PU-MNING Gentlemen: This refers to a six unit residential development now under construction at the end of .S.W. 98th Avenue by Century 21 Homes, Inc. and their plans for al additional 33 units east of the existing location. Upon inspection of the construction site, we find that the 12" storm drain at the end of 98th Avenue which collects roof and street runoff from the new area, discharges water into the railroad ditch through approximately 135 ft. of ditch beyond the end of the street. Although we are aware that the natural drainage in that area is toward the rei1roc4 we most strongly object to having water collected and dumped on our right of way at the end of 98th Avenue.as our ditch is close to the track, erosion could damage the track roadbed in the approximate three blocks the ditch is being used to transport this runoff, before it flows under the tack in the vicinity of 95th Avenue. In designing their storm drain system for the 33 unit develop- ment, we are asking that Century 21 Homes not u,se the railroad ditch between 98th Avenue and the railroad pipe, in the vicinity of 95th Avenue to transport water from this drainage system. The plot plan we submitted last week in- dicates a 14 '-4" rear yard and the oak tree is removed. . Since this is a deviation from the approved plat, I've , • been advised that the change needs -t;.o be approved by your department. , . Suite 112 Portland, Oregon 97225 Dear Mr. Oringdulph: As I recalled our conversation concerning the formation of a drainage district in order to pressure the railroad companies to install and maintain storm drainage facilities, it would be up to you to determine a district boundary, secure signatures and request, through the county, that a district be formed. The City staff would be willing to cooperate in such an effort and to work with the county and the railroads in making such a plan work. However, I do believe the ball is in your court as far as initiation is concerned, Until such time as a storm drainage district becomes reality, the requirements for on-site retention will remain. One other solution you might consider would be to contribute to a storm drainage fund, perhaps a 'charge in lieu of retention/detention" if you will . Q CITY OF TIGARD, OREGON RESOLUTION NO 82- i m A RESOLUTION OF THE TIGARD CITY COUNCIL ADOPTING FINAL ORDER IN THE CONSIDERATION OF CAMBRIDGE SQUARE, AN APPLICATION OF CENTURY 21 HOMES, INC. (PD 2-82 & S 5-82) : WHEREAS, the matter of Cambridge Square came before the Tigard City Council on September 27, 1982 for review and discussion by the Council of a Tigard Planning Commission action pursuant to §18.84",250(b)(2) of the Tigard Municipal Code (TMC) regarding the request for a planned unit development (PD 2-82) and a subdivision (S 5-82) filed by Century 21 Homes, Inc., (the "Applicant"); and WHEREAS, the subject property consists of approximately .58 acres, tax lot 2200 and 2300, which is located at 118.') and. 11900 SW 98th Avenue, north of Southern Pacific Railroad Tracks; and WHEREAS, the Planning Commission held a hearing on July 20, 1982 for Preliminary and General Plan Review of Phase I with a proposed 39 unit single family subdivision on 3.75 acres. Approval was granted for a Preliminary Plan Review of Phase I giving tentative approval of the general concept of cottage-type housing in the zone. General Plan Review was delayed until resubmittal of information dealing with streets, parking and emergency vehicle access On September 7, 1982, the Planning Commission conducted a hearing for General Plan Review and approval of a six lot subdivision on .58 acres as Phase I of the proposed project. At that meeting,, no persons appeared in . 1 opposition to the request. The Planning Commission approved PD 2-82 and S' 5-82 of Cambridge Square Phase I with the following conditions. 1. The applirlant shall apply for Preliminary Plan, General Plan and Subdivision approvals for Phase II of Cambridge Square at a later date. 2. The applicant shall submit sewer improvement plans, all street improvement plans, all water improvement plans and, storm drainage improvement plans to the City Engineering Division to be approved prior to issuance of any Building Permits. 3. Full half-street improvements shall be made to SW 98th. These improvements shall be bonded for 100% of the estimated construction costs prior to issuance of any Building Permits. In addition, a bond shall be posted for 100% of the cost of water, sewer and storm drain improvements required to serlre the site prior to issuance of any Building Permits. 4. The on site street improvements shall, be completed prior to the issuance of Occupancy Permits. Q 5. No changes shell be made to approved plans without approval of the appropriate City Department. • 6. The 32' section of road off, 98th Avenue shall be a public street. 