Proposed changes includes the removal of false - mansard awnings to be replaced with fascia boards to match existing on the rest of the structure, removal of a non- functioning service window and wood panel to be replaced with a fixed window, replacement of an existing door, repair of an existing sign, and construction of a new trash enclosure. ZONING DESIGNATION: MU -CBD: Mixed Use — Central Business District. The MU -CBD zoning district is designed to provide a pedestrian friendly urban village in Downtown Tigard. A wide variety of commercial, civic, employment, mixed -use, multi- family and attached single family residences are permitted. New development and re- development is required to conform to the standards of Chapter 18.610. SUB -AREA: Main Street - Center Street. This sub -area is centered on the City's historic downtown Main Street. It is intended to be pedestrian oriented with smaller scale development that would function like a "traditional Main Street." A pedestrian environment would be improved with a continuous building wall broken only intermittently. New buildings in the sub -area must include ground floors with commercial storefront features. Residential and commercial uses are permitted on upper floors. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.520.030, 18.610.010, 18.610.030, and 18.745.050. SECTION II. DECISION Notice is hereby given that the City of Tigard giv ty igard Commurury Development Director's designee has APPROVED the above request for Downtown Design Review subject to conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS DDR2012 -00003 / TIGARD MAIN STREET CLEANERS DOWNTOWN DESIGN REVIEW PAGE 1 OF 4 FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. SITE AND PROPOSAL INFORMATION Site Information & History The site is located on SW Main Street, constituting a single -story building with a commercial storefront occupied by Tigard Main Street Cleaners. The site and surrounding properties were rezoned from CBD (Central Business District) to MU -CBD (Mixed Use — Central Business District) in 2010 to create the Tigard Downtown District. Sub -areas were established within the downtown, and this site is located within the Main Street — Center Street sub -area. Surrounding parcels are developed with a mix of retail uses and restaurants. Proposal Information The applicant is proposing facade improvements to the existing structure. Proposed changes includes the removal of false- mansard awnings to be replaced with fascia boards to match existing on the rest of the structure, removal of a non - functioning service window and wood panel to be replaced with a fixed window, replacement of an existing door, repair of an existing sign, and construction of a new trash enclosure. Because the proposal meets the threshold of a Track 1 Design Review Compliance Letter (Tigard Development Code Section 18.610.010.E.1), the application is being processed as a Type I procedure. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS A. Zoning Districts 18.520 Commercial Zoning Districts B. Tigard Downtown District Development and Design Standards 18.610 C. Landscaping and Sreening 18.745 A. ZONING DISTRICT Commercial Zoning District: Section 18.520.020 Lists the description of the Commercial Zoning Districts. The site is located in the MU -CBD zoning district: Mixed Use — Central Business District. Uses: Section 18.520.030 (Table18.520.1 — Use Table Commercial Zones) The tenant space is occupied by a dry cleaning business (repair oriented retail), which is an allowed use in the MU -CBD zoning district. This standard is met. B. TIGARD DOWNTOWN DISTRICT DEVELOPMENT AND DESIGN STANDARDS Applicability 18.610.010.C.2 addresses expansion, modification and site improvements to existing development. An addition, expansion, modification, and /or site improvements associated with such lawfully preexisting uses and structures shall be allowed, provided the application for such proposed project moves toward compliance with the applicable Development Code standards. Only those Downtown Building and Site Design standards applicable to the proposed expansion modification or site improvements to the existing development shall be applicable. The proposal modifies a pre - existing use and structure. Applicable building and site design standards are addressed below. Applicable development criteria are listed with findings showing how the proposed project moves the structure towards compliance with district standards. This criterion is DDR2012 -00003 / TIGARD MAIN STREET CLEANERS DOWNTOWN DESIGN REVIEW PAGE 2 OF 4 satisfied. Purpose and Procedures 18.610.01O.E.1 addresses when Track 1 design review procedures are required within the Tigard Downtown. Track 1: Design Review Compliance Letter using Design Standards are applicable with the addition of new fences, retaining walls, or both. The proposal is for the restoration of a window, change to an existing awning and canopy, and an addition of a new fence (trash enclosure). A Track 1 Downtown Design Review is being requested; this criterion is satisfied. 18.610.030 - Building and Site Design Standards — Create Vibrant ground floors, streetscapes and rights -of -way; provide weather protection; and promote safety and security. Design standards in this section are intended to foster vibrant, inviting streetscapes and sidewalk - facing ground floors and entryways. They are also intended to create buildings that are easily accessible and provide protection from the elements for pedestrians. They also will help ensure that the ground floor promotes a sense of interaction between activities in the building and activities in the public realm. Primary Entry: Commercial /Mixed Use Buildings: (2 (1) At least one entry door is required for each business with a ground floor frontage. ) Each entrance shall be covered, recessed, or treated with a permanent architectural feature in such a way that weather protection is provided. (3) All primary ground -floor common entries shall be oriented to the