However, City records do not indicate that this was ever -Finalized, This issue should be resolved before the final Oat is recorded. Because of the existing Street improvement, including sidewalk • that exists along the frontage of 97th Avenue and the western 150 feet of McDonald Street, a 5-foot wide public roadway easement will be acceptable. The remaining frontage on McDonald Street should meet the right-of-way requirement of 80 feet from centerline, c, Assessments are outstanding on the property for the McDonald Street Sanitary Sewer LLD4 and the Tigardville Heights Street LLD, An agreement has been reached to allow for payment of the remaining balance at the time of plat approval, d. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Statewide Planning Goals 1, 2, and 10; Tigard Comprehensive Plan policies 2.1.1, 3, 1.1, 7,2.1, and 8.1,3; and Chapter 19.50, 18,84, 18.134, and 19.160 of the Community . Development Code, • The Planning Commission concludes that the proposal is consistent with the applicable Statewide Planning Goals and Guidelines based upon the following findings: a, Statewide Planning Goal #1 is met because the City has adopted a ' Citizens Involvement program including review of all development applications by the Neighborhood Planning Organization (NPO) . In addition, all public notices requirements were met. b, Statewide Planning Goal #2 is met because the City applied all • applicable Statewide Planning Goals, City Comprehensive Plan 0 Policies and Development Code requirements to the application, • c. Goal #10 is satisfied because the proposal will provide for housing as contemplated by the City Comprehensive Plan. 0 The Planning Commission has determined that the proposal as submitted, or with minor modifications, is consistent with the relevant portions of the Comprehensive Plan based upon the findings noted below! a. Plan Policy 2.1.1 is satisfied because the Neighborhood Planning Organization and surrounding property owners were liven notice of the hearing and an opportunity to comment on tile applicant's proposal, . , b. Plan Policy 841.3 will be satisfied if the plat is modified as suggested by the Engineering Division to includ0 a combination of permanent roadway easements, right-of-wa1,1 dedicwtio •, and street ,.. improvements. Said improvements along SW 97th Avenue shall be built to minor collector street standards and conform to the alignment of existing street improvements there aIong 4. Five (5) sets of plan-profile public improvement construction plans and one (1) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the engineering Section for approval, 5. Sanitary sewer lateral (plan-profile) details, for provision of seWer service to each lot, shall be provided as part of the public improvement plans, 6. An easement or similar arrangement will be necessary to accommodate the swimming pool which straddles the property line b, between Lots 1 and 2. • b. The dedication of right-of-way along McDonald,;,,Streit and 97th Avenue was intended to be accomplished as part of the L.I.D.. However, City records do not indicate that this was ever, A , finalized. This issue should be resolved before the final plat is recorded. Because of the existing street improvement, including sidewalk that exists along the frontage or 97th Avenue and the western 150 feet of McDonald Street, a 5 foot wide public roadway easement will be acceptable. The remaining frontage on McDonald Street should meet the right-of-way requirement of 30 feet from centerline. • c. Assessments are outstanding on the property for the McDonald " Street Sanitary Sewer L.I.D. and the Tigardville Heights Street L.I.D.. ' An agreement has been reached to allow for payment of the remaining balance at the time of plat approval. d. The proposed building sites will avoid the drainageway and the portions of the property that exceed a 25% slope. However, because of the close proximity of the sites to the steep slopes • areas, soils and foundation reports should be submitted prior to receiving building permits. If the reports indicate that landform alteration will be necessary within the drainageway or area ever 25% slope, a Sensitive Lands permit will be required. McDonald St. with S.W. 97th Ave. and contails approximately 1. 06 acres; sufficient area for six lots under the R-4 .5 zoning that has been applied to the area. • The variances consist of the establishment of lot areas of 7,125 sq. It for Lots 1 and 2 of the proposed subdivision instead of the required 7,500 sq. ft. VARIANCE APPROVAL CRITERIA A. The proposed Variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the . Comprehensive Plan, to any other applicable policies and sGand- ards; and to other properties in the same zoning district or vicinity; hESPONSE 0 , There will be no detrimental effect to the purposes of the Development Code from approval of this request nor.will such approval conflict with the policies of the Comprehensive Plan or with any other applicable policies or standards. Neither will such approval compromise other properties in the vicinity. The Comprehensive Plan designates the subject property as being within a Low Density Residential Single Family district which is zoned R-4. 5 with a minimum lot area of 7,500 sq. ft. The combined area of the two tax lots comprising the property to be subdivided, is 46,250 sq. ft. ) or slightly more than 1. 