The applicant is requesting preliminary plat approval in accordance with Section 17.16.100 of the Tigard Municipal Code to subdivide a 3.34 acre parcel into 20 lots with a minimum lot size of 5000 square feet, 6 dwelling units per acre Maximum Density. 2. Applicable policies from the NPO #5 Plan are as follows: POLICY 2: Residential subdivision will be developed with paved streets, curbs and gutters, street lights, and walkways, according to City or County standards. All utilities will be placed underground. POLICY 3: Development will coincide with the provision of public streets, water and sewerage facilities These facilities shall be (a) capable of adequately serving all intervening properties as well as the.proposed development and (b) designed to meet City or. • County standards. POLICY 26: With•;n the residential portions of the NPO, on Durham Road, Hall Boulevard, and Bonita Road, the City's arterial street standard e shall be reduced to the following standard: The improved pavement section shall consist of a two lane 'roadway with a center turn lane at intersections, a landscaped median strip where turn lanes are not necessary, a bikepath on one side and a sidewalk on the other; with all these improvements to take place within a 90 foot wide right-of-way section. 3. Section 17.16.100E Tigard Municipal Code, states that: "No tenative plan for a proposed subdivision and no tentative plan for a major partition shall be approved unless a. Streets and roads are laid out so as to conform to the plats of subdivisions or maps of major partitions already approved for 1 adjoining property as to width, general direction and in all other respects, unless the City determines it to be in the public interest to modify the street or road pattern, b. Streets and roads held for private use.are clearly indicated on the tentative plan and all reservations or restrictions relating to such private roads and streets are set forth thereon. c. S 15_78 r Page 3 - 4. The site is a vacant, relatively flat field, gently sloping at a 1-3% grade towards the west. Surrounding land uses includes the following: To the north, Hambach Park, a 30 lot single family subdivision under construction; to the, south, a flat vacant field to SW Ross Street; to the west across Hall Blvd., a small orchard with a farm house and Soheckla Park Estates, a 68 lot single family subdivision under construction; to the east, single family houses on large lots on SW 81st. 5. Sewer service is available to the site from an 8" line at Hall Blvd. and Murcock Street or from an 8" line in 83rd Avenue at the .south line of Hambach Park Subdivision. The preliminary plat proposes to extend an 8" sewer Line 120 ft. . along Hall Blvd. and thence along the common lot lines of Lots 14 and 15 to the cul-de-sac in LaMancha Estates. 6. Water service is available to the site from a 12" Tigard Water District line in Hall Blvd. or a 6" line in 83rd Avenue from Hambach Park. The preliminary plat proposes to extend a 6" water line from Hall Blvd. through Lot 13 to the a cul-de-sac in. LaMancha Estates. 7. A storm drainage plan was not indicated on the preliminary plat. 8. The existing right-of-way on SW Hall Blvd. is 60 feet, with 22 feet of pavement _ d. inadequate shoulders. NPO Plan #5 and i in fair ( e. patched) condition an #6 designated SW Hall Blvd. as a "Residential Arterial" with a 90 foot right- of-way, 2 lanes, 24 feet paved with a 14 foot landscaped median, capable of handling 6-12,000 vehicles a day at a driving speed of 25-35 miles per hour. The preliminary plat proposes to dedicate 45 feet of right-of-way from the centerline of SW Hall Blvd. <y 9. The Tigard Environmental Design and Open Space Plan designates SW Hall Blvd. as a "visual corridor". As a condition of approval of Hambach Park (S l-78) , immediately north of LaMancha Estates, a 15 foot landscaped earth berm, was required along SW Hall Blvd. frontage. • 10. No fire hydrant within LaMancha Estates was indicated on the prelimiary plat. E. Gruelich, Deputy Fire Marshall Tualatin Rural Fire Protection Joseph y � � Rural District, stated in a letter dated February 20, 1980, that a fire hydrant will be required to be installed at the corner of 83rd and the cul-de-sac street in LaMancha Estates. 