The answer gi•'cr vVas that any such impro iemsnt,s would not be standard. Thereupon she spoke in favor of the proposal and commendz.cl the applicant on his working with the neighboring residents r • but reiterated the impracticability of th Gaarde Street residents dedicating property for a wider street. - • • : David reF:aven, 18735 S.W. Fairview Co;art, directly to the east of thy applicant's property, expressed concern about the area in which a 4, , ,\ sewer lire was installed about 1 years ago, which he labeled as •' "a sea of mud . . a health hazard." He asked who will restore and • maintain the creek bed? It was stated this would be addressed in cross examination. ? 2. Opponent's. Epina Porter, 11875 S.W. Gaarde, stated the applicant had worked very Well with the neighbors; that the reason for rejection by the City Council of the street through the property was that it was not in accordance with the comprehensive plan. She commented on the great change in both the staff and the commission since this issue was previously heard, and that accordingly much of the past history is unknown to the incumbents. NPO 3 designated Gaarde as a collector street with only a 50 fort right of way; that additional right of way Q . • should come from the other side of the street because of the setback specified by Washington County about eight years ago when these houses were built. She advocated the sidewalk within the existing right of ' °" way, since the neighbors had quite recently rethought their previous approval of the bike path concept. D. Staff Recommendations. MINUTES i ,s TIGARD PLANNING COMMISSION February 6, 1979 - 7:30 P.M. page 10 E. Commission biscussion & Action: c O Speaker commented that the impact of the public testimony has been not= the development itself, but on the Gaarde Street sidewalk issue. He asked the rationale for the 400-foot limitation to the cul-de-sac, responded to by Selby: access for emergency vehicles. He stated it appeared the choice was either to have the through street (which the City Co'znci1 had denied) or allow the longer cul-de-asac, to permit the reasonable development of the property, 'e• suggested a nonrem nstranc e agreement might be appropriate with respect • to the street improvements. O Woad inquired if there is a good engineering reason why a shift in the street alignment could not he made in recognition of the problems to the residents on Gaarde, o Staff agreed, so long as there was not,an abrupt shift. o Wood then commented on the Condition No 8 and the potential hardship on the applicant over a long period of time should neighbors not choose to connect to the sewer, which is available. o Smith commented on the lack of a right of one property owner to discharge sceptic tank effluent onto other property. This was responded to by doward, who agreed to have staff work with the Rose Vista residents, in the process commenting that annexation is not the most, ro popular avenue to take, but that the applicant should not be denied the ' • use of his property for an extended period of time. 0 Smith noted that since the residents on S.W. Rose Vista do have five foot easements for utilitieq, they can have access to sewer. o Howard reported on his contact with Mr. Ames of Ames Orchards Subdivisions concerning the cleaning up of the creek bed. He stated emrhatically this will not be a, park but will be left in its natural state and will be sprayed for insects if the city budget permits. o There was discussion among Wood, staff and Cause about how sidewalks (which the applicant agreeable to consider providing) can be secured. Mr. Gause expressed the opinion a Sidewalk would be possible if the curb were placed at the edge of the present pavement. o Wood felc it desirable to,keep the City's options open, and thereupon moved for approval based on staff findings and recommendations, but. with 1ecommendation No. 8 deLeted, and that in place of the half street improvements rents called for by Pecornmendation 2, the apply::r ant shall submit a nonremonstrance agreement to be made from the southwe:, corner of • Tax Lot 3800 to the southeast corner of Tax Lot 3600 along S.W, Gaarde Street. Request: To subdivide a 5.20 acre parcel into 14 lots ip an R-10 "Single Family Residential" zone. This item was referred to the Planning Commission for review and approval by the Planning Director on December 26, 1978. I. Findings of Facts: .1, • 1. The site is designated Suburban Density Residential on the NPO #3 Plan and zoned R-10 "Single Family Residential". 2. Applicable policies from the NPO #3 Plan are as follows: t Policy 4. Protect the existing suburban character of this portion of the Neighborhood from encroachment by higher density develop- ments. The maximum overall density of development will be three dwelling units or nine persons per gross acre. A higher density — ' of four units or twelve persons per gross acre is a possibility within an approved planned unit development. Policy 5. Residential subdivisions will be developed with paved streets, curbs and gutters, street lights, and walkways according to city or county standards. All utlities will be placed under- ground. • Policy 6. Development will coincide wlth the provision of public streets, water and sewage facilities. These facilities shall be (a) capable of adequately serving development and (b) designed to meet city or county standards. • Section 17.16.100 states that: /. .) "No tentative plan for a proposed subdivision and no tentative plan for a major partition shall be approved unless: A. Streets and roads are laid out so as to conform to the plats of • stbdivision or Maps of major part!