That in order for Larry Grayson, the developer • of Kneeland Estates, to commence construction on his project, • pursuant to conditional use CU23--80) the appeal filed by Tualatin Development Co. , Inc. , as a result of the Planning Commission hearing held on January 6, 1981, must first be disposed of. 2. Amonrother issues raised in its appeal, Tualatin Development Co. , Inc. objected to the increase of traffic with.:tn TDC's Copper Creek development (ZC 1-80 and S 3-80) inasmuch as TDC' s access to Durham Road is temporary only and is due to expire on September 20, 1982. 3. That substantial financial damage will be done to both Larry Grayson and to Tualatin Development Co. , Inc. if: (a) Gra Y son s project is delayed, and (b) if access to the Copper Creek project is terminated before all residences in both projects have been readied for occupancy. The measure of damages is unestimated at this time because p increase of of the anticipated � traf fic flow in both projects. 4. There is a public need to commence construction of the residences as soon as practicable in. both Kneeland tstates and the. Copper Creek development. Our original submittal, about two months ago, was for 145 lots. The new plan includes 130 lots which was approved by the City Council under a planned development on September 22, 1980. A fee of $975.00 was included in the original submittal for 145 lots. Since our revised plan has only 130 lots, we are requesting that the City re-imburse Tualatin Development Company the difference between the plans of 15 lots which works out to be $75.00. Tigard Planning Commission on May 20, 1980, the first stage of Copper Creek was given preliminary Design Review '(,.. approval based on satisfaction of the following Design conditions: 1) Redesign access to Lots 1 .. 4; 2) All lots shall be redesigned so as to not include sensitive land areas; :'c . 3) Elimination of the southern cul-de-sac and provide a roadway to be continued south to Stage, 110 The present proposal has bee designed to satisfy each of these concerns: 1) Access to Lots 1 ,- 4 is achieved by a 30 foot private drive, common to these lots; 2) Lotting pattern has remained outside the sensitive land areas; 3) A 50 foot right-of-way has replaced the southern cul-de-sac and now provides additional access to Stage II . Due to the implimentation wit reguard to elimination of the southern . cul-de-sac, the division between Stage I and Stage II has been shifted north to the rear property line of Lots 14 and 15. We have asked and . if, received permission from the Planning Director, Mr. Aldie Howard, to reduce the lots in Stage I to the 14 shown in the Preliminary Plat.
