FINDINGS AND CONCLUSIONS: The findings and conclusions on which the decision is based are noted below: Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the lot line adjustment„ and thL existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district, 2. ley reducing the lot c ize, the lot or structures (s) on the lot will not be in violation of the site development or zoning district regulations for that district, and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district The pr■po'od lot line adjustment i consistent with these standards. No new lot would b , created through the adjustment. The minimum lot size of 1,400 square feet per multi- family unit is satisfied. Lot Width: The minimum width of the building envelope area shill meet the lot requirement of the applicable zoning district B. Lot Area The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public: right-of-way by at least 15 feet or have a legally recorded minimum 15 ;Foot wide access easement. D. Setbacks Setbacks shall be as required by the applicable zoning districts E. Front Yard Determination for Flag Lot: Whem the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less thln 10 feet, Structures shall generally be located zo as to wansimize separation from existing structures. F. Screening on Flag Lots A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation area for proposed development. G. INFORMATION SUMMARY In 1989, the Director approved a Site Development Review application to construct a 94 unit apartment_ complex (Oak Tree Apartments, SDR 88-26) subject to conditions. One condition required the dedication of the ravine area located is the southern portion of the property. The complex has been completed and the ravine area was dedicated to the City. Following, a survey of the project, it was discovered that one building complex cov ' ' � in the com le.� ,� ©es not meet C.�.ty setback standards due to the greenway dedication. Also, private storm and sanitary sewer lines are located within the greenway area without easements being retained to give the apartment complex owner the legal right to maintain these lines on City property.
