E. Klock and Son Construction Company for construction of a sidewalk and curb along Scoffins Avenue for the new Post Office site. At the meeting, reference was made that this item would not have come up at a late date if regular procedures had been followed and plans had been submitted to the City for review. This was requested so that the City of Tigard could provide contractors with estimates of neces- sary fees prior to bidding. h. 10 September 197 Request by Mr. Heibert to modify storm sewer connection. � . 19 September 197 Letter to Mr, Bruce Clark regarding storm sewer connection at manhole in street. j. 15 October 197 Meeting at the site with Mr. Heibert to discuss finish grades at the new driveway to Scoffins Avenue. W. 97th Avenue, Tigard, Oregon 1, CALL TO ORDER Chairman Whittaker called the meeting to order at 7:30 p.m. 2. ROLL CALL Commissioners` present: Ball, Hansen, Popp, Porter, Sakata, Wakem, Whittaker. Staff represented by Powell and City Attorney Anderson 3. MINUTES The minutes o:(,;' the April 15, 1975, meeting were considered. Wakem asked that they be amended to show that at item 4.2 he had abstained and' that item 4,3 had been tabled by a 5 to 4 vote. The' minutes were then approved as read,. 41 COMMUNICATIONS o Staff asked that the agenda be amended to delete items 4.3 and 4.4. o Chmn. Whitaker discussed the Council's actions with respect to those revisions of the C-3, General Commercial Zone, recommended by the Planning Commission. The Commission concensu.s was to ask that the additional provisions (separating the Main St. zoning from Pacific Hwy. zoning and the 750 ft. distance from schools for high traffic generators) be set for hearing at the net Planning Com-- - mission meeting. o Ball moved to schedule future hearings for 7:30 instead of 8:00, seconded and carried. . , 0 Ball asked that a City Attorney t s opinion be made available to the Planning Commission on the recent court cases of Dag (Appeals) , .. eg supreme Court) . Staff explained that the post office had not applied for any review of the project and the first official contact had recently occurred with • respect to this particular problem. The contact had occurred , - when the City had required a street opening permit. Porter moved to table the matter, directing staff to discuss it with the Postal Service. Second (Wakem) , carried. 4. PUBLIC HEARINGS 4.1 Zoning Ordinance Amendment ZOA 2-75 - , A proposed amendment to Sections 18.04.011 (conditional uses) • and 18.40,070 (signs) in the chapter dealing with the Commercial- , Professional zone, Commissioners Wakem and Ball announced they felt they had a con- ', flict of interest and asked the chairman's permission to abstain _..3 from participation in discussion and voting on this amendment. Chairman Whittaker granted that permission. A. Staff Report Powell read staff findings and the proposed text changes with an alternate wording of 18.40.070 (1)(a) . B. Public Testimony 0 Lynn Wakem (representing Farmers Insurance Corp. ) said that the company had studied the proposal and • favored it. o Bill Flattery (Lincoln Properties) stated that he felt the proposed ordinance amendment was still not adequately addressing Lincoln Properties ' needs. o Bill McMonagle asked if variances would be necessary in order for a developer to exercise his options under paragraphs requiring Design Review Board approval. III • o Staff said that variances would not be necessary for • the forseeable project. C. Commission Discussion and Action c Sakata moved to adopt as amended. OTHER BUSINESS o Mr. Bruce Samuelson, representing Boles, Maguire and Hoch, architects for the Postal Service building, had not been present when the matter of that building and the Scoffins Street improvements had been brought up. He asked to ex- ' - plain the architect's concern about the matter. • o Chairman Whittaker said the matter had been tabled but that it could be reopened. o Mr, Samuelson said the first four items were reasonable requests and were already covered by the construction contract, but that #5 (rock and pave area between proposed curb and existing road surface. . . ) was not the contractor's, nor the Postal Service 's responsibility. He said that in a discussion he had had with the former Public Works Dir. he had been told the grade of Scoffins St. would be changed anyway and that they need not pave the area, o Whittaker asked how large the area in question would ba. • o Mr. Samuelson replied about 9 tu,--6 by 100 feet. o Ball asked for the contract provisions. o Motion to approve (Popp) Public Works recommendations #1 through #4 and refer #5 to the Director of Public Works for his action. o Motion died for lack of second. o Motion (Ball) to refer the matter to Council with a recommendation that the public works recommendations be followed. o Second (Wakem) o Carried, Popp against; 7.
