Walnut Street - Tigard, Oregon DOCKET: S 7-77 REQUEST: To create a four lot subdivision on a 1.17 acre parcel in a R-7 zone. LOCATION: S.W. Durham Road, west of S.W. 92nd. Avenue . APPLICANT: Charles Coston I. FINDINGS OF FACT: 1. The applicant is requesting preliminary plat approval in accordance with Section 17.16.100 of the Tigard Municipal Code to subdivide a 1.17 acre parcel into four lots with an average lot size of 11,000 square feet in a R-7 zone on the south side of S.W. Durham Road, west of S.W. 92nd. Avenue. • 2. The site is designated "Urban Low Density Residential" on the Tigard Community Plan, 1971 and zoned R-7. Attached as conditions to the application of City zoning (May 3, 1977) were the following: a. A one foot access control strip be dedicated, to the City prohibiting direct access onto S.W. Durham Road but reserving temporary access until permanent access . is provided through the adjacent property to the south. b. 25 feet be dedicated along S.W. Durham Road for street purposes. 3. The applicable policy from the Tigard Community Plan, 1971, 1.,.5 as follows: a. The maximum overall density of development will be four dwelling units or 12 persm.:3 per gross acre. This amounts to a standard of 7,500 square feet of land per dwelling unit allowing for streets and other open • space. Some areas will have a lower density owing to topography, existing development patterns, or the desire of individuals to own a larger lot. Streets and roads are laid out so as to conform to the plats of subdivision or maps of major partitions al- ready approved for adjoining property as to width, general direction and in all other respects, unless the City determines it to be in the public interest to modify the street or road pattern. . b. Streets and roads held for private use are clearly indicated on the taitative plan and all reservations or restrictions relating to such private roads and street are set forth thereon. c. The tentative plan complies with the comprehensive plan and applicable zoning regulations of the .City then in effect. d. No tentative plan of a subdivision or map of a major partition shall be approved unless there will exist adequate quantity and quality of 'water and an adequate sewage disposal system to support the proposed use of the land described in the proposed plat. II. STAFF OBSERVATIONS: The site is flat, presently vacant with numerous 14 to 16 foot • tall evergreen trees scattered around the site and surrounded by a horse stable to the south, a single family residence on a large lot to the east, vacant land on the west, and the Summerfield Planned Development on the north. Adequate water and sewer is available to serve the proposal both of which are available from main lines in S.W, Durham Road. it* The parcel abuts S.W, Durham Road, which is a county road and designated an arterial on the Tigard Community Plan, 1971. Sewer is available to handle the proposed density on this site via a trunk line in S.W. Durham Road. 44. Water service is available to facilitate the proposed density on this site via a main line in S.W. Durham Road. Although the lot has legal access directly onto S.W. Durham ) Road, the coordinated development of this riarcel and the adjacent parcel to the south permanent access could be provided through that lot on S.W. 92nd Avenue, This arrangement would support the arterial streets policies of the Tigard Community 03 I . A ,*4 Page 3 • • Plan, 1971. Staff has met with both applicants, and both have • stated their agreement to such a proposal. The lotting pattern as proposed does not create lots which all abut a public street. In order to satisfy the condition of the • zone change, access can be provided for the lots 3 and 4 by ease- merits until access is provided through the adjacent it to the south, as noted on the preliminary plat. III. CONCLUSIONARY FINDINGS: 1. The proposed preliminary plat conforms to the Tigard Community Plan, 1971 in that the proposed lotting pattern is for residential purposes, conforms to the dimensional requirements of Title 18 of the Tigard Municipal Code (zoning) , and furthers the arterial streets policies of the Tigard Community Plan, 1971. 2. With the attachment of appropriate conditions, access will be available to all lots, and each lot as proposed will abut a public street when the adjacent parcel to the south is developed. IV. FINAL ACTION: • The preliminary plat. for "Coston Place" is hereby approved subject to the following conditions: 1. Easements granting access to Lots 3 and 4 he shown on the final plat and recorded at the time of rrding the final plat. 2. The final plat dedicate 25 feet along S.W, Durham Road and show the one foot access control strip as required by zone change 9-77. 3. " The driveway providing access to the property to the south be a minimum 24' , " 4. "The driveway to Durham load be closed upon access being available to the south but maintained and available for emergency vehicle , access.
