We are in the process of preparing a pamphlet to be dis t ibuted to all local authorities and the railroads , containing an explanation of the PUC laws , rules and regulations pertaining to railroad crossings , sample forms , and answers to what we feel are common questions It will take some time to prepare this document, however, and for the present, I would like to summarize the situa tion regarding railroad crossings and public authorities . The law relating to railroad crossings, which will be . effective October 5, 1973, does several important things : (1) The law removes city jurisdiction over the blockage of public crossings by railroad. equipment. PUC jurisdiction is substituted. (2) The law expands the Commissioner's jurisdic- . ti on over railroad train speed from the existing authority over cities of less than, ► on to include all public 180, 000 population p crossings in the state. I mention this to public authorities because I am sure that 4 you are all aware that private crossings account for a fairly large proportion of the injuries and fatalities at grade crossings , due primarily to lack of public awareness that these crossings here cro are private and liability and protection may be limited, (5) The policy statement adopted by the Legislature is as follows : "It is the policy of this state to achieve uniform and coordinated regulation of railroad-highway crossings and to eliminate crossings at grade, wherever possible. To these ends, authority to control and regulate the con struct on, a. , pration and protection of railroad highway crossings is vested exclusively in the state and in the Public Utility Commissioner, as provided in this Chapter. v of �. t creation(G,, And perhaps the most important, the creat . a State Grade Crossing Protection Fund. In cases where protective devices are installed at existing crossings , or at new crossings requested by railroads, all maintenance cost will he borne by the railroad. In those situations where _a public authority requests a. totally new crossing that is to be signalized, the cost of maintaining • this signal device will be borne by the railroad, The law provides for some interim orders to allow construction of projects prior to final determination of costs , and the law also provides that federal funds, a',ailable specifically for the elimination of hazardous grade crossings , will be used before any Grade Crossing Fund mo ne y is s used. Anothc r feature of the Fund proposal is that it allocates $1.00 ,000 per year to be used in the reconstruction or alteration of existing grade separation structures . The exact procedures and applications under the Grade Crossing Fund will be a subject of the pamphlet described earlier. I think a policy statement is needed now. While the bill contains no language as to the priorities for crossing protection projects , testimony in front of the Legislative Committees was, and the intent . the Legisla- ture is that Crossing Protection Fund money be expended ' on some rational priority basis . Given that set of standards , I will soon be instructing the PUC Railroad Division to pre- pare a preliminary 1�s � of fund-eligible crossings. Beyond that I have instructed them to start a proceeding to develop fund-eligible crossing lists. Initially, protection projects will not viewed strictly on a first-come first-served basis envision that once a list of eligible crossings is prepared, those crossings will be protected and funded on a first-come first-served basis. As you can see, much went on in the 1973 Legislature that affects public authorities and railroad crossings . I know that this letter has probably raised as many questions as it has answered.