06 acres . The overall density of the proposed six-lot subdivision provides an average area of 7,70U sq. ft. per lot - about 3% larger than the required minimum - which is a fact that must be considered as meeting the spirit of the Comprehensive Plan, even though Lots 1 and 2 fall short of the letter of the arza reqUir . ments of the R-4 .5 zone. The reduction in area for each of these two lots is about 5% of the required area per lot, but they have been laid out with increased widths to partially compensate for this loss of area. In the case of Lot 1, the width and depth t are 95 ft . and 75 ft. , respectively, providing yard setbacks for an existing residence that are above Code minimums. Sim- ilarly, the width and depth of Lot 2 are 75 ft. and 95 ft. , respectively, again providing front, side and rear yards greater than required by the Development Code. No other policies or standards are applicable to this site and there will be no detrimental effect to other properties in the vicinity since the requested variances impact only two lots within the proposed subdivision. B. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district. -0 RESPONSE The site is bordered on the north by S.W. McDonald St. and on the west by S.W. 97th Ave. These frontages measure 295 ft. and 150 ft. , respective1y, with the depth along the easterly border expanding to 170 ft . A well-defined drainageway enters the property near the mid-point of the southerly boundary, traver- ! ses the site and exits just south of the mid-point of the easterly boundary. An existing single-family dwelling occupies the north- westerly corner of the property along with a lanai and svimming pool. These circumstances, which are unique to the site, combine to create a situation where, if the requirements of the Develop- ment Code were strictly applied, only five lots could be created with each of them being 20% crSize and wasteful of the land resource. Mitigation of these factors is beyond the control of the applicant and none of them is applicable to other properties in the district. O. The use proposed Will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic uso of the land. RESPONSE The proposed use of the subject property is in conformance with the Development Oode which provides that the site may be developed with single-family residences on 7,500 sq. ft. lots. As stated above, the average net lot area for the subdivision is in excess of 7,700 sq. ft. and all City standards will be maintained, excluding those that are the subject of this request. D. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the develop- ment were located as specified in the Code. RESPONSE Approval of this request will not adversely affec',-, any existing physical and natural systems, including traffic, drainage and land forms . As stated previously, reduction of the area for Lots I and 2 is an accomodation of physical limitations on the site and will not increase the overall density of development or runoff generating surface above that allowed by the zone. Furthermore, grading for new structures will occur away from the aforementioned drainage channel and will not markedly impact the existing land form of the site E. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. RESPONSE p The constraints upon this site which necessitate this request were not created by the applicant; the drainageway is a natural landform and the two tax lots with their inherent dimensions were created by others. In addition, at the time the applicant first proposed subdivision of the property and made inquiry to the City, a moratorium had been placed on creation of new subdivisions pending adoption of the current Development Code, even though the superseded Code was still in effect at the time. From the above, it can be determined that the requested variances meet the criteria for approval and that no detrimental effect will ensue from such approval, either to the purposes of the Development Code or to the policies of the Comprehensive Plan or any other policies or standards. The circumstances that com- bine to necessitate the request for variances are unique to the subject property and were not created by the applicant, nor are they subject to mitigation by the applicant. The use proposed will be the same aa that allowed by the Development Code and there will be no adverse effect to existing physical and, natural systems, since there will be no increase in overall density as a result of approval of the request. The variance request should therefore be approved. With approval of the requested variances, the proposed sub- , division can be approvod as submitted. Services are available to the property through the City of Tigard (water, schools, parks, police) , Tualatin Rural Fire District, The Unified Sewerage Agency of Washington County, Tri-Met (Line 43) , Portland General Electric Northwest Natural Gas Co. , and General Telephone Co. Both 97th Ave. and McDonald St., are paved, but have been designated as Major Colleutor reets and will be widened to suit that status at some future date. The drainageway through the property provides for storm water 7 Lk disposal and it has been determined that the site contains no 5,A.AkiwO sensitive lands. .