11. A revised preliminary plat was submitted by the applicant following the Planning Director's denial of the original one on January 17, 1980. The proposes revised plat ro oses access to LaMancha Es tates from the north via 83rd Avenue, no direct access from Hall Blvd., and the extension of 83rd Avenue as a stub street to the south line of LaMancha Estates, to serve future development to the South. The lot lines 'between lots 15/16 and lots 11/10 are 76 feet not 86 feet, as indicated on the preliminary plat. Lots 10 and 16 as proposed are slightly less than 5000 sq. ft., approximately 4970 sq. ft. each. The other lots range •. from 5000 to 7300 sq. ft. CONCLUSIONARY FINDINGS: 1. The proposed preliminary plat conforms to NPO #5 plan in that the lotting pattern is for residential purposes, but does not conform to the lot size requirements of Title 18 of the Tigard Municipal Code (Zoning), in that lots 10 and 16 are less than 5000 sq. ft. An adjustment to the west lot lines of these lots should be made. 2 The connection of 83rd Avenue as a stub street toathe south line of LaMancha Estates, as recommended by the Planning Director,. has been proposed; a one foot reserve strip at the 83rd Street plug should be conveyed to the city by the final plat. 3. Both sewer and water service are available to the site to facilitate the proposed density. • In consultation with the Public Works Director, these comments were made 4 : regarding the proposed sewer routing: That the sewer route to serve LaMancha Estates should connect to the Hambach Park 8" line at the south end of 83rd in, Hambach Park, rather than cut through lots 14 and 15. 4. In the 'judgement of the. Tualatin Rural, Fire Protection District Deputy Fire Marshall, Joe Gruelich, the emergency access to Hall Blvd. through lot 13 is not necessary for fire access purposes, as long as there is a provision for north south access via a through street on SW 83rd. That the lot lines on lots 10 and 16 be adjusted on the Final Plat so that these Lots meet the 5000 sq. ft. minimum lot size requirements. 2. That a one foot reserve strip in 83rd Avenue at the south line of LaMancha Estates be conveyed to the City and so indicated on the final plat 3. That the sanitary sewer route to serve LaMancha Estates be connected to the south end of the Hambach Park line in 83rd Avenue, with the approval of the Public Works Department. A storm water drainage plan and sanitary sewer plan must be submitted for Public Works Department approval. 4. Water service and sanitary service, and storm sewers shall be installed to this site prior to the issuance of a Building Permit. 5. That the emergency access easement shown through Lot 13 be eliminated from the final, plat and that a covenant restriction appear on the final plat prohibiting any lot having direct access onto sW Hall Blvd. 6. A 15 foot wide landscaped berm be provided along the SW Hall Blvd. frontage and a landscaping plan be submitted for the Planning Director's approval. Street trees be placed along all streets in the subdivision and a street tree plan be submitted for the Public Works Director's approval prior to approval of the final plat. The landscaped berm and trees should be consistent with the berm and trees in Hambach Park. All landscaping must be bonded and installed prior to issuance of occupancy permits. '. , , 7. The applicant is requesting preliminary plat approval in accordance with Section 17.16.100 of the Tigard Municipal Code to subdivide a 3.34 acre parcel into 20 lots with a minimum lot size of 5000 square feet, 6 dwelling units per acre Maximum tensity. 2. Applicable policies from the NPO #5 Plan are as follows: POLICY 2: Residential subdivision will be developed with paved streets, curbs and gutters, street lights, and walkways, according to City or County standards. All utilities will be placed underground. POLICY 3: Development will coincide with the provision of public streets, water and sewerage facilities. These facilities shall be (a) capable of adequately serving all intervening properties as well as the proposed development and (b) designed to meet City or County standards. POLICY 26: Within the residential portions of the NPO, on Durham Road, Hall Boulevard, and Bonita Road, the City's arterial street standard shall be reduced to the following standard: The improved pavement section shall consist of a two lane roadway with a center turn lane at intersections, a landscaped median strip where turn lanes are not necessary, a bikepath on one side and a sidewalk on the other; with all these improvements to take place within a 90 foot wide right-of-way section. 