7. A sidewalk shall be constructed on at least one side of the street and the cul-'der.sac. k ESOUT.ION ' + 82-//41 • . A t WHEREAS, Upon staff review of conditions Nos. 6 & 7 with the Director of . Public Works, it was determined by staff that clarification of these two conditions was necessary. Pursuant to TMC §18.84.250(b)(2) the City Council of the City of Tigard on its motion called for review of the conditions attached to S 5-82 and PD 2-82 with the stipulations that review would be ; confined to the record of the hearing; and . WHEREAS, the City Council pursuant to TMC §18.84.050(d)(3), held a hearing on these requests on September 27, 1982. At that hear° g, the Applicant, the Director of, Planning and Development, and Director �� Public Works spoke in favor of the project. The Director of Public Works provided information • concerning the standards which he required for streets and sidewalks which • would be required under conditions 6 and 7 of the Planning Commission approval; and WHEREAS, the City Council acknowledges the following findings of fact: 1. The approval sought is for .58 acres representing Phase I of Cambridge Square. • 2. The LCDC statewide planning goal relating to transportation, Goal #12, was developed with the intent of providing a safe, convenient and economic .- transportation system. The subject site would be accessible via 98th Avenue. The developer will be required at a later date to extend , Commercial Street, in front of the site, to connect 98th to 95th Avenue to allow for better, traffic circulation in the area. Half street improvements will be required in Phase I on SW 98th Avenue. All streets ;' .. within the Phase I limits shall be improved or bonded as required by the Engineering Division prior to issuance, of building permits. 3. Policy 9 of Tigard's NPO #2 states that urban medium residential areas .,.; will be developed with paved streets, curbs and gutters, and walkways, according to City or County standards. All utilities will be, placed underground. ' + 4. Policy 10 of Tigard's NPO #2 states that development will coincide with the provision of public streets, water and sewerage facilities. These facilities shah: be (a) capable of adequately serving all intervening properties as well as the proposed development; and (b) designed to meet. City or County standards. 5. Section 17.06.065 of the TMC, Criteria of Approval, requires that no preliminary plat for a proposed subdivision and no map or major partition shall be approved unless: (1) Streets and roads are laid out so as to conform to the plat6 of subdivisions or maps of major partitions already approved for adjoining property as to width, general direction and in all other respects, unless the City determines it to be in the public interest to modify the street or road pattern; (2) Streets and xo,s.ds held for private use are clearly indicated on the tentat.lvve Flan and all reservations or restrictions relating to such private raids and streets are set forth thereon, (3) The preliminary plat cdr p±,es with the comprehensive plan, the applicable zoning regulations; and the. regulations A within this title; and (4) There will exist adequate quantity and quality of water and an adequate sewage disposal system to support the proposed. use of the land described in the proposed plat; and i! In addition, all streets within the Phase I limits shall be ` improved as required by the Engineering Division prior to issuance 7 , of Building Permits. 2. NPO # 2 POLICIES POLICY 9. Urban medium density residential areas will be developed with paved streets, curbs and gutters, and walkways, according to City or County standards. All, deviations or variances from the standards prescribed by this title and in particular, in specific terms, all deviations or variances from the standards and specifications and requirements of Title 17 of this code, which are being proposed to be varied from, shall be addressed in writing with a showing that the public health, safety and welfare will be best served by such proposal. 17.16100 Tentataproval. (a) Within sixty days of the date of submission of the preliminary plat, the Planning Commission will review the plan reports of the agencies listed in Section 17.16.090 and may give tentative approval of the preliminary plat as submitted or may modify the ^ plat or, if disapproved, shall express the Planning Commission's disapproval and reasons therefor. (b) No tentative plan for a proposed subdivision and no tentative plan for a major partition shall be approved unless: (1) Streets and roads are laid out so as to conform to the plats of subdivisions or maps of major partition already approved for adjoining property as to width, general direction and in all other respects, unless the City determines it to be in the public interest to modify the street or road pattern. (2) Streets and road held for private use are clearly indicated on the tentative plan and all reservations or restrictions