street or a public space directly facing the street, not to the interior or to a parking lot. The applicant's proposal would remove the existing entry door, with a replacement door installed within the existing doorframe. The entrance is protected by an existing canopy structure that would not be removed. The existing door does not directly face the street, and the replacement will not increase the nonconformity. Approval criterion for primary entry doors in commercial buildings is met. Windows: Ground Floor windows for nonresidential and mixed use buildings: (1) 60% minimum ground floor window coverage for street - facing wall (minimum window coverage includes any glazed portions of doors). (2) Ground Floor Window Transparency. All buildings with nonresidential ground floor windows must have a visible transmittance (VT) of 0.6 or higher, with the exception of medical and dental offices, which may have tinted windows. The applicant's proposal does not specify the existing and proposed percentage of ground floor window coverage or the visual transmittance of the existing or proposed glazing. Regardless, the application does propose the restoration of a fixed window through the removal of a wood board and service window. The result would be an increased percentage of glazing on the street facing wall, and a visible transmittance that will match that of the existing glazing according to a note on Sheet 2 of 4. The changes will move the structure closer to compliance with this standard, if it is not already compliant. This criterion is satisfied. Weather Protection: For non - residential and mixed use buildings: (a) A projecting facade element (awning, canopy, arcade, or marquee) is required on the street- facing facade of the street with the highest functional classification. (b) Awnings /marquees /canopies may project a minimum of three feet and a maximum of six feet from the facade (a maximum of four feet into the public right -of -way). (c) The element shall have a minimum 10 -foot clearance from the bottom of the element to the sidewalk. d) Awnings must match the width of storefronts or window openings. e) Internally lit awnings are not permitted. f) Awnings must be made of glass, metal, or exterior grade fabric (or a combination of these materials). The existing masonry structure is located in a roughly "L" shape parallel to Main Street. A wooden canopy projects from the northeastern side of the structure towards the street, creating a protected driveway for customers to pick -up and drop -off laundry. Existing false- mansard awnings fronted with wood shingles currently project from the street - facing side of the facade and canopy. Removal of the false- mansard awnings would move the structure closer to compliance as the existing awnings are not made of glass, DDR2012 -00003 / TIGARD MAIN STREET CLEANERS DOWNTOWN DESIGN REVIEW PAGE 3 OF 4 metal, or exterior grade fabric. This criterion is satisfied. C. Landscaping and Screening 18.745.050.E.4 addressees special provisions for refuse containers. Any refuse container or refuse collection area which would be visible from a public street, parking lot, residential, or commercial area, or any public facility such as a school or park shall be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. All refuse shall be contained within the screened area. The proposed application would construct cedar plank fencing to establish a trash enclosure. According to details on Sheet 3 of 4, the plans call for the enclosure to be 5' tall with verification that the fencing extends "past top of existing trash containers." This criterion is satisfied. SECTION V. Create vibrant ground floors, streetscapes and rights -of -way; provide weather protection; and promote safety and security. A.2. Primary Entry. a. For commercial /mixed use buildings: (1) At least one entry door is required for each business with a ground floor frontage. This project removes a non - functioning door that was originally used to serve drive up customers. The door will be replaced with a window, preserving the ground floor window requirement. (2) Each entrance shall be covered, recessed, or treated with a permanent architectural feature in such a way that weather protection is provided. There is an existing awning structure. The awning is being changed by removing a mansard structure. (3) All primary ground -floor common entries shall be oriented to the street or a public space directly facing the street, not to the interior or to a parking lot. The entry remains oriented to a public street. Landscaping and Screening 18.745.050.E(4) 4. Screening of refuse containers. Except for one- and two - family dwellings, any refuse container or refuse collection area which would be visible from a public street, parking lot, residential or commercial area, or any public facility such as a school or park shall be screened or enclosed from view by placement of a solid wood fence, masonry wall or evergreen hedge. All refuse shall be contained within the screened area. The project will add a trash enclosure to screen the trash and recycling containers. Trash has been serviced from this area since the building was constructed in the 1960's. Mixed Solid Waste and Recyclable Storage 18.755.050 C. Design standards. 1. The dimensions of the storage area shall accommodate containers consistent with current methods of local collection; 2. Storage containers shall meet Uniform Fire Code standards and be made and covered with waterproof materials or situated in a covered area; 3. Exterior storage areas shall be enclosed by a sight- obscuring fence wall, or hedge at least six feet in height. Gate openings which allow access to users and haulers shall be provided. Gate openings for haulers shall be a minimum of 10 feet wide and shall be capable of being secured in a closed and open position; 4. Storage area(s) and containers shall be clearly labeled to indicate the type of materials accepted. The trash containers will be enclosed with a sight obscuring fence.
