Background The subject lots and the access tract were created through the recently platted Settler Park Subdivision. The Planning Commission reviewed and approved the preliminary plat for Settler Park subdivision on December 5, 1989 (8 89- 10 /PD 89 -03) . No other previous land use or development applications regarding these parcels have been reviewed by the City of Tigard. Vicinity 'Information Properties surrounding Settler Park Subdivision are developed with single- family residences and are zoned R -3.5 (Residential, Y _ - k to the east, west, and 3.5 units/ acre) taat+h�i north and R '7 (PD) � Y south. Proposal Description The applicant, Royal Oaks Development Company, proposes to adjust the to cation of Tract A, five feet to the west in order for a sidewalk to be tnstalled on the west side of the private street rather than on the east: side as originally planned. All five lots mbutting the tract will have th = it dimensions slightly modified through the proposed reconfiguration of the access tract. The reconfiguration of the access tract has been n cesaitated by construction on Lot E. The home currently un4er construction is located within five feet of the existing eastern edge of Tract A, whereas a ten foot corner yard setback is required on this corner. lot. The applicant and the building plan reviewer apparently considered the west side of the house to be a aide yard, rather than a corner lot side yard, because the road within Tract A serves a limited number of homes and is a primate street. The Planning Division has previously determined that the corner lot setback applies to yards fronting on private streets as well as lots fronting on public streets. 4. Agency and NPO Comments The Engineering Division has reviewed the proposal and offora the fa, flowing comments: 3 The approved set of plans for Settler Park subdivision pla ed the required sidewalk for the private street on the east side of Tract A. The sidewalk has not yet been installed. Roadway, curbs, and utilities are in place. 2. Thee are no City sewers along the property lines which are proposed to be relocated. NPO #6, the City of Tigard Building Division, Portland General Electric, and Tigard Water District have reviewed the proposal and have made no comments or objections. No other comments have been received. ANALYSTS AND CONCLUSION Community Development Code S& .ion 18,162.060 (1.1t Line Adjustment- Approval Standards) cocitaine the applicable standards of approval: 1. An additional lot is not created by the lot line adjustment and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the aproved zoning for that district. By reducing a lotto size,, the y >at or will rot i;t74 in violation of the Site district regulations for that district. Because the properties are located within the Planned Dev- :lopment overlay district, each lot need not meet the minimum lot size of the underlying R -7 zone. Instead, the averave lot size of all lots within the development must meet the 5,000 s clua re foot minimum lot size Estandard of the R.-7 zone. The average lot size of the lots in Settler Park Subdivision will not be ffected by the proposed adjustment. No structure's setbacks will be adversely affected by the proposed lot line adjustment. The only structure on any oi: the impacted lots !Ls on lot 6. The lot line adjustment is proposed in order to abate a setback violation on that lot. Adequate public facilities are av- ;ilable to serve the proposal. 4 All proposed lots conform to the size and dimensional requirements of this title 5. All proposed improvements meet City and applicable agency standards. The proposed lot line adjustment is conai -tent with these criteria. The propceed lot configurations conform with the City's Comprehensive Plan and comply with all statutory and ordinance requirements. The resultant parcels will conform with all applicable dimensional requirements of the Code. No public improvements are proposed as part of this application. Public improvements are already in place along the privete aecess tract. Easement, are in place for these public facilities; the easements will remain in place after the adjustment. .
