Brookside Aventine. Applicant requests a «Minor Land Partition approval to d vide one parcel of approximately 2.15 acres into three parcels of approximately 1.62 acres, 10,250 and 11,980 square feet in size. The applicant is also proposing a private drive easement to access S.W. Brookside. GTE requests a five (5) foot public utility sidewalk on the private drive easement. The Tualatin Valley and Tigard Water District has proposal reviewed this proposal an hasl of f ered the following comments: The applicant should be made aware of the following requirements; 1) A plan showing fire hydrants shall be submitted to Tigard Water District. 2) The District will require a fire hydrant at the entrance of the private drive. 3) Fire hydrants are required within 500 feet measured around the outside and along accessways of all buildings. The City of Tigard Public Works, School District #23J, Portland General Electric and Northwest Natural Gas have reviewed this proposal and have no objection to it. No other comments have been received. ACT I - FINDINGS AND 'rmagamitE= Minor Land Partition Section 1:1620 0 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City ° s Comprehensive Plan; The proposed pa complies with all statutory and ordinance requirements and regulations; Adequate public facilities are available to serve the proposal; NOTICE OF DECISION MLP 93 -0011 m WOODWARD / NtMONAGLE r.1? 06 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83-52) The subject site conforms with the City's comprehensive plan in that each newly created lot will allow for a single family residence. Therefore, this site is presently not in conflict with the Low Density Residential comprehensive plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve 1 he proposal. Section j.II ..5Q .050 contains the applicable size and dimensional requirements. After conducting a site visit of the subject parcel, planning staff found the site to contain an accessory structure that was not shown on the preliminary site plan. Planning Division will thus require the applicant to submit a revised site plan that includes the accessory structure, its size and setback from the property line Section 18.162.050 states that each lot created through the process shall front a y partition p public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. The preliminary partition plat demonstrates that all the lots will meet or exceed this requirement. Section 18..88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy source s b y providing for improved acces... s to o sunlight residential Code Section 18.88.040(E), allows the approval authority to exem pt ne w lots from the solar access standard in certain cases, including NOTICE OF DECISION MLP 93 -0011 - WOODWARD / McMONAGLE Page 4 • situations in which existing road patterns must be continued through the site or must terminate on-site in a way that prevents given streets, or lots in the development, from being oriented for solar access. Given existing street orientation and the configuration of the subject site, compliance with applicable road standards prevents the proposed parcels from being oriented for solar access. Therefore, all three parcels are exempted from the solar access standards. gjionsi8. 164. 30. (Streets), 18.164.090 (Sanitary Sewer) , and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The site is located on the east side of S.W. Brookside Avenue, between S.W. Johnson and Walnut Street. S.W. Brookside is classified as a local street. S.W. Brookside Ave., along the frontage of the site, has 25 feet of right-of-way and is fully improved except for sidewalks. The applicant is proposing to access the site with a private drive from S.W. Brookside. The proposed private drive meets or exceeds current standards for this size of development. In addition, the applicant has previously applied for and has received approval for a "Street Opening Permit", through the Engineering Department, to construct the private drive. 2. Sanitary Sewer: Currently there is an 8 inch public sanitary sewer line located at the north edge, and within the eastern portion, of the proposed development. The applicant is proposing to connect Parcel 1 and 2 to the public line located on the eastern portion of the site No other improvements are required. 3. Storm Sewer: The site slopes towards .Lhe north, The applicant should be required to provide positive drainage of the newly created lots through the proposed private easement to the public storm sewer system located in S.W. Brookside. Re small sites would result in numerous facilities t hat would become maintenance burden to the City. Furtheraore , the applicant has not proposed any such facilities and there no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in -lieu of construction of these facilities, would provide, the required treatment with improved maintenance. Therefore the applicant reliability and less l�.c should be required to pay the fee in -lieu of constructing an on -site facility. ECTION. Findinas�° 1. Streets: The site is located on the east side of S.W. Brookside Avenue, between Johnson and Walnut. S.W. Brookside is classified as a local street. S.W. Brookside Ave., along the frontage of the site, has 25 feet of right-of-way and is fully improved except for sidewalks. The applicant is proposing to access the site with a private drive . from a S W . Brookside The proposed private drive meets or exceeds current standards for this size of development. In addition, the applicant has previously applied for and has received approval for a "Street Opening Permit", through the Engineering Department, to construct the private drive. 2.
