SITE DESIGNATION: The site is presently zoned R-5 "single-family residential" in conjunction with the Tigard Comprehensive Plan. PREVIOUS ACTION: On June 8, 1981, the Tigard City Council approved a Tigard Comprehensive Plan revision from B.77,7 to R-5 for the subject site, I. FINDINGS OF FACT: 1. The applicant's request for preliminary plat approval is in Conformance with Section 17 .06 .065 of the Tigard Municipal Code, to subdivide, a 1.7 acre parcel into 6 lots with a minimum lot size of 5000 square feet, 6 dwelling units per acre Maximum Density. 2 , Applicable NPO #5 policies are as follows: See Policy 2, 3, 8, 13 and 26 . 3 . 'There is one (1) two story residential building on the subject site which will be demolished by the time of develop- ment. 4 . The site has a gentle slope toward the east. The surrounding 1 land uses include single-family residential to the south, east, and west, and both single and multi-family residential to the north. 5. Acce5s to the subject site will be provided by 79th and • Bonita 'Streets (collector streets) . The right-of-way for a collector is sixty (60) feet. The current right-of-way on both 79th Street and Bonita Road is forty (40) feet. A storm drainage plan was not indicated on the preliminary plat. II. CONCLUSIONS: 1. The proposed preliminary plat conforms to NPO 45 plan in that the lotting pattern is for residential purposes . Also, lots meet the minimum lot size requirements in the, R-5 zone. 2 . Both sewer and water services are available to the site to facilitate the proposed density. 3. Adequate right-of-way (10 feet) on Bonita Road and 79th Street will be provided by the proposed subdivision. III. STAFF RECOMMENDATION: Staff recommends approval of the preliminary plat of Bonita Park, subject to the following conditions: I. No Building Permit shall be issued until Tigard City Council approves the Zone Change Annexation accepting the property into the City. 2. Bonita Road is substandard. A nonremonstrance agreement for each parcel shall be recorded/made, a part of the final plat agreeing to future improvements to Bonita. A ten (10' ) feet dedication along full Bonita Road frontage shall be required. 3. A nonremonstrance agreement must be recorded by Washington County and returned to the City of Tigard Planning Department before issuance of Building Permits or change of property • ownership. AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION FOR A COMPREHENSIVE PLAN REVISION TO THE 1977,05 PLAN MAP OF THE CITY OF TIGARD DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. (CHATTERLEY) TIME CITY OF TIGARD ORDAINS AS FOLLOWS SECTION 1: Finding that the lands hereinafter described are now classified as R-7, and further findings that pursuant to procedures, the above stated application for a Comprehensive Plan Revision was presented at a public hearing. Therefore, the Council adopts the following substantive finding: A. That the proposed zoning compatible with the surrounding �. neighborhood as determined by the Tigard Planning Commission. SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the Tigard Municipal Code, this request for a Comprehensive Plan Revision of the NPO ##5 Plan Map of the City of Tigard is hereby approved subject to provisions of Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits "A" and "B"attached, and made a part of this Ordinance. Bonn felt the concerns expressed at the previous meeting had been properly addressed, and that the elan as, pre- • sented is a good one. Owens felt that the density is quite acceptable on this rather small site. Helmer agreed with the density as proposed, but expressed concern over maintenance of the common park, feeling it should be eliminated. Kolleas and Herron agreed to the density but felt the maintenance of the park would be a problem.
