SUMMARY OP THE REQUEST The applicant requests approval of a preliminary plat to subdivide a L28-acre pared into 4 lots ranging from 8500 to 10,500 square feet. The applicant proposes to construct a private drive along the east edge of the site to serve the lots. The applicant also requests approval of a variance to mate a lot with only 15 feet of frontage on the private street, rather than 25 of frontage feet as required by code. Staff recommended conditional approval of the subdivision and denial of the variance. At the hearing, the applicant accepted the recommended conditions of approval and argued in favor of the variance. One neighboring property owner testified with questions. The Hearings Officer concluded the variance should be denied, because the applicarit did not show that there are special circumstances or conditions affecting the property that are unusual and peculiar to the property compared to other lands similarly situated. However, the Hearings Officer also concluded the subdivision should be approved with Certain changes to the preliminary plat and subject to the conditions recomnended by staff with one change. Because the Staff Report to die Hearings Officer so closely parallels the firtdings, conclusions, and decision that the Hearings Officer would make, this Final Order incorporates by reference much of that Staff Report, a copy of which is attached, rather . than restating its contents.