3. Section 17.28, Tigard Municipal Code, states that: 17.28.07G- Future extension of streets. Where necessary to give access to or permit a satisfactory future subdivision of adjoining land, streets shall extend to the boundary of the subdivision, and resulting dead-end streets may be approved without a turn-around. Reserve strips including street plugs may be required to preserve the objectives of street extensions. 17.28.150 Marginal access streets Where a subdivision abuts or contains an existing or proposed arterial street, the Planning Commission may require marginal access streets, reverse frontage lots with suitable depth, screen planting contained in a non-access reservation along the rear of side property line, or other treatment necessary for adequate protection of residential properties and to afford separation of through and local traffic. 5. The site is a vacant, relatively flat field, gently sloping at a 1 - 3% grade towards the west. Surrounding land uses includes the following: To the north, Hambach Park, a 30 lot single family subdivision under construction; to the south, a flat vacant field to SW Ross Street; to the west across Hall Blvd. , a small orchard with a farm house and Sheckla Park Estates, a 68 lot sir,crle family subdivision under construction; to the east, II single family houses on large lots on SW 81st. 6. Sewer service is available to the site from an 8" line at SW Hall Blvd. and Murdock Street (Hambach Park) . The preliminary plat proposes to extend an 8" sewer line along SW Hall Blvd. from LaMancha Estates to connect with the Hambach Park line. Recent rtraffic counts (July - August 1979) on SW Pall Blvd. , indicate an average daily traffic of 6,380 vehicles a day on the SW Bonita Road to Pinebrook Section, and 5,163 vehicles a day on the Pinebrook to SW Ross Street section. Posted speed limit is 45 miles per hour. In the 1,600 foot segment of SW Hall Blvd. between SW Bonita. Road and SW Ross Street there are presently two intersections at Pinebrook Street, about 370 feet south of SW Bonita and ad SW Murdock Street, about 400 feet south of Pinebrook Street. The preliminary plat proposes to create a 3rd intersection in this segment, at LaMancha Drive, only 250 feet south of SW Murdock Street. 11. The Model Subdivision Regulations, American Society of Planning Officials, ' 1975, recommends that the ''number of intersections along major street should be held at a minimum" and that "intersections of major streets shall be at least 800 feet apart". 12. A letter to the applicant on January 26, 1979 from the State Highway Division Assistant District Engineer, regarding the previous subdivision proposal (with the same street layout) , stated that the Highway Division preferred that "the access as shown to SW Hall Blvd. be eliminated and the property access by way of the subdivision which adjoins it to the north". CONCLUSIONARY FINDINGS: 1. The proposed preliminary plat conforms to NPO 45 Plan in that the lotting pattern is for residential purposes, and conforms to the lot size requirements of Title 18 of the Tigard Municipal Code (Zoning) . 2. Both sewer and water service are available to the site to facilitate the proposed density. 3. Adequate right-of-,Way on SW Hall Blvd. (45 feet) will be provided by the subdivision. > 4. A landscaped berm along SW Hall Blvd. would be in keeping with the Environmental . 1,,, Design Open p required berm along Hambach Park. STAFF RECOMMENDATION: Staff recommends that the proposed preliminary plat of LaMancha Estates be modified and resubmitted for our approval, subject to the following conditions: 1. A cul-de-sac be located at the west end of LaMancha Drive with emergency vehicle access to SW Hall Blvd. 2. Connection of 83rd Avenue be made to the so+s.ith line of Tax Lot 1901 in a stub street with a street plug. 3. A landscaped berm be provided along the SW Hall Blvd. frontage and a land- scaped plan be submitted for design review prior to approval of the final plat.
