Back round In February, 1981 the City approved a Zone Change from R-7 and M3 to M3(PD) with conditions relating to the development of the property (7CPD 13 SO/Ord, No 81-03). A revised proposal was reviewed in September, ) 1081 and was denied for lack of adequate information (PD 25-81/M 5-81) . 3. The subdivision is intended to be developed in two phases with lots 11, 12, 13, and 14 in the first phase served by a temporary cul-de-sac. The proposal will require a Sensitive Lands review since fill ;And grading are necessary to raise portions of the lots and the street above • the 100 year flood plain, If the preliminary plat is approved, a Sensitive Lands Permit must be requirC as a condition of appoval. The outcome of the review may require some modification of the preliminary plat, The street which ends at the -ailroad right-of-way is to be extended to join Tech Center ..rive which presently ends on the opposite side of the tracks. Another street is proposed to extend from the railroad crossing to : the northern property line, near the northwest corner. The Comprehensive Plan calls for future street connections between Bonita ' Road, Tech Center Drive, Hunziker, and Hall. Blvd. 5. If the Sensitive Lands permit is approved, provisions for the pedestrian/bicycle path will be made along Fanno Creek. 4, Policy 6.6.1 will an l be met because Fanno Creek and the flood plain area provides natural vegetation between this project and the residences to the south and west. Also, when each of the lots are developed, landscaping will be required as part of the Site Development Review process. 5. Policy 7,1,2 is met since adequate water and sewer (sanitary/storm) facilities are available. 6, Policy 8.1.1 is satisfied because the two street extensions at the north erd of the project are consistent with the street system contemplated in the Comprehensive Plan. The applicant 'Mall be responsible for a portion of the railroad crossing to Tech Center Drive. • 7, Policy 8,1.3 will be satisfied because the necessary right—of—way dedication and street improvements shall be a condition of final plat approval, The Planning Commission has determined that the proposal is consistent with the relevant portions of the Community Development Code !lased upon the findings below: 1, Chapter 18,70 is satisfied because the proposal meets the minimum lot size and other related requirements of the I—L zone, 2,. Seven (7) sets of plan-profile public improvement construction plans and one (1) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Section for approval. Sanitary sewer plan-profile details shall be provided as part of the public improvement plans. 5. Construction of proposed public improvements shall not commence until after the Engineering Section has issued approved public improvement plans. The Section will require posting of a 100% Performance Bond, the payment of a permit fee and a sign installation/streetlight fee. Also the execution of a construction compliance agreement shall eccur prior •to, or concurrently with the issuance of approved public improvement plans. SEE THE ENCLOSED HANDOUT GIVING MORE SPECtFIC INFORMATION REGARDING FEE SCHEDULES BONDING AND AGREEMENTS. 6. A one (1') foot reserve strip granted to the "City of Tigard" shall be previded at the terminus of the proposed roadway. Also, a temporary turn around shall be provided which meets the approval of the Tualatin Rural- Fire Protection District, 7. Additional right-of-way shall be dedicated to the Public along the S.W. Bonita Road frontage to increase the right-of-way to ao feet from centerline, The description for said dedication shall be • tied to the existing right-of-way centerline as established by • County Survey #20,38/. The dedication document shall be on City forms and approved by the Engineering Section. DEDIWTION INSTRUCTIONS ARE ENCLOSED. 8. Street Centerline Monumentation 1, In accordance with ORS 92,060 subsection (2), the centerlines of all street and roadway right-of-413ays shall be monumented before the Citt11211Reseptteeeltrket improvement. 2. The plan has been under consideraion for some time and a portion was once approved by the Tigard Planning Commission.. Adjustments have been made to comply with planning, zoning and physical requirements. Results of consultations with the City Of Tigard Public Works and planning were incorporated in this final design. Portions of the street improvements and lots lie within the 100 year flood plane area. Improvement of the channel way would be made increasing the flow through this area. Storm flood studies per rformed by the City of Tigard on Fanno Creek i r;di cate increased flow tiiirough this area is desirable. The project is designed to fit street patterns to the North and East. The Easterly connection involves a railroad crossing construction and connects to the Tech Center Business Park street pattern, The rail- road crossing will be developed in conjuction with Tech Center Business Park. The Northerly connections will, open up street development to Northerly Properties. The impact on adjoining areas will not be adverse, but is a furtherance of the pl an for this area The project will continue development planned for this area and be an importatnt part of this Bevel optlent. Subdivision of Land is defined as the division of land into four or more lots within a calendar year when such area or tract of land exists as a unit or contiguous units of land under a single ownership at the beginning of such year (See ORS 92.010 (12)) B. The subdivision of land, is governed by ORS CH. 92 and the Community Development , Code Title 18. These documents should be examined prior to the negotiation to sell any land and prior to the submission of an application. C. The application and approval process consists of the following three steps: 1. Preapplication Conference Prior to the submission of a preliminary plat, the applicant must make, an appointment with, the Planning staff to discuss the proposal as it relates to the applicable requirements. 2. Preliminary Plat Approval Preliminary plat approval involves a public hearing before the • Planning Commission. The Commission will evaluate the proposal as it relates to the applicable, provisions in the Plan and the Code, and the preliminary plat will be approved, approved with conditions, or denied. 3. Final Plat Approval The final plat will be reviewed ; by staff for compliance with the preliminary plat approved or approved with conditions by the Planning Commission.