relating to such private roads and streets are set forth thereon. (3) The tentative plan complies with the Comprehensive Plan and applicable toning regulations of the City then in effect. (4) No tentative plat of a subdivision or map of a major partition shall be approved unless there will exist adquate quantity and quality of water and adequate sewage disposal system to support the proposed use of the land described in the proposed plat. v 4. N \ 1 • e Commissioner Christen did not feel that the opponents who were against °r this project because they lived in 150 to 250 thousand dollar homes had a valid argument. * Commissioner Bonn did not like, flag lots, Looking at the total number of units, they were only requesting an increase of six units. He wished they could accomplish this without using flag lots, but with the street in the middle of the site it looks impossible. e Commissioner Edin commented he was in agreement with Mr. Speaker regarding the Roads. However, there is an incompatibility with parts of the neighborhood which has not been addressed adequately. What would the possibility be of having R-5 below Kabe and R-7 above? That way the R-5 Zone vJould be closer to Summerfield and the R-7 closer to the larger lots. e Commissioner Moen agreed with Commissioner Edin's comments,. he also did not think a development should be denied because of the condition of the road.. However, the density issue should not be made light of nor NPO #6's recommendation for denial. He was not sure if the, density problem had been addressed properly when the property was rezoned to R-7. Because cl► these reasons he would have to oppose this zone change. ir President Tepedino was not persuaded that the zone should be changed from R-7 en R-5. He felt the Commission should look for smooth transitr.dry changes rather than abrupt changes. He was concerned about , • the access for emergency vehicles, which is a big problem. He was not convinced that this is in the best interest of the neighborhood, the NPO, the City or the Applicant. • Commissioner Owen's general feelings about the higher density is negative However, the need and reality of smaller lots and smaller homes and the fact that there are smaller lots south of this area does not make it 100% out of place. She was interested in Commissioner Edins proposal of split density. Neither the NPO nor CCI offered testimony. • APPLICANT'S PRESENTATION was made by Bob Miller, 5164 Bobs Court, Salem, Century 21 Home, represeltative. He expressed agreement with the staff report, and mentioned slight changes in the water system and storm drainage from what is shown on their plans. PUBLIC TESTIMONY: • No one appeared to speak. CROSS-EXAMINATION AND REBUTTAL: • Dennis Russell, 12020 SW 95, raised the question of traffic which uses 95th to Commercial to get to downtown, rather than going on Greenburg and though the signal at the highway. He asked whether a stop sign could be installed to slow traffic down, and iff it would be possible to have a light at SW Commercial and Main Street. He was told how citizens can initiate such a request for traffic controls. • Commissioner Moen expressed "excitement" at the concept. He voiced his concern that there was no provision for sidewalks, and he felt this was a real safety hazard. • David Oringdul'ph, on behalf of the developer explained the concept of 24-foot one-way streets, which they felt was adequate to take care of both automobile and pedestrian traffic. Comm►.,sioner Moen still felt there should be sidewalks on one side. • Commissioner Edin raised the question of the ability of fire vehicles t to get into the cul-de-sacA This was declared. to be not a problem by staff. He expressed concern. about fire vehicles getting around on the one-way street if vehicles were parked on both sides. This has been addressed by the staff and fire officials and is not felt to be a problem. Moen gh. affirmed his conviction that particularly if there are any children in the subdivision, they must walk the streets to get anywhere if there are no sidewalks. This he considered unsafe. Commissioner Bonn, Christen and Owens had no further comments. Commissioner Speaker questioned staff whether approval of Phase I would commit the Commission to approval of the private road presently shown in Phase II. Newton stated staff was still considering this, but no decision has been reached. It was established the road into Phase I from 98th Avenue, would be a public street, the cul-de-sac a private street. Commissioner Edin expressed considerable satisfaction : with the concept. Commissioner Edin favored a sidewalk on one side. o Commissioner Moen MOVED approval of PD 2-82 General Plan Review and S 5-82 Subdivision of Cambridge Square Phase I based on discussion at this hearing and staff findings, with conditions 1 though 5 as stated in the staff report, and adding there Conditions: 6.
