He questioned the real significance of .. „ the zone r4-mange from M3 to M4, but asserted the Fasaxio standards are met in ,this while, 1-:', , case. He pointed out that .chile, as paragraph 2 of the Staff Recommendation states, "The structure is encroaching into the greenway, which violates the City's • Open Space Ordinance", Jection 18.57.041 (1) provides for an exception process for structures, and he submitted the proposed plan is an architecturally sound design j 'J_: in an area zoned for the intended use There was no PUBLIC TESTIMONY. `,•,, COMMISSION DISCUSSION AND ACTION s Extensive discussion took place a z';;ng t.,' the Commissioners and Staff. Howard emphasized the precedent that allowing even l;;: ,, ?$ . this small encroachment on the greenway would establish, and pointed out the ,'.: ., imprecise nature of the data on flood levels, Fund, Wood, Speaker and Kolleas opposed the recommendation for denial. Wood outlined the reasons for the recent change in the floodplain ordinance which permits certain encroachments. Tepedino ;, suggested consideration of alternatives such as two stories, rearrangement of utilization of land above the floodplain, compensating excavation to preserve :o' flood storage capacity, etc. t }te The President asked Commissioner Wood if he could frame a motion with conditions suggested by the preceding discussion. At this point Selby offered suggested conditions appropriate to an approval of the applicant's request. 1 Wood thereupon MOVED for preliminary "'len approval of ZC 251-,79PD and a` Special, Permit M 7-79 based on findings that the applicant has demonstrated '`t. that the design of the building is compatible with the greenway plan of the i City in the c'ntext of a planned unit development. OLD BUSINESS: Howard presented the problem of Mr. Jack St. Clair, owner of a 100 x 100 foot lot at Hampton and 67th AVenue. According to Mr. St. Clair, the property was zoned C-1:' in 1975. As a member of NPO 4 he opposed the provision ,. for "discouraging" developments on parcels of less than one acre. His point ig i,.. that his property was alveady zoned C-P when the neighborhood plan was adopted, and he felt in view or the grandfather-type situation of his property, he would , . be allowed to develop under the ordinance establishing the zoning. The City ki Attorney when asked said he had the right to deve)op under his prior zoning, The 1 Planning Director, however, tinder date of duly 2, wrote him that "the Comprehen- sive Plan takes precedence over existing zones", and since Lhe NPO plan "discouraged" " *. development of less-than-one-acre parcels, his request for development was denied. There was considerable discussion of the problem of aetting numerouki owners of 2500-foot iota to cooperate Li developing parcels or an acre or more, I.. In order for Mr. St. Clair to obtain a decision by th4 City Council, where f he felt this matter would have to be settled,' Speaker MOVED the Planning Commis- sion sustain the Planning Director in the position he took in his aely 2 letter .. to, Mr. St..
