This is to confirm our telephone conversation of May 20, 1980 concerning the above referenced matter. • As stated, I represent Mr. Richard Caf f al, one of the principals in the Berea Development which was the subject r matter of the variance proceeding B7-77 and subdivision ' proceeding S14-77. 6 As I stated in our conversation, the subdivision approval was granted upon the condition that my client at that time make certain street improvements in the area of Ash and Garrett. It was understood by all concerned that in order to • accomplish all the improvements, the city and the planning department decided Ms. Jacobson would have to participate by dedicating a certain portion of her property contiguous to the street area. At the time this was first proposed, and while the subdivision was being constructed, Ms. Jacobson refused to � so dedicate. At that time, my client extended and expended the 4* i sums necessary to make the improvements that could be made on 1•• ` the streets without the dedication. It is my understanding r that this was done with the acquiescence of the City of Tigard by virtue of Ms. Jacobson's failure to participate by 1 dedicating the necessary property _efusa Approximately two years after her ;�,� =, l r Ms Jacobson informed the city that she w''s now willing to make the dedication necessary for the total improvement of Ash. and Garrett, and my client was so notified. My basic, position is as set forth in, my letter of March 17, 1988, wherfin my client states that he is ready, willing and able to contribute and �3 pay, either to the city. or to anyone else making the necessary improvements, the sum of $7,0330 which i .the bid amount as to the cost of the improvements if all the improvements had been made at the time ,• they were originally contemplated. My clien; feels that it is unfair, inequitable and improper that they be asked to make the full improvements now, two costs years later, when the costs have .� effectively doubled. , I feel that since the improvement will be of economic benefit to the adjacent property, includiny the property which is the subject matter of the MLP, that property should be required to participate .by assisting in the improvements and making the half-street improvement required. It will be of economic benefit to Ms. Jacobson, and as I stated, my client would be willing to contribute the amount of money they would a have expended in the initial instance.. Should you decide to argue this point, I will indicate that your client's refusal to cooperate to date has been the . cause, of increased costs. E Y Obviously, Ms» acobsen's refusal to cooperate has postponed the completion of this improvement also. My concern, as the Planning Director, is to resolve the issue. The implication is that you agreed to a trade-off: % re.duced road building costs in terea in exchange for improvement to Ash ti and Garrett Streets. , Mrs. Jacobsen is willing to dedicate the land. She objected to your • original "personal design approach" in her front yard -_ i.e. slope it severely to the sidewalk. She prefers a retaining wall be installed to protect her property. We feel this is a reasonable request. Your reasons for not completing this project are not very convincing. The dea$gn capability and construction labor, material and equipment needed to accomplish this task is available. 1 think we have procrastinated long enough. In, the fall of 1977, or whatever date the developer of the Berea subdivision, Mr. Dick Caffall, received permission to make the improve.- meats it was conditioned on his providing, at his expense, half street improvements to the property in r s paragraph #1, as well as s�.d��wa.cE��. 2. I was about to sign the proper papers as property owner, when I' discovered that in removing 1. portion of my property bank, the ' developer had not advised his engineers to provide me with a drawing of how they planned contour and prevent problems with the bank. In all of my discussions with you and John Laws at the outset of the project, I have made it clear that the improvements must e done during the normal phase of construction. This was not possible due to the lack of ° " cooperation with the land owner of Trxx Lot 400. , John Laws, Mr• Cafall and myself met w�th the owner on s �to and explained • the proposed improvements. She a�e did not want any part of it Period, . Now after the phases of constructi :in are complete, she makes up her mind. The ana- logy to this is after the house is completed, she decides to put in a window. The p o scope window during the normal construction phase would have been minor, but after the house built it is a comp letly different operation, be- cause of complexity and scope of the work involved. We have dealt together in good faith to this point, but we cannottbe expected to have our costs controlled because of a third party indecision. I would like to meet with you to discuss this further. Both lines are of adequate ca- pacity to facilitate the proposed density. 3. S .W. Ash and S .W. Garrett Streets are both substandard in right-of-way and improvement width. In order to bring the existing right-of-way to meet the NPO #1 Plan standards, a five Toot dedication on the property along S.W. Ash Street and a five foot dedication along S .W. Garrett Street would be required. 4. S .W.. Creamer Drive presently terminates at the north prop- erty line of the plat . The applicant is proposing to ex-- tend S .W. Cresmer Drive through the subdivision where it will intersect with S .W. Ash Street.
