAC) discussed the CCAC's recommendation to retain a professional to assist in forming a self - sustaining downtown organization. At that time the board of the CCDA decided to scale back the proposal in favor of a more targeted technical assistance program focused on events and marketing. This type of assistance was felt to be most valuable by many businesses, due to the time requirements of organizing events. The goal of events is to attract new customers and new small business investment to the downtown. Events also build the brand of downtown Tigard and promote its status as the central gathering place of the community. In January 2012, Bridget Bayer, of Business Association Management (BAM) was engaged for a limited term contract to work on this project. She has worked to improve the organization of, and increase participation in, the "Third Friday" events that Downtown businesses had previously started. Working with volunteers she also organized the Downtown Tigard Street Fair on August 11. The event drew approximately 2,000 visitors to the Downtown. Bayer will report to the Board of the CCDA on her activities and make recommendations on moving forward on Downtown Events. One recommendation is for the Tigard Area Chamber of Commerce to take on some of the tasks that Bayer had worked on. The Chamber would work with the Downtown businesses that have been involved in event planning. Preliminary discussions with the Chamber CEO have been positive and the Chamber will submit a proposal and proposed budget in the next two weeks.
