These criteria are. 1. The proposal conformed with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations 3. Adequate prjblic facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements' of this title, and 8. All proposed improvements meet City and ap licabte agency standards. The proposal minor p partition approval criteria of Section 18162040 (Partition Approval Criteria). This proposal also conforms with the City's Comprehensive Plan and complies with all statutory and ordinance requirements and regulations. Adequate public facilities aro available to serve the two percale. All proposed lots conform to the size and dimensional requirements of this title. There are no improvements currently proposed for this site. Solar Access: Code Section 18.88 states that all newly created lots within th&. City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. Vim front property lines of these three proposed lots are aligned with the existing north- south orientation of SW Hall Boulevard. Therefore, they are not within 30 degrees of a true east-west axis which is required in order to comply with the base requirement. The north -south lot dimensions of the two proposed lots is greater than the required 90 foot minimuttt. Since both of these requirements have not been satisfied, neither of these two lots meet the base requirement of this section. The orientat.kon of these lots is subject to the existing alignment of SW Hall Soule ;yard from which these parcels must gain access This alignment will not permit the front property lines to be oriented within 30 degrees of a true east -west axis. As a reeult, these two proposed parcels shall be adjusted out from this requirement as per Section 18.88.040(B). Therefore this code requirement has been satisfied. Building Setback: Code Section 18.54.50 A.3 states that for a single family dwelling the front yard setback shall be minimum of 15 feet, the side yard setback shall be a minimum of five feet, the rear yard setback shall be a minimum of 15 feet; and the distance between the property line and the ,front of the garage shall be s. minim*nn of 20 feet. The existing development on the northern parcel conforms with this code requirement. All future development on these two parcels shall comply with the current setback standards. At se sampling sites where such a combination of mandatory criteria were found, area and adjacent t i what be wetland on the basis of being in a depressional the site was determined to basis o is probably a more typical wetland situation (the area to the east). 3.0 SITE CHARACTERISTICS 3,1 Topography and Geomorphology The topography of the site can generally be characterized as a broad, gently concave swale that slopes slightly toward the west. A small, narrow ditch is found intermittent of the swale. The site is located near the lower segments of a e, itte t stream corridor that originates in an area that is virtually entirely developed (Figure 1). Generally three dominant species (greater than 20 percent areal plants were found at most of the sampling locations: Columbia brorne (FACU), slough sedge (OBL), and dense sedge (OBL). 4.0 DISCUSSION AND CONCLUSIONS Based on an August 1981 1 :58,000 scale color infrared aerial al ph oto graphy, the U.S. Fish and Wildlife Service has identified wetland on the site as part of the National Wetland inventory (NWI) program (Figure 3; Beaverton, Oregon quadrangle 1:24,,000). However, it is our opinion that the NWI designation of is in error.
