Monahan July 15, 1986 Page Two As shown by the map, the road which loops from Morninghill through a section of Bellwood and back into Morninghill is the only, means of access for Lots 7-14 of Bellwood. This is the access which was approved by the parties and the Tigard City Council. Nevertheless, Morninghill has now been developed without any provision for such access. Obviously this is a serious matter as it would leave Lots 7-14 of Bellwood landlocked and unable to be developed until the situation is corrected. We therefore must insist that the City of Tigard refrain from recording any for Morninghill y plat g l which does not provide the access discussed in this letter, and that the City advise the owners of Morninghill that any development of its property must provide access to Bellwood consistent with such documents. Although our client would prefer not to initiate legal action, it will not hesitate to do so unless this matter is satisfactorily resolved in a very short Perie'..14 of time. Our clie&zt was just in the process of closing a large transaction including the transfer of the Bellwood property when development of the Morninghill property came to light, and the problem threatens the entire transaction.
