The nature of this proposal is to request duplexes in a residen- tial zone as required in the Municipal Code: Conditional Use in a R-7 zone. (1.) Duplex residential, with a minimum lot size of ten thousand square feet: One duplex per lot. 2. Duplexes in a residential zone compliment the Comprehensive Plan. The Tigard Comprehensive Plan has as objectives in urban low-density residential; (1) to provide areas of the City having a. predominately • Single-family residential character ; (2) to permit densities that will economically support the cost of necessary public services and facilities such as paved streets, pedestrian ways and utilities; (3) to permit a variety of housing types to meet the needs of differ- ent family size and family income. The Tigard Community Plan allows limited mixing of housing types in the urban low density residential areas. Some mixing i8 appropriate when sensitively designed into the residential areas 3. There is a community need to provide greater diversity of housing density than supplied by single family units alone. Duplexes are one answer to this problem. Duplexes supply residential shelter at more reasonable prices while protecting the bas ic character of the neigh - . borhood0 Such an alternative helps supply the demand oy the elderly with reduced financial capabilities so that they can continue to live in the community as well as take care of younger coupes and working single people as they move up the economic ladder towards home owner- ', -. r ship in community. The proposed land use is more suitable than other locations in t e city because it best meets the conditions usually recommended for duplew e . within the low density residential area du- xes� for ex�pl�-� � � plexes es are recommended on lots that are less appropriate for single • family homes* These would be along major thoroughfares or collector w • • K o streets, as buffers between schools and single family areas, abutting marginal lands such as flood plain areas, etc. The subject property location is along a collector street, Tigard Street, it is adjacent to a future Senior High School on the West and borders Fenno Creek and its flood plain on the South and East. To the North is future residential land(presently being farmed with a single ' family residence thereon) , but located in Washington County. The nearest City residence is located across Fenno Creek to the East over 400 feet away W The precedent has been set in the area for within one-quarter of a mile radius there are presently six duplexes located along Tiedeman--four on the East side of Fenno Creek and adjacent to the balance of this property along Tiedeman and two in Clydesdale Subdivision across from Fowler Junior High School. Three other duplex units are located West of the subject development on Tigard Street at 1140 Place. 6. The impact or effect the proposed development and use will have will be minimal. The Senior High School to be located on the West makes duplexes desirable as a buffer between such an extensive ed- ucational use and more residential areas. The County residential area to the North will be screened from the housing units by on site landscaping such as the hedgerow that presently exists along the w road. A heavily traveled collector street, Tigard Street, also divides the subject area from that to the North. The required sub- division standard for a half ' street improvement will make this barrier even wider than it presently is. The remainder of the sur-', rounding area is bounded by Fenno Creek on the East and its flood plain on the South which is not buildable land or occupied by any residences or structures of any kind. The closest residence is 400 feet away to the East at the intersection of Tigard Street and «,/. Tiedeman and is itself screened by many trees on its own site across • Fenno. Creek. Five duplexes will not increase the traffic load much more than five full sized houses that would tend to have larger single family households. 7. Public services are all available to and on this site. The sub division will allow a half street improvement which will widen Southwest Tigard Street for over 600 feet and thus improve the over- all traffic capacity and flow in the area. (Added) The subdivision represents only about 1.15( 50, 200 Sq Pt) acres of the total 7. 79 acres in the subject parcel along the West bank of Fenno Creek. Proposed disposition of the 0.64 acres that remain, follows, ,es, the Fanno Creek to the a. ��.dicat�.on of 50 feet on thy. West .�a.de of �' City of Tigard to aid in accomplishing the Comprehens ive Plan objective of utilizing ?anno Creek as the basic element in the r Cr enway System." (Approximately 1.09 acres) b. Suggested covenants would prohibit obstructions of any kind to be built in the flood plain which is below the 100 year flood contour of `156 feet. This would specifically apply to ',:Tact "A" which is entirely in the flood plain. The subject Sierra Subdivision is above this contour. No solid fences or . any obstacle that would tend to damn up or restrict the natural flow of water in the flood plain could be constructed. 9. (Added) All staff recommendations as originally submitted are satisfactory. In recommendation 7 the minimum floor elevation of not less than 3 feet ab' ve the 100 year flood plain level is mainly applicable to Lot 5, the lowest lot. In addition it is noted that the standard setbacks will be observed(ie front yard 20 feet, side yard 5 feet and rear yb't■rd` 15 feet) . The rear yard setback of 15 feet will mean that no building will be closer than 15 feet from the 156 foot contour which will be the rear lot line of the plat. Code) There appears to be a difference of opinion between the Planning Commission, the Planning Staff and the Publics on how to properly Interpret the Flood Plain Ordinance-Chapter 18.57, Flood Plain ? District. From the meeting of September 5th on Sierra Subdivision, . least it became fairly Chairman has a varying a.:rl obvious that at the opinion on interpretation. Because of this there is a need for guidance to be given to the whole Planning Commission by the Planning Staff and Legal Council so that proper interpretation and administration of the Flood Plain Ordinance can be given to the Public The chief question seem to be whether or not flood plain- land . may be subdivided and subsequently platted with all or parts of an i�ndividu.al lot or tract being located in the flood plain As one who helped draft and adopt the Flood Plain Ordinance in the City of Tigard, 1 know that the intent of the Ordinance was net : to arbitrarily prohibit subdivision ,ir, the flood plain, but rather control the uses and what could be done therein. A legal inter p,rtation from the City Attorney would help a great deal at this juncture so that both the Planning Staff, the Planning Commission ,,;, . as a whole and. the Public may have some common understanding and I interpretation as to what can or can not be done with land both in and adjacent to the flood plain distriOt. • The Ordinance itself seems to be rather clear, but individual interpretations such as those rendered somewhat unilaterally by , fi, the Planning Commission Chairman on September Soh make it very difficult to know how to proceed today on any matter that pertains to the flood plain. Having 'worked with the Planning Staff in this area to date it is also apparent that the Staff and Chairman do not concur on interpretation. A great deal of vacant land is still affected by the Flood Plain Ord i.nanco' so to constructively aid future planning efforts, a clear decision on the above is necessary at this time. (A_maaf,tsif:Is_a2saal.s is a lot with both buildable land not in the flood plain and some in the flood plain such as the rear of a lot being in and/or including a creek and its adjoining lowlands.
