BACKGROUND/PREVIOUS ACTION: On May 19, 1930, the Tigard City Council approved a Comprehensive Plan Revision from R-7 Single Family Residential to A-20 PD "Multi-Family Planned Development" for the subject property. On July 20, 1980, the Tigard Planning Commission approved the Preliminary Plan for Phase I with conditions and gave te L. ative approval to the concept of cottage housing in an A-20 zone. On October 11, 1982, the Tigard City Council adopted a final order approving Phase I of London Square with conditions. AREA CHARACTERISTICS: The property to the uorth and east is designated for Eingle family residential development on the Comprehensive plat. The property to the west is vacant and is designated medium on the Comprehensive Plan. The Southern Pacific Railroad borders the property along the south. The street improvements to Phase I are almost complete and Construction is nesAy complete On two homes in Phase I. / ' ‘, . SITE CHARACTERISTICS: The remainder of the site is vacant,, slopes to the south, and is grass covered with some pine and oak trees. APPLICABLE COMPREHENSIVE PLAN POLICIES: , 2.1.1 The City shall maintain an ongoing %....tizen involvement program and shall assure that citizens will be provided an opportunity to be involved in all phases of the planning process. . Notices were sent to all property owners within 250 feet of this application. A notice was published in the Tigard Times on. April 21, 1983. In addition, NPO # 2 has been notified of the application. 6 2.1.3 The City shall ensure that information on land use planning issues is available in an understandable form for all interested citizens. All interested parties are given, at a minimum, 10 days to respond in writing to the application and request under consideration and are encouraged to do so. The planning staff is available to ` address any specific questions concerning the application or the application process. is 6.1.1 The City shall provide a,. opportunity for diversity of housing densities and residential types at various price and rent levels. Approval of this subdivision will provide 33 new building lots for single family homes. Lot sizes will range from 2400 to 3900 square feet. These lots will acccatmodate smaller homes which should be affordable to a greater number of prospective home buyers. 7.1 .2 The City shall require as a precondition to development approval that: a. Development coincide with the availability of adequate service ,. capacity including: 1. Public Water; 2. Public Sewer (New development on septic tanks shall not be allowed within the City); and 3. The applicant proposes to connect to an 8" publ.Lc sewer line in S.W. 95th Avenue. 7.6.1 The City shall require as a precondition to development that: a. The development be served by a water system having adequate water pressure for fire protection purposes; b. The development shall not reduce the water pressure in the area below a level adequate for fire protection purposes; and • c. The applicable fire district will review all applications. The Tualatin Rural Fire Protection District has reviewed the. project and submitted a letter (see attached) supporting the development with conditions which have been made a part of staff's recommendation. 8.1.3 The City shall require as a precondition to development approval that: ` a. Development abut a publicly dedicated street or have adequate access approved by the appropriate approval authority; b. Street right-of--gay be dedicated where the street is substandard in width; • c. The developer commit to the construction of the streets, curbs and sidewalks to city standards within the development; d. Individual developers participate in the improvement of existing streets, curbs and sidewalks to the extent of the development's impacts; e. Street improvements be made and street signs or signals be provided when the development is found to create or intensify , , a traffic hazard; f. "No parking" signs will be posted on the left side of the street. There is a public transit stop at the corner of S.W. Greenburg and SW 98th, north of the site. 12.1.1 The City shall provide for housing densities in accordance with: ao The applicable plan policies. b. The applicable locational criteria. c. The applicable Community Development Code provisions. The densty proposed in the development conforms to those set forth in the newly adopted Comrrehensive Plan policies, plan map and interim zoning map. TIGARD MUNICIPAL CODE PROVISIONS; 17.16.100 Tentative approval. a. Within sixty days of the date of submission of the preliminary plat the Planning Commission will review the plan reports of the agencies listed in. Section 17.16.090 and may give tentative approval of the preliminary plat as submitted or may modify the plat or, if disapproved, shall express the Planning Commission's disapproval and reasons therefor. ( b. No tentative plan for a proposed subdivision and no tentative plan for a major partition shall be approved iraless: 1. Streets and roads are laid out so as to conform to the plats of subdivision or maps of major partition already approved for adjoining property as to width, general direction and in all other respects, unless the City determines it to be in the public interest to modify the. street or road pattern. Berverton-Hillsdale Highway Portland, Oregon 97225 Phone 297-1493 A resubdivision of Lots 1 and 2, Greenburg Heights Addition located in the S.W. i of Section 35, T1S, R1W, WM, Tax lots 2200 and 2300, Tax Map 1S1 35 CD Each condominium unit is a detached structure with individualized receationai and open, space. The average lot has 1891 square reet of landscaping or open space. Because this development will cater to retirees, empty-nesters and single parents with small children there is no expected demand for grouped open space. Our market analysis has determined that our expected buyers would like their own small, private recreational or open space directly adjacent to their homes. Each of the detached units will be a cottage-style structure placed where the maximum number of trees can be retained. This site was originally approved for 54 units of standard apartment- 4 T style condominiums. The design was changed when it became apparent that nearly all of the trees would be cut down. Demand on or increased use of existing city recreational facilities, will be, less than if the use were for a "normal" single family development or standard condominium because of the targeted market to retirees or couples. There are no sensitive land forms within this development nor does there appear to be any impact on sensitive land forms outside of this site The internal traffic pattern, is dual access from S.W. 98th Ave. and S.W. Commercial St. London Court is a 32 foot, publically- , owned right-of-way with parking allowed on one side. The internal loop is 24 foot Wide , and allows one-way traffic with parking on one side. The external effects of this development will be to add traffic to S.W. 98th Ave. and onto Greenburg Road, Eventually, Commercial Street will be connected through to 95th and on to Mein. This development will create part of this neensary traffic link. Public Transportation facilities will hopefully be utilized at the intersection of Greenburg and 98th. Service there is Bus 45 from Oantebury Square to Portland and BUE1 77 from Lake Osw9go to Providence Hospital. A -1 ' /- Narrative - 2 The, proposed density is 33 units on 2.93 acres gross or 2. 16 acres net, deducting for all roadways public and private and for easements. This results in 15.28 units per acre net in an A-20 zone which would allow 20 units per acre. This site was originally approved for "standard" condominium units at a much higher density. The proposed ownership pattern is individual ownership of each home and lot with common ownership of the private drive from Commercial St. and the looped street. There is no proposed change of ownership patterns at a later date. The proposed development is in substantial conformance with Tigard®s Adopted Comprehensive Plan as it calls for higher density residential development and assures that natural features of the land are preserved. The land use is higher density than the surrounding neighborhood as recommended by the Comprehensive Plan but conforms to the single family nature of the adjacent properties and therefore maintains the existing character. The public benefit derived from this proposed use is to preserve many healthy, well-developed trees which would be destroyed with conventional higher density residential attached structures, and to provide an affordable style of single family home. The proposed location for this land use is specifically suited to this site because of the many desirable trees. The impact on adjacent homes will be very beneficial as it will maintain the single family character of the area, thus maintaining property values and lessening the impact of larger traffic volumes on this dead-end street. Deviations from City of Tigard standards are limited to the desire to site unattached single family homes separately and the r site size being less than four acres. An additional deviation to the standards for this zone would be the proposed setbacks shown on the preliminary plan. The Planned Unit Development approach in the correct vehicle for handling these deviations. The public will be better served by the use of individually sited cottages on this site as it will allow the developer to save the majority of trees on this site. Street, water and sewer improvements will be required to the interior of the site and will be accomplished with the development as required by City ordinances.