„tions already approved for adjoining property as to Width, general direction, and all other ( respects unless the city determines it to be in. the public interest to modify the street or road pattern. .a* • • aat _ • I • STAFF :REPORT AGENDA 5,.4 TIGARD PLANNING COMMIS SION February 6, 1979 - 7:30 P.M; M Page .2 b. Streets and roads held for private use are clearly indicated on the tentative „plan, and all reservations or restrictions relating to such private roads and streets are set forth thereon, • 3. The applicant is requesting preliminary plat approval in accordance with Section 17.16.106 of the Tigard Municipal Code to subdivide a 5.20 acre parcel into 14 lots with a minimum lot size of 10,000 square feet at S.W. Gaarde Street (east side of S.W. Rose Vista Drive) . • 4. 5.2 acres x 3 units per acre = 15.6 possible suburban single family units. Therefore, the applicant is proposing 1.6 units below the allowable .cumber of units. 5. Creek Side Park is proposed with 12 of the 14 lots entering onto a cul-de-sac and the remaining two lots entering onto S.W. Terrace Trails Drive. Provision has been made for open space and storm water detention. 6. Cross Creek Court is shown as a 600 foot long cul,-de"-sac designed to serve lots 1-6 and lots 9-14. Lots 7 and 8 will front on S.W. Terrace Trails Drive and have no direct access to Cross Creek Court„ Section 1.7,28.110 Cul-de-sac states that: ",A cul-de-sac shall be as short as possible and shall in no event be more than 400 feet long. 7W North Star Subdivision was a previous subdivisiOn application (S 22-77) which was proposed for tax lots 5700, 390J and 4000 a year ago. The application was approved by staff but denied at they Planning Commission and City Council level. North Star E bdivision was proposed with a through street and no open space provisions. The residents from the Terrace Trails Subdivision were assured by the City Council that a street connection between their subdivision and the southern adjacent North Star Subdivision would not be required. 8. The site is covered with a mixture of conifers and deciduous trees. The elevation at S.W. Gaarde Street is 300 feet, then moving in a northerly directions the property drops off sharply' within an area containing a natural drainage swale (250 feet) which traverses the parcel in a northeast/southwest direction. The elevation 'shell rise) again to 500 feet along the west side of the parcel at the north property line which abuts the Terrace Trails Subdivision. ) 9. The applicant has shown the public utility e'.sements (PUE) to be provided on 5-foot easement. Section 17.32.030 Easements (2) of the Tigard Municipal Code requires that utility line easements shall be a minimum of ten feet in width. 12. Topov provide for the construction of Cross Creek Court from S.W. Gaarde Street, the applicant is proposing to traverse the drainage swale bk located in the southern portion of the site The grade at this location is rather severe (over 15%) and will require fill to facilitate the construction of the street. No indication nas been given on the plat as to what percent the street 0..\ grade will be where the swale is to be traversed by the street. 0..\ Section 17.32 030 (b) Watercourses of the Tigard Municipal Code states: Where a subdivision is traversed by a watercourse, drainageway, channel or street, there will be provided a storm water easement A': or drainage right-of-way conforming substantially with the lines '` ,, of the watercourse, and such further width as will be adequate for • b' the purpose. Conclusionary Findings: 1. Tim proposed preliminary plat conforms to the NPO #3 Plan in that the proposed lotting pattern is for residential purposes and adheres to the dimensional requirements of the zoning code. 2. dequate sewer and water service are available to the site. It is probable that lots 1144 would lie on the drain field of the homes adjacent to the vest property line of the plat. Tax lot 3500 which abuts the site of the proposed subdivision om its eastern boundary is largely undeveloped. When developed the dwelling on tax lot 3500 will need access to sewer. 3. Access will be available to all lots within the development, and each lot N# ' ,a.s proposed will abut a public street. 4. Alteration of the natural drainage area shall be made only with the approval of the Engineering Department. 5., Southwest Terrace Trails Drive as originally platted was intended to be a through street to Gaarde Street. Ken Selby Associate Planner ,P City of Tigard .,.--- Tigard City Hall 2420 SW Main Street ,. Tigard, Oregon 97223 ..!. ..,-, Dear Mr. Selby: ,..'. We are submitting a preliminary plat of Creek Side Pak on behalf of our client , . . Ed Gause. The property is located approximatley 700 feet south of SW 121st. Avenue on the north side of SW Gaarde Street. The site consists of 5.2 acres and has a creek running east & west through it. . Approximately a year ago, a preliminary plat North Star was approved for Dave achg1/4 but was later denied by the Planning Commission and City CouncTT: The ..,, • , , main reason for denial was that the residents of the area did not want SW Terrace ..,, Trails extended on through to SW Gaarde Street. -,, , After a thorough site inspection and talking v,ith surrounding neighbors, it was decided by the new developer to run a cul-de-sac into the site and not extend SW . , Terrace Trails. However, we are proposing to remove the street plug at the end of , ,...:. SW Terrace Trails to gain access to two building sites. We are also proposing : to construct a half street improvement with a bikepark along SW Gaarde St: from the ' west side of tax lot 3800 to the east side of tax lot 3701 , Since the existing homes along SW Gaarde St, are built close to the rcld, the improvement would take . '*'.. place within the existing right of way. , Another concern was that storm drainage be taken care of on site and open space ' , . . , .,.,i provlded. This plan allows for this in tracts A&B and Tigards storm drainage policy ; ) , . 6 . ..:.) - - , guarantees against any additional storm run off down stream. If there are any questions or additional information needed, please do not hesitate to cll . i. .., Sincerely, ..c ., / WAKII. ASSOCIA S INC. . , i ialt , 1 1 '4‘4,